ORDINANCE NO. 10340
AN EMERGENCY ORDINANCE ESTABLISHING A NEW SPECIAL
REVENUE FUND ENTITLED: "MIAMI COMPREHENSIVE
NEIGHBORHOOD PLAN: FY '87-'88:" APPROPRIATING FUNDS
FOR ITS OPERATION IN THE AMOUNT OF $218,427 COMPOSED
OF $218,427 FROM THE FLORIDA DEPARTMENT OF COMMUNITY
AFFAIRS; AUTHORIZING THE CITY MANAGER TO ACCEPT THE
GRANT AWARD FROM THE FLORIDA DEPARTMENT OF COMMUNITY
AFFAIRS AND AUTHORIZING THE CITY MANAGER TO ENTER INTO
AND EXECUTE THE NECESSARY CONTRACT(S) AND/OR
AGREEMENT(S) FOR THE ACCEPTANCE OF THE GRANT;
CONTAINING A REPEALER PROVISION AND A SEVERABILITY
CLAUSE.
WHEREAS, the City of Miami applied for Local Government Comprehensive
Planning Assistance funds from the Florida Department of Community Affairs in
the amount of $218,427 to provide assistance in the updating of the Miami
Comprehensive Neighborhood Plan as mandated by Chapter 163.3161 Florida
statutes "Local Government Comprehensive Planning and Land Development
Regulation Act;" and
WHEREAS, by Chapter 9J-16 F.A.C. "1987-88 Local Government Comprehensive
Planning Assistance Program," the Florida Department of Community Affairs
allocated the said $218,427 to the City of Miami for the program period to
July 15, 1988; and
WHEREAS, this grant program is scheduled to operate for the period of
November 1, 1987, through July 15, 1988; and
WHEREAS, the Florida Department of Community Affairs requires that
documents accepting these funds must be executed in November in order to
expend funds commencing November 1, 1987;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:

Section 1. The following Special Revenue Fund is hereby established and
resources are hereby appropriated as described herein:
FUND TITLE: MIAMI COMPREHENSIVE NEIGHBORHOOD PLAN: FY '87-'88
RESOURCES: FLORIDA DEPARTMENT OF COMMUNITY AFFAIRS $218,427
APPROPRIATION: MIAMI COMPREHENSIVE NEIGHBORHOOD PLAN:
FY '87-'88 5218,427
Section 2. The City Manager is hereby authorized to accept the
aforementioned grant from the Florida Department of Community Affairs, to
enter into the necessary contract(s) and/or agreement(s) and to execute all
documents necessary for such acceptance.
Section 3. All ordinances or part of ordinances insofar as they are
inconsistent or in conflict with provisions of this ordinance are hereby
repealed.
Section 4. If any section, part of section, paragraph, clause, phrase or
word of this ordinance is declared invalid, the remaining provisions of this
ordinance shall not be affected.
Section 5. This ordinance is hereby declared to be an emergency measure
on the grounds of urgent public need for the preservation of peace, health,
safety, and property of the City of Miami and upon the further ground of the
necessity to make the required and necessary payments to its employees and
officers, payment of its debts, necessary and required purchases of goods and
supplies, and to generally carry on the functions and duties of municipal
affairs.
Section 6. The requirement of reading this ordinance on two separate
days is hereby dispensed with by a vote of not less than four -fifths of the
members of the City Commission.

ENCLOSURES
It is respectfully recommended that the City Commission adopt the attached
emergency ordinance establishing a special revenue fund: "Miami Comprehensive
Neighborhood Plan: FY '87-'88"; authorizing the City Manager to accept
$218,427 from the Florida Department of Community Affairs; to execute the
necessary agreements, and appropriating the funds.
BACKGROUND
The Planning Department, through the Mayor, applied to the Florida Department
of Community Affairs for $218,427 in Local Government Comprehensive Planning
Assistance Funds to continue updating the Miami Comprehensive Neighborhood
Plan as mandated by Chapter 163.3161 F.S. "Local Government Comprehensive
Planning and Land Development Regulation Act" as amended through 1986. The
Florida Department of Community Affairs has allocated $218,427 to the City of
Miami for the program period to July' 15, 1988. A copy of the award
notification from the Department of Community Affairs is attached.
The work program to be undertaken by the Planning Department includes land use
data and housing needs analyses and a capital improvement implementation plan,
following Chapter 9J-5, F.A.C. "Minimum Criteria for Review of Local
Government Comprehensive Plans and Determination of Compliance." The data
will be compiled in a report consisting of maps and tables to be submitted to
the Department of Communty Affairs by July 15, 1988.
An emergency ordinance is requested because the Florida Department of
Community Affairs will honor expenditures after November 1, 1987, if the grant
contract is signed in November.

The City of Miami has tentatively been allocated $218,427
for FY 1987-88 under the Local Government Comprehensive Planning
Assistance Program. Because of your early comprehensive plan
submittal date, procedures for administration and distribution of
funding for this program requires submittal of your funded Mork
products to the Department within a relatively short time frame.
Therefore it is in your best interests and those of the
Department to begin the application and contracting process as
soon as possible.
Please fill out and return the enclosed application as soon
as possible so that'Me can expedite the contracting process. As
soon as we have approved your scope of services, and the funding
rule (9J-20, F.A.C.) is effective, we will be able to forward a
contract for your signature.
_ Please note that the interim deliverables will be due on
January 29, 1988, and final deliverables will be due July 15,
1988. Proposed Rule 9J-10.005(7) allows an extension of the
contract beyond the final due date, only to allow Mork on land
development regulations (if they are included in your scope of
work). Your prompt submittal of this application will allow you
to have the longest possible period to work on the contracted
work products.
