WHEREAS, the Miami Zoning Roard , at its meeting
of June 15, 1987, Item No. 4, following an advertised hearing,
adopted Resolution No. ZB 78-87, by a 9 to 0 vote, RECOMMENDING
APPROVAL of a change of zoning Classification, as hereinafter set
forth; and
WHEREAS, the City Commission after careful consideration of
this matter deems it advisable and in the best interest of the
general welfare of the City of Miami. and its inhabitants to
grant this change of zoning classification as hereinafter set
forth;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The Zoning Atlas of Ordinance No. 9500, the
zoning ordinance of the City of Miami, Florida, is hereby amended
by changing the zoning classification of approximately 1025
Northwest 19th Avenue, Miami, Florida, more particularly
described as Lot 12 and the North 22.5 feet of Lot 11, Block 3,
COPPINGER'S TROPICAL GARDENS as recorded in Plat Book 16 at Page
52 of the Public Records of Dade County,, Florida, from RS-2/2 One
Family Detached Residential to RG-1/3 General Residential (One
and Two Family).

NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The Zoning Atlas of ordinance No. 9500, the
zoning ordinance of the City of Miami, Florida, is hereby amended
by changing the zoning classification of approximately 1025
Northwest 19th Avenue, Miami, Florida, more particularly
described as Lot 12 and the North 22.5 feet of Lot 11, Block* 3,
COPPINGERIS TROPICAL GARDENS as recorded in Plat Book 16 at Page
52 of the Public Records of Dade County, Florida, from RS-2/2 One
Family Detached Residential to RG-1/3 General Residential (one
and Two Family).
Section 2. It is hereby found that this zoning
classification change:

b) Is not contrary to the established land u.qe pattern,,
C) Will not create an isolated district unrelated to
adjacent and nearby districts;
(d) Is not out of scale with the need--, of the neighborhood
or the City,,
(e) Will not materially a I t e r the population density
pattern or increase or overtax the load on public
facilities such as schools, utilities, streets, etc.,
( f ) Is necessary dL10 to changed or changing conditions;
(g) Will not adversely influence living conditions in the
neighborhood-,
(h) Will not create or excessively increase traffic
congestion or otherwise affect public safety;
(i) Will not create a drainage problem;
will not seriously reduce light and air to adjacent
area;
(k) Will not adversely affect property values in the
adjacent area;
(1) Will not be a deterrent to the improvement or
development of adjacent property in accord with
existing regulations;
(m) Will not constituteia grant of special privilege to an
individual owner as contrasted with protection of the
public welfare.
Section 3. Page No. 25 of the Zoning Atlas, made a part of
Ordinance No. 9500' by reference and description in Article 3,
Section 300 of said Ordinance, is hereby amended to reflect the
changes made necessary by these amendments.
Section 4. All ordinances or parts of ordinances insofar as
they are inconsistent or in conflict with the provisions of this
ordinance are hereby repealed.
Section 5. If any section, part of section, paragraph,
clause, phrase, or word of this ordinance is declared invalid,
the remaining provisions of this ordinance shall not be affected.

REQUEST Change of Zoning Classification in the Official
Zoning Atlas of Zoning Ordinance. 9500, as
amended, the Zoning Ordinance of the City of
Miami to RG-2/4 General Residential.
RECOMMENDATIONS
PLANNING DEPARTMENT AP ROVAL. The proposed change would not conform
with the Miami Comprehensive Neighborhood Plan.
The applicant has filed a plan amendment which
is required in this case. The proposed plan is
not in conflict with the established, land use
pattern. The proposed change would not create
an isolated district unrelated to adjacent
districts. The subject property is abutted on
the north and west by RG-2/4 General Residential
and by RS-2/2 One Family Detached Residential on
the east and south.
The proposed change is not out of scale with the
needs of the neighborhood or the City. The
proposed change would not materially alter the
population density pattern, due to the
relatively very small size of the subject
property which would be adequately served by
existing public facilities such as schools,
utilities, streets, etc.
The proposed change. would not excessively
increase traffic congestion or otherwise affect
public safety. NW 19th Avenue dead ends at the'
S-R, 836 east -West Expressway. The proposed
change would not ,adversely influence living
conditions in the neighborhood,

PUBLIC WORKS
The design capacity of the existing sanitary
sewer system serving this property' is
approaching its maximum. The proposed rezoning -
should not overload the sanitary sewer system,
but if additional properties are rezoned the
system capacity could be exceeded.

This Declaration of Restrictive Covenants Running with the land
("Declaration") is made and entered into this i day of May 1987,
by Miguel A. 8chagarrua, as ownerofthe property in 1025 N.W. 19th
Avenue.
BACKGROUND FACTS
The owner has title to the property described as follows:
North 221, feet of lot 11 and all of lot 12
in Block 3 of Coppinger's Tropical Gardens,
According to the Play Book 16 at page 52 of
the Public Records of Dade County, Florida
Owner has applied to the City'of Miami ("City".) to rezone the
oroperty to RC-2/4 under the City of Miami Zoning Code.
Owner desire to offer certain assurances to the owners of properties
within 375 feet of the property ("Neighbors"') and to the City, that if the
Orooerty is developed under the RG-2/4 classification, Owner will waive
their right to certain uses, will limit certain uses thereon, and
adhere to density restrictions thereon'.
The owner recognizes and acknowledges that the covenants
listed below are freely and voluntarily offered as a benefit to the
public health, welfare and safety of the City of Miami and inhabitants.
COVENANTS
Owner hereby agree and covenant as follows:
1. That if the property is rezoned to RC-2/4, owner will
use said pronerty only for the purposes of addition on the structure
of my house,, subject to meeting all other regulations of zoning
ordinance 9500, for the construction of a duplex, according to the
zoninq renulations of the City of Miami, Dade County, Florida, and
the said property shall not be used for any other purpose permitted by
law under the RC-2/4 zoning.
2. The said home shall be used exclusively as a duplex
when completed.
3. That if the property is zoned RC-2/4, the owner agrees
to waive all rights to transitional uses under the present City of
Miami Zoning Code and its successors.
4. That if the property is rezoned RC-2/4 the owner
shall strictlycomplywith density restrictions of applicable
Zoning and Building Codes.
5. These covenenats shall be covenants running with the land
and shall be binding upon Owner, Owner's succesors in title and assigns
and shall inure to the benefit of and be enforceable by the City of Miami
and the intended beneficiaries or nei.qhbors,
6, This Declaration may be released, modified, or amended
as to all of any portion of the Property by a written instrument approved
