' e7--87-827 9/26/87 RESOLUTION NO. 87--915, A RESOLUTION AMENDING PARAGRAPH (A) OF SECTION 2 OF RESOLUTION NO. 86-983, ADOPTED DECEMBER 11, 1988, TO PROVIDE THAT THE CITY OF MIAMI BID BOND VOUCHER PROGRAM FOR MINORITY AND FEMALE FIRMS BE LIMITED TO CONSTRUCTION CONTRACTS AMOUNTING TO $200,000.00 OR LESS. WHEREAS, Resolution No. 86-983, adopted December 11, 1986, authorized the City Manager's establishment and implementation of a bid bond voucher program for minority and female firms on public works projects, for public works construction projects amounting to $200,000.00 or less in cost; and WHEREAS, said Resolution specifies that the City Manager may waive the requirement of a performance bond for public works contracts of $200,000.00 or less awarded to minority or female firms but does not presently specify that the Bid Bond Voucher issued to eligible certified minority firms waiving the bid bond is similarly limited in its scope to public works contracts amounting to $200,000.00 or less; and WHEREAS, by this amendment, the City Commission reaffirms the goals and principle reflected in Resolution No. 86-983, which is in operative force and effect, and clarifies the intention of the City of Miami to limit the bid bond voucher to otherwise qualified firms relative to public works contracts amounting to $200,000.00 or less; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The findings and recitals contained in the preamble of this Resolution are hereby adopted by reference and incorporated herein as if fully set forth in this Section. Section 2. The City's Minority and Women procurement Administrator shall administer the Program in accordance with the following provisions: A. Pursuant to the Policy established herein for Mjblio works contracts amounting to 3200.000.00 or less, a Bid Bond Voucher Memorandum will be issued by the Administrator to eligible certified minority and women vendors to be submitted and accepted in lieu of a required bid bond or certified check. A separate Bid Bond Voucher Memorandum is required to be issued to each eligible vendor for each contract 9 1200_000.00 or less upon which the eligible certified vendor desires to bid. Odi o -- City Manager RECOMMENDATION: DATE: u ' , 3 1981 FILE: SUBJECT- Resolution Amending Resolution No. 86-983 REFERENCES: ENCLOSURES: Bid Bond Voucher Program It is recommended that a resolution be passed amending paragraph (A) of section 2 of resolution 86-983, adopted December 11, 1986. Said resolution establishes bid bond and performance bond requirements for City of Miami contracts; the proposed amendment would limit availability of bid bond vouchers to minority firms on contracts of $200,000 or less. BACKGROUND: The Department of Public Works has analyzed the situation, and determined that there exists a need for a revision to the present bid bond voucher program. Resolution 86-983, adopted on December 11, 1986, restructured and consolidated the performance bond and bid bond requirements for the City. The intent of the resolution is to provide assistance to qualified, small minority firms to participate in the City' s bidding process. When a surety company provides a contractor with a bid bond, it is a guarantee of their intent to supply the contractor with a performance bond also if the company is awarded a contract for the bid amount. Florida Statutes exempt the requirements for a performance bond on contracts for an amount less than $200,000, but do require it for contracts of a greater amount. A bid bond should also then be required on those larger contracts to prevent contractors from bidding on jobs for which they have no adequate bonding capacity. The proposed attached resolution modifies paragraph (A), section 2, of resolution 86-983, to include a limit of $200,000 or less for the bid bond voucher memorandum which is the same as the performance bond exemption. ss -� 137��.a .
