HomeMy WebLinkAboutR-87-1066J-87-851 9/30/87 RESOLUTION NO. 47-1066 A RESOLUTION MODIFYING THE DECISION OF THE ZONING BOARD AND GRANTING A SPECIAL EXCEPTION AS LISTED IN ORDINANCE NO. 9500, AS AMENDED, THE ZONING ORDINANCE OF THE CITY OF MIAMI, THE SCHEDULE OF DISTRICT REGULATIONS, PAGE 2 OF 6, RG-3 GENERAL RESIDENTIAL, PRINCIPAL USES AND STRUCTURES, PERMISSIBLE ONLY BY SPECIAL PERMIT, AND ARTICLE 20, SECTION 2034 TO PERMIT AN ADULT CONGREGATE LIVING FACILITY (ACLF), FOR THE ELDERLY, WHICH IS A TYPE OF COMMUNITY BASED RESIDENTIAL FACILITY (CBRF), WITH A MAXIMUM OF 248 RESIDENTS INCLUDING RESIDENT STAFF, TO BE LOCATED AT APPROXIMATELY 1700-1770 NORTHWEST 34TH STREET, APPROXIMATELY 1701-1757 NORTHWEST 33RD STREET AND APPROXIMATELY 3300-3380 NORTHWEST 17TH AVENUE, MIAMI, FLORIDA, (MORE PARTICULARLY DESCRIBED HEREIN), AS PER PLANS ON FILE, WITH ONLY CERTAIN DESCRIBED ROOMS TO BE USED FOR DOUBLE OCCUPANCY (ALL OTHERS ARE TO BE SINGLE OCCUPANCY) PER EXISTING PLANS ON FILE; SUBJECT TO APPROVAL BY THE CITY COMMISSION OF A CHANGE OF ZONING FROM RG-1/3 ONE AND TWO FAMILY DETACHED RESIDENTIAL TO RG-3/6 GENERAL RESIDENTIAL; ZONED RG-1/3 ONE AND TWO FAMILY DETACHED RESIDENTIAL AND CR- 3/7 COMMERCIAL RESIDENTIAL (GENERAL). THIS SPECIAL EXCEPTION HAS A TIME LIMITATION OF TWELVE MONTHS IN WHICH A BUILDING PERMIT MUST BE OBTAINED. WHEREAS, the Miami Zoning Board at its meeting of May 18, 1987, Item 2, following an advertised hearing, adopted Resolution ZB 63-87 by a seven to zero (7-0) vote, granting the Special Exception as listed in Zoning Ordinance No. 9500, as amended, the Zoning Ordinance of the City of Miami, the Schedule of District Regulations, Page 2 of 6, RG-3 General Residential, Principal Uses and Structures, Permissible Only By Special Permit, and Article 20, Section 2034 to permit the conversion of one two-story structure and one three-story structure to an Adult Congregate Living Facility (ACLF), for the elderly, which is a type of Community Based Residential Facility (CBRF), with a maximum of 222 residents including resident staff, at approximately 1700-1770 Northwest 34th 1701-1757 Northwest 33rd Street and Street, approximately approximately 3300-3380 CITY COMM? SIGN MEETrT9(Y 07 DEC 1981 OLUTION Z6. 97 Northwest 17th Avenue, also described as Lots 1-5 and 12-20, inclusive, Block 1, and a certain unplatted parcel lying in that Block, LAVONIA PARK, as recorded in Plat Book 9 at Page 113 of the Public Records of Dade County, Florida, (Complete legal description on file with the Hearing Boards Division), as per plans on file, with only those rooms listed as 16' x 1114", III x 16' and 11' x 10' 8" to be used for double occupancy ( all others are to be single occupancy) per existing plans on file; subject to approval by the City Commission of a change of zoning from RG- 1/3 One and Two Family Detached Residential to RG-3/6 General Residential; Zoned RG-1/3 One and Two Family Detached Residential and CR-3/7 Commercial Residential (General), with a time limitation of twelve months in which a building permit must be obtained; and WHEREAS, the applicant has taken an appeal to the City Commission from certain of the conditions attached to the granting of the Special Exception for an Adult Congregate Living Facility (ACLF) as described herein and to request an increase from 222 residents to a maximum of 248 residents, including resident staff, to be located on the premises; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The decision of the Zoning Board is hereby modified and the Special Exception as listed in Zoning Ordinance No. 9500, as amended, the Zoning Ordinance of the City of Miami, the Schedule of District Regulations, Page 2 of 6, RG-3 General Residential, Principal Uses and Structures, Permissible Only By Special Permit, and Article 20, Section 2034 to permit the conversion of one two-story structure and one three-story structure to an Adult Congregate Living Facility (ACLF), for the elderly, which is a type of Community