IN THE PROPOSED AMOUNT OF $7,412,088, BASE BID PLUS ALTERNATES 1 AND 4 OF THE PROPOSAL, FOR DINNER KEY MARINA REDEVELOPMENT - PIER CONSTRUCTION; WITH MONIES THEREFOR ALLOCATED FROM THE CAPITAL IMPROVEMENTS ORDINANCE NO. 10187, PROJECT NO. 414005 IN THE AMOUNT OF $7,412,088 TO COVER THE CONTRACT COST; AND AUTHORIZING THE CITY MANAGER TO EXECUTE A CONTRACT WITH SAID FIRM; FURTHER APPROVING THE CHIEF PROCUREMENT OFFICER'S DECISION TO REJECT PROTESTS RECEIVED IN CONNECTION WITH SAID PROJECT. - WHEREAS, sealed bids were received July 7, 1987, for Dinner -i —! Key Marina Redevelopment - Pier Construction; and WHEREAS, the City Manager and the Directors of the Departments of Public Works and Parks, Recreation & Public Facilities recommend that the bid received from Misener Marine Construction, Inc. be accepted as the lowest responsible and responsive bid; and WHEREAS, the Capital Improvements Ordinance No. 10187, was adopted on December 11, 1986, and monies are available for the proposed amount of the contract, project expense, and Incidentals under Project #414005 of said Ordinance; and WHEREAS, written protests were received in connection with the herein bid award; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The June 30, 1987, bid of Misener Marine Construction, Inc. In the proposed amount of $7,412,088, for the project entitled Dinner Key Marina Redevelopment - Pier Construction, for the base bid of the proposal based on lump sum prices, Is h%reby accepted at the price stated therein; further, the Chief Procurement Officer's decision rejecting bid award protests In connection with this project Is hereby CITY COMMISSION. E i r f t l j P%i BT �- F IMPORTANT ADDENDUM CITY OF MIAMI, FLORIDA Department of Public Works ADDENDUM NO. 1 ISSUED June 21, 1987 to BIDDING AND CONTRACT DOCUMENTS FOR DINNER KEY REDEVELOPMENT - PIER CONSTRUCTION B-3202-E THE CONTRACTOR IS HEREBY NOTIFIED AS FOLLOWS: CHANGE 1: (Advertisement) , Sealed bids for this project will be received by the City Manager and the City Clerk of the City of Miami at 11:00 a.m., on July 7, 1987, in the City Clerk's Office at Miami City Hall, 3500 Pan American Drive, Miami, Florida, instead of at 11:00 a.m. on June '. 30, as previously announced. CHANGE 2: (Proposal) Add attached Proposal page 2h(#2) to the Proposal. This establishes an Additive Alternate Item 4, for limerock rip -rap. On page 2i of the Proposal, revise the 3rd paragraph to include Additive Alternate Item 4. CHANGE 3: (Specifications) i In Division 2, Section 2.04 "Description of Proposal Items", add the following: $ Additive Alternate 4 is a unit price quotation for furnishing and placing limerock boulder rip rap. Rip rap shall be natural limerock boulders, 90% of which by weight measure between one foot and three feet in average diameter. Limerock shall be deposited along a shoreline or bulkhead wall at one or more locations as directed by the Engineer. In Section 2.05 "Revisions to General Conditions - Division 1", (B) 7-12 Insurance, note that Comprehensive General Liability insurance required is in the amount of $500,000 per occurrence (combined single limit for property damage and bodily injury). In Section 2.08 "Items Furnished by City", add "litter receptacles". In Section 2.08 add "Note that all mounting bolts shall be furnished and installed by the Contractor. All such bolts shall be non-magnetic stainless steel". In Division 15 - Mechanical, page 15300-3, revise paragraph on "Galvanized Steel Pipe" to read "Seamless, extra -strength ANSI B36.10 Schedule 80 steel pipe, roll -groove and galvanized fittings. Coat all exposed threads with two coats of Zinc Chromate, or approved equal after assembly. When used underground, paint with two coats of Bitumastic No. 50 paint or approved equal. On piers, provide one coat of Bitumastic paint on the galvanized pipe". In Division 15, add the attached Misc. Drawings 35-86-8 and 35- 86-9, which show details of the Citys standard Type A manhole. References to "ARTM" should be corrected to read "ASTM"; references to "Prestreesing" should be corrected to read "Prestressing"; references to "recpticals" or "recpticles" should be corrected to read "receptacles". CHANGE 4: (Plans) On Sh.S-1, add the following note: "All stainless steel fasteners - shall be non-magnetic stainless steel". On Sh.S-5, revise note 5 of "...Notes" to eliminate maximum six — foot limitation on drilling and punching. Drilling or punching shall be used, in conjunction with driving, to attain the necessary bearing value, along with lateral stability. Any attempt by the City of Miami to formally award the contract to McNew Marine Construction, Inc. shall be opposed by all means available. Misener Marine's objection to the award of the contract to McNew Marine is based on the concept that the City of Miami cannot award the contract to McNew Marine Construction based on the fact that McNew Marine's bid was not responsive to the City's request for proposals. The responsiveness of a bid is a nuestion of whether the bid, as submitted, is in exact conformance with the invitation for bids. Absent the r%quirements that all bids be responsive, the contracting authority would not be able to accurately compare the bid proposals, 5nd the public would not be assured that the project was rruly obtained for the least cost. It is well recognized that in order for a bid to be disqualified for lack of responsiveness, the non -responsive item must generally be a material item which affects the integrity of the bidding system. In the instance case, McNew Marine did not provide a bid bond or a certified check as security for its bid proposal. Instead, McNew Marine categorized itself as a Disadvantaged Business Entity (DRE), and submitted its bid with a bid voucher. This procedure gave McNew Marine an unfair advantage over the other contractors, who were required to post bid security, and McNew Marine's bid should therefore be disqualified. . . . / . . . . 97-1028 97"1028 Mr. Donald W.
