HomeMy WebLinkAboutR-87-0919J-87-915 10/2/87 Mot-87-465 (10/2 /87) RESOLUTION NO. 87-9.1 y A RESOLUTION CONCERNING THE 1988 CARNAVAL MIAMI PASEO TO TAKE PLACE MARCH 6, 1988, THE 8-K RUN ON MARCH 11, 1988, THE BIKE DASH ON MARCH 12, 1988 AND CALLE OCHO OPEN HOUSE FESTIVAL ON MARCH 13, 1988, TO BE CONDUCTED BY THE KIWANIS CLUB OF LITTLE HAVANA, PROVIDING FOR THE CLOSURE OF DESIGNATED STREETS TO THROUGH VEHICULAR TRAFFIC; ESTABLISHING A PEDESTRIAN MALL SUBJECT TO THE ISSUANCE OF PERMITS BY THE DEPARTMENTS OF POLICE AND FIRE, RESCUE AND INSPECTION SERVICES; ESTABLISHING AN AREA PROHIBITED TO RETAIL PEDDLERS DURING THE PERIOD OF THE EVENTS; AUTHORIZING THE SALE OF BEER AND WINE IN CONNECTION WITH SAID EVENTS SUBJECT TO THE ISSUANCE OF ALL PERMITS REQUIRED BY LAW; FURTHER RELAXING THE LIMITATIONS ON THE DISPLAY OF FIREWORKS TO ALLOW THE STAGING OF PYROTECHNIC DISPLAYS UNTIL 12t00 MIDNIGHT FOR CARNAVAL NIGHT AT THE ORANGE BOWL STADIUM ON MARCH 5, 1988 AND IN THE VIZCAYA AREA FOR A SPONSORS PARTY ON MARCH 12, 1988; CONDITIONED UPON THE REQUIREMENT THAT THE CITY WILL BE INSURED AGAINST ANY POTENTIAL LIABILITY AND UPON ORGANIZERS PAYING FOR ALL NECESSARY COSTS OF CITY SERVICES ASSOCIATED WITH SAID EVENTS BEYOND THE FUNDING PROVIDED BY FESTIVAL ORDINANCE NO. 10206. WHEREAS, the Kiwanis Club of Little Havana will conduct certain events during the period of March 5-13, 1988, in connection with the celebration of Carnaval Miami 88; and WHEREAS, on May 14, 1987, by Motion No. 87-465, the City Commission expressed its intent to grant the request received from the Kiwanis Club of Little Havana for street closures, authorization for the sale of beer and wine, the designation of areas prohibited to retail peddlers and extension of the fireworks deadline in connection with said events; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. Section 2. Such closing of streets is subject to State approval and issuance of permits by the Departments of Police and Fire, Rescue and Inspection Services. Said permit from the Department of Police is to be issued upon the full approval of the Chief of Police after giving all due consideration to the safety and traffic needs of residents, businesses, and religious institutions in the area for entering and crossing through said arterials and upon the favorable exercise of the City Manager's judgement predicated upon all factors set forth herein. Section 3. Pursuant to the provision of Ordinance No. 8851, enacted September 28, 1978, all retail peddlers' occupational licenses issued under the provisions of Chapter 31 of the City Code, as amended, will not be valid in the area of public right of way included on the above designated streets and on all intersecting streets for two blocks in all directions, during the dates and hours specified therein. Section 4. Upon the issuance of a temporary permit by the Florida Department of Business Regulation, Division of Alcoholic Beverages and Tobacco, to sell beer and wine pursuant to City Code 54-12.1, the request of the Kiwanis Club of Little Havana to sell beer and wine in soft containers for four (4) one -day periods in connection with Carnaval Miami Paseo scheduled for March 6, 1988 and Calle Ocho 8K Run, Carnaval Miami Bike Dash and Calle Ocho Open House Festival scheduled for March 11, 12 and 13, 1988 respectively, is hereby granted, subject to the issuance of all permits required by law. Section 5. The time limitations on the display of fireworks is hereby relaxed to allow the staging of pyrotechnic displays until 12:00 midnight on Saturday, March 5 1988, at the Orange Bowl for Carnaval Night and on Saturday, March 12, 1988 in the Vizcaya area in connection with a sponsors party, subject to the issuance of appropriate permits from the Department of Fire, Rescue and Inspection Services. Section 6. Such authorizations are hereby conditioned upon the organizers obtaining insurance requirements as mandated by the City of Miami and paying for all necessary costs of City services beyond the funding provided by Festival Ordinance No. 10206. Od REFERENCES: City Manager + Commission Agenda l�.em ENCLOSURES: October 22, 1987 RECOMMENDATION: It is respectfully recommended that the City Commission adopt the attached resolution formalizing Motion 87-465 of May 14, 1987 authorizing certain street closures, establishing a pedestrian mall, authorizing the sale of beer and wine, prohibiting retail peddlers in the area and extending the fireworks deadline in connection with 1988 Carnaval Miami festivities. The street closures for these events are subject to the issuance of permits by the Departments of Police and Fire, Rescue and Inspection Services and conditioned upon the organizers paying for the cost of City services beyond the funding provided by Festival Ordinance No. 10206. BACKGROUND: The Department of Community Development has prepared the appropriate legislation for the above mentioned authorizations in connection with the 1988 Carnaval Miami festivities to be conducted by the Kiwanis Club of Little Havana.
