All ordinances, code sections, or parts thereof in conflict herewith are hereby repealed insofar as'they are in conflict. Section 4. Should any part or provision of this Ordinance be declared by a court of competent jurisdiction to be invalid, the same shall not affect the validity of the ordinance as a whole. Consideration of a change of plan designation for the subject . property on the Miami Comprehensive Neighborhood Plan (September, 1985) from Low Density Residential to Moderate High Density .Residential. - REQUEST Change of Miami Comprehensive Neighborhood Plan (1985) land use designation from Low-Oensity Residential to Moderate -High Residential. BACKGROUND The subject site is designated on the MCNP f1985) for low density residential uses, with the property being used as a single-family residence in conformity with this Master Plan designation. The next six lots running northward of the subject site are designated for moderate -high residential use. The first lot to the north contains a duplex structure, with the - remaining five I lots containing A multifamily condominium structure: Immediately to the west of the site, on the.west side of 19 Avenue between 11 Street and - Northwest S. River Drive, the Master Plan land use designation is also Moderate -High Density residential. That block contains three residential structures. two four -flats, and a duplex, with all of these structures backing up to a medium size FP&L electrical substation. A number of the owners of properties surrounding the subject site support the application. Property to the east and south of the site have the same land -use designation and use as the applicant. ANALYSIS The Planning Department finds that this application will not adversely impact any established neighboring land uses. The request also will not 'create a • spot land -use designation, nor will the change adversely affect traffic or public safety. RECOMMENDATIONS PLANNING DEPT. Approval. . Change of MC NP (1985) land use designation from Low Density Residential to Moderate High Density Residential. PLANNING ADVISORY BOARD. At its meeting of June 17, 1981, the Planning Advisory Board adopted Resolution PAS 40-879 by a 7 to O vote, recommending approval of the above. Three replies in'favor and three objections were received by mail. One proponent was present at this meeting. CITY COMMISSION At its meeting of July 23, 1987, the City Commission continued the above to its meeting of September 22, 1987.
