AN EMERGENCY ORDINANCE AMENDING SECTIONS 1
AND 3 OF ORDINANCE NO. 10327, ADOPTED OCTOBER.
22, 1987, WHICH FORMALIZED PREVIOUS CITY
COMMISSION ACTIONS DURING WHICH THE FISCAL
YEAR ENDING SEPTEMBER 30, 1987 IMPLEMENTED
_ BUDGETARY ADJUSTMENTS IN THE ANNUAL,
APPROPRIATIONS ORDINANCE (90. 10150) FOR SAID
FISCAL YEAR TO COMPLY WITH GENERALLY ACCEPTED
ACCOUNTING PRINCIPLES AND PROVIDING BY SUCH
AMENDMENT A CORRECT STATEMENT OF THE ORIGINAL
COMPOSITION OF THE INTEREST EARNINGS BEING
TRANSFERRED TO THE GENERAL FUND AS CONTAINED
IN SECTION 3 OF ORDINANCE 90. 10327 AND -
FURTHER PROVIDING FOR CORRECT PLACEMENT OF
PROVISIONS AND COMPUTATIONS WHICH WERE EITHER
OMITTED OR APPEARED IN IMPROPER SEQUENCE IN
SAID ORDINANCE NO. 10327 CONTAINING A
_ REPEALER PROVISION AND A SEVERABILITY
CLAUSE.
BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. Section 1 of Ordinance No. 10327, adopted
October 22, 1987, which formalized previous City Commission
actions during which the Fiscal Year ending September 30, 1987
implemented budgetary adjustments in the Annual Appropriations
Ordinance (No.,10150) for said fiscal year to comply with
generally accepted accounting principles is hereby amended in the
following particulars: 1/
"Section 1. Sections 1, 2, 3,—, and 6 of
Ordinance No. 10150, adopted September 25, 1976, the
Annual Appropriations Ordinance for the Fiscal Year
ending September 30, 1987, are hereby amended and a new
Section 5.1 is hereby added to said Ordinance in the
following particulars: 1/
1/ Words and/or figures stricken through shall be deleted.
Underscored words and/or figures shall be added. The
remaining provisions are now in effect and remain unchanged.
Asterisks indicate omitted and unchanged material.

Section 3. The following appropriations
are hereby made for debt service payment of
principal and interest and incidental costs
of $158,150 for Utility Service Tax Bonds and
the transfer of $19, 069, $21.392.176 to
the General Fund for FY'87. In addition,
this fund will contribute
$3,541,488 to the Conferences and Conventions
Center Enterprise Fund and $1,044,730 to the
Government Center Garage Enterprise Fund for
the 1986-87 fiscal year:

they are inconsistent or in conflict with the provisions of this
ordinance are hereby repealed.
Section 3. If any Section, part of Section, paragraph,
clause, phrase, or word of this ordinance is declared invalid,
the remaining provisions of this ordinance shall not be affected.
Section 4. This ordinance is hereby declared to be an
emergency measure on grounds of urgent public health, safety and
property of the City of Miami and upon the further ground of the
necessity to make the required and necessary payments to its
employees and officers, payment of its debts, necessary and

On October 22, 1987, Ordinance No. 10327 (Item #66) vas adopted
on an emergency basis which formalized previous city Commission
actions during the fiscal year ending September 30, 1087 and
Which implemented budgetary adSustments in the Annual
Appropriations Ordinance (No. 10180) for said fisoal year to
comply with generally accepted a000unting principles.
A clerical error in that amendatory Ordinance (No. 10327) has
been disclosed by the Finanoe Department, as refleoted in the
attaohed memorandum dated October 28, 1987, which error had
resulted in an incorrect statement of the composition of the
internal earnings being transferred to the General Fund. A close
review Of that same Ordinance (No. 10327) also disclosed that
several provisions or computations were either omitted or
appeared in an improper sequence. The attached ordinance, also
to be oonsidered on an emergency basis, will make the necessary
corrections, none of Which ohange the dollar amount of the
original appropriations which were made in Ordinance No. 10327.

A review of amending appropriation ordinance adopted by the City
Commission on October 22, 1987 as item 66 disclosed a clerical
error that incorrectly changed the original composition of the
interest earnings being transferred to the General Fund. Section 3
of page 5, should read as follows:
Section 3. The herein increase in revenues to the
General Fund In the amount of $3,522,292 consists of the following:
a) $1,000,000 from interest on investments from the Sale of General
Obligation Bonds (Non -Revenues) as follows: 1) 1981 Fire Bonds -
$280,000, I 1975-76 Sanitary Sewer Bonds - $400,000, and 111)
1980 Streets Highway Bonds - $320.000, b) $2,322,292 from
Utility Service Tax Revenue (Hon -Revenues); c) $500,000 from
General Obligation Debt Service Fund - Interest Earnings; and d)
a $300,000 reduction in Southern Bell Franchise Fees (Taxes).
Also attached is a copy of page 5, as adopted.
These interest earnings are attributable to proceeds of general
obligation bonds sold by the City in 1985. Closing documents for
the 1985 transaction stated that "The investment earnings derived
from the investment or deposit of the New Money Proceeds will be
commingled within one year of receipt thereof with the general
revenues of the City and used for general City purposes," which
clearly allows for their transfer to the General Fund.