Based Residential Facility (CBRF) with a maximum of 248 residents including resident staff, to be located at approximately 1700-1770 Northwest 34 Street, approximately 3300-3380 Northwest 17 Avenue, Miami, Florida, also described as Lots 1-5 and 12-20, inclusive, Block I, and a -2- 87-1066 certain unplatted parcel lying in that Block, LAVONIA PARK, as recorded in Plat Book 9 at Page 113 of the Public Records of Dade County, Florida, (complete legal description on file with the Hearing Boards Division), as per plans on file, with only certain rooms to be used for double occupancy (all others are to be single occupancy) per existing plans on file; subject to approval by the City Commission of a change of zoning from RG-1/3 One and Two Family Residential to RG-3/6 General Residential; Zoned RG-1/3 One and Two Family Detached Residential and CR-3/7 Commercial Residential (General), and a time limitation of one year in which a building permit must be obtained, is hereby granted. BECAUSE THIS WAS A REDUCTION, THE CHANGE WAS NOT RE -ADVERTISED ON THE STREET SIGNS, TO THE BORDERING NEIGHBORS, IN THE NEWSPAPERS OR WAS IT REFLECTED ON THE ZONING BOARD AGENDA OF MAY 18. MAY 18: I APPEARED BEFORE THE ZONING BOARD FOR THEM TO CONSIDER MY APPLICATION AGAIN. (AGENDA ATTACHED) THE. ZONING BOARD, WHETHER CONSIDERING 248 OR 268, WAS'MORE CONCERNED ABOUT THE ROOM SIZES THAN THE TOTAL NUMBER OF RESIDENTS. I HAVE CONTENDED WITH STAFF ON NUMEROUS OCCASIONS THAT THERE BE A MINIMUM SQUARE FOOTAGE GUIDELINE: HOWEVER, THE ZONING ROARD DISREGARDED MY REQUEST AND LISTED SPECIFIC ROOM DIMENSIONS WHERE DOUBLE OCCUPANCY WOULD BE ALLOWED (e.i. 16'X11'4', IlIX1610 r 16'X10'8"). THE TOTAL NUMBER ARRIVED AT WAS 222 AS COMPARED TO THE 268 REQUESTED ON THE AGENDA. THE DECISION OF 222 RESIDENTS IS BEING APPEALED RY ME, BECAUSE I NEED A MINIMUM SQUARE' FOOTAGE GUIDELINE IN REHABILITATING AN EXISTING BUILDING. THE TOTAL NUMBER OF RESIDENTS WOULD HAVE TO BE DETERMINED BY THAT GUIDELINE, NOT TO EXCEED A CERTAIN NUMBER, IN MY CASE: 260. AT THE TIME OF RENOVATION, IT MAY BE THAT THE ROOMS WOULD BE ABLE TO BE INCREASED IN SIZE ACCORDING TO WHERE, THE LOAD —BEARING WALLS ARE LOCATED. IN MY LETTER OF APPEAL (ATTACHED) DATED MAY 25, 1 DID NOT PUT A TOTAL NUMBER, BECAUSE I AM INTERESTED IN GETTING A SQUARE FOOTAGE GUIDELINE. SINCE IT WOULD STILL BE A REDUCTION OF THE ORIGINAL ADVERTISED 268? 3) IF THE CITY OF MIAMI COMMISSION VOTES ON A SQUARE FOOTAGE GUIDELINE THAT WILL ALLOW MY 260, HOW DO I GO ABOUT GETTING'THE APPROVAL FOR THE ADDITIONAL NUMBER OF RESIDENTS AND FROM WHOM DO I GET IT? MY PURPOSE FOR SPENDING THE $400.00 ON THE APPEAL IS TO GET A CONCRETE GUIDELINE ESTABLISHED, SO I DO NOE GO INTO A SITUATION OF UNKNOWNS IN CONSTRUCTION. IF I COME UP WITH A WALL 3" OFF, IT COULD CAUSE ME TO BE IN VIOLATION. BECAUSE IT IS NO • LONGER 16'X11'4" BUT NOW IT IS 16'X11'1"; HOWEVER, IT COULD STILL BE WELL OVER THE MINIMUM SQUARE FOOTAGE. In discussion with the applicant on Tuesday, April 21, 1987 I determined that the requirement on the City's Platting Application that all liens be paid prior to replatting was in fact an inaccurate reiteration of City Code Section 54.5-8(d) entitled "Other Data Required With Plat," which requires, in subsection (3) thereof, the following: Certification from the City and County that all taxes and assessments have been paid on the •land within the proposed subdivision or receipted tax bills. Thus, I have advised Reverend Panky that, to comply with said sub -section, he must show only that taxes and assessments have been paid prior to platting, and that the judgment liens which were the basis of his concern are neither taxes nor assessments and do not come within the purview of this subsection. Reverend Panky raised a question regarding the proposed replatting of his property and I suggested to him that he contact Mr. Campbell, Chairman of the Plat and Street Committee, at the Department of Public Works to go over his application in detail.
