NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY
OF MIiAMI, FLORIDA:
section l: Section 38-49 of the Code of the City of Miami
Florida is hereby amended in the following particulars: 1
"Section 38-49. Alcoholic beverages; intoxicated persons.
(a) Possession or consumption of alcoholic beverages
within park limits of any City park is prohibited except as
follows:
(1) Alcnhol is 3n-ar3ges Beer --y-wd--gym", may No sold and
consumed at Fgrt Dallas, Bicentennial and Bayfront Parks as
follows:
(a) On a roqular basis within city restaurant facilities
by properly licensed oaerators therein during hours

remaining provisions of this ordinance shall not be affected.

It is respectfully recommended that the City Commission adopt
attached Ordinance which would amend Section 38-49 of the City
Code to allow full alcoholic beverage service, subject to all
applicable laws, in restaurant facilities at Bayfron't,
Bicentennial and Fort Dallas Parks.
Background:
The Department of Parks, Recreation and Public Facilities is
preparing a competitive request for proposals for the lease of
property within Fort Dallas Park for the operation of a
restaurant. In order to maximize revenue potential at this site,
it is recommended that Eull alcoholic beverage service be
allowed.
The City Code presently permits the sales of beer and wine (only)
on a regular basis at restaurants in Bicentennial and Bayfront
Parks. Temporary beer and wine sales are also permissible in
conjunction with special events at all City parks. The attached
ordinance proposes to expand such regular sales to full beverage
service at City -leased restaurants and to add the Fort Dallas
restaurant. With the City's present push to increase revenue and
to attract qualified firms into the downtown area, a change in
pertinent park regulations will provide viable opportunities for
qualified restaurant operators.

All interested persons may appear at the meeting and be heard
with respect to the proposed ordinances.
Should any person desire to appeal any decision of the City Com-
mission with respect to any matter to be considered at this meeting, ]
that person shall ensure that a verbatim record of the proceedings Is 1
made including all testimbny and evidence upon which any appeal I
may be based. i
