MAY 4: I APPEARED BEFORE THE, ZONING BOARD
ON MY REQUEST OF HAVING 268 RESIDENTS IN OUR ACLF.
(AGENDA ATTACHED) THE DOARD WAS CONCERNED ABOUT
THE SIZE OF THE ROOMS AND THE BATHROOM FACILITIES
AND CONTINUED THE ITEM TO MAY 18, SO I COULD CHANGE
THE PLANS TO MEET THEIR WISHES.
WE DID CHANGE OUR PLANS, BUT THE STAFF'S
RECOMMENDATION STILL MAINTAINED THAT THERE BE ONLY
ONE PERSON PER -ROOM. I DID NOT AGREE WITH THIS,
BUT IN ORDER TO BE ON THE AGENDA FOR MAY 18. 1 WAS
TOLD THAT I NEEDED TO MAKE SOME COMPROMISE. I
WROTE A LETTER AT YOUR OFFICE DATED MAY 7
(ATTACHED) STATING THAT I WOULD CHANGE MY
APPLICATION TO READ 248 RESIDENTS FROM THE ORIGINAL
268. BECAUSE THIS WAS A REDUCTION, THE CHANGE WAS
NOT RE -ADVERTISED ON THE STREET SIGNS, TO THE
BORDERING NEIGHBORS, IN THE NEWSPAPERS OR WAS IT
REFLECTED ON THE ZONING BOARD AGENDA OF MAY 18.
MAY 18: I APPEARED BEFORE THE ZONING BOARD
FOR THEM TO CONSIDER MY APPLICATION AGAIN. (AGENDA
ATTACHED) THE. ZONING BOARD, WHETHER CONSIDERING
248 OR 268, WAS'MORE CONCERNED ABOUT THE ROOM SIZES
THAN THE TOTAL NUMBER OF RESIDENTS. I HAVE
CONTENDED WITH STAFF ON NUMEROUS OCCASIONS THAT
THERE BE A MINIMUM SQUARE FOOTAGE GUIDELINE:
HOWEVER, THE ZONING ROARD DISREGARDED MY REQUEST
AND LISTED SPECIFIC ROOM DIMENSIONS WHERE DOUBLE
OCCUPANCY WOULD BE ALLOWED (e.i. 16'X11'4',
IlIX1610 r 16'X10'8"). THE TOTAL NUMBER ARRIVED
AT WAS 222 AS COMPARED TO THE 268 REQUESTED ON THE
AGENDA.
THE DECISION OF 222 RESIDENTS IS BEING
APPEALED RY ME, BECAUSE I NEED A MINIMUM SQUARE'
FOOTAGE GUIDELINE IN REHABILITATING AN EXISTING
BUILDING. THE TOTAL NUMBER OF RESIDENTS WOULD HAVE
TO BE DETERMINED BY THAT GUIDELINE, NOT TO EXCEED A
CERTAIN NUMBER, IN MY CASE: 260. AT THE TIME OF
RENOVATION, IT MAY BE THAT THE ROOMS WOULD BE ABLE
TO BE INCREASED IN SIZE ACCORDING TO WHERE, THE
LOAD —BEARING WALLS ARE LOCATED. IN MY LETTER OF
APPEAL (ATTACHED) DATED MAY 25, 1 DID NOT PUT A
TOTAL NUMBER, BECAUSE I AM INTERESTED IN GETTING A
SQUARE FOOTAGE GUIDELINE. I WILL, AT THIS POINT,
PUT IN WRITING THAT I WOULD NOT WANT TO EXCEED 260
RESIDENTS AS 1 MENTIONED TO YOU THIS MORNING.
2
S7 -iQss 6
SINCE THIS IS HIGHER THAN THE 248, WHICH YOU
CONTEND IS THE NUMBER FOR WHICH I HAVE BEEN
APPLYING:
1) HOW DO I APPLY FOR THE MAXIMUM OF 260?
2) MAY I WRITE A LETTER (AS THE MAY 7
LETTER) CHANGING TO 260 RESIDENTS. SINCE IT WOULD
STILL BE A REDUCTION OF THE ORIGINAL ADVERTISED
268?
3) IF THE CITY OF MIAMI COMMISSION VOTES ON
A SQUARE FOOTAGE GUIDELINE THAT WILL ALLOW MY 260,
HOW DO I GO ABOUT GETTING'THE APPROVAL FOR THE
ADDITIONAL NUMBER OF RESIDENTS AND FROM WHOM DO I
GET IT?
MY PURPOSE FOR SPENDING THE $400.00 ON THE APPEAL
IS TO GET A CONCRETE GUIDELINE ESTABLISHED, SO I DO
NOE GO INTO A SITUATION OF UNKNOWNS IN
CONSTRUCTION. IF I COME UP WITH A WALL 3" OFF, IT
COULD CAUSE ME TO BE IN VIOLATION. BECAUSE IT IS NO
• LONGER 16'X11'4" BUT NOW IT IS 16'X11'1"; HOWEVER,
IT COULD STILL BE WELL OVER THE MINIMUM SQUARE
FOOTAGE.
THANK YOU FOR HELPING ME GET THE ANSWERS TO
THESE QUESTIONS.
S 11 NNCj4LY,
ICHARD A. PANKEY
P.S. I CONTEND THAT THE ADVERTISING FOR THE
268 RESIDENTS HAS BEEN USED DURING THE WHOLE
PROCESS AND i DO NOT UNDERSTAND WHY YOU FEEL. THAT
IF I CHANGE THE NUMBER TO 260 I WOULD HAVE TO GO
ALL THE WAY BACK TO THE BEGINNING OR STARTING OVER
WITH A NEW APPLICATION.

Res Application of Allapattah Baptist Church for an ACLF
Dear Willy: '
As you know, the referenced item was before you on April 20th,
1987 as Item No. 7 and was deferred to allow applicant, Reverend
Panky, time to prepare his presentation. In discussion with the
applicant on Tuesday, April 21, 1987 I determined that the
requirement on the City's Platting Application that all liens be
paid prior to replatting was in fact an inaccurate reiteration of
City Code Section 54.5-8(d) entitled "Other Data Required With
Plat," which requires, in subsection (3) thereof, the following:
Certification from the City and County that
all taxes and assessments have been paid on
the •land within the proposed subdivision or
receipted tax bills.
Thus, I have advised Reverend Panky that, to comply with said
sub -section, he must show only that taxes and assessments have
been paid prior to platting, and that the judgment liens which
were the basis of his concern are neither taxes nor assessments
and do not come within the purview of this subsection.
Reverend Panky raised a question regarding the proposed
replatting of his property and I suggested to him that he contact
Mr. Campbell, Chairman of the Plat and Street Committee, at the
Department of Public Works to go over his application in detail.
I am not familiar with his plat application or development plans.

CITY OF MIAMI CCh'MiSION MEETING r— .
, 19F7
sevr, A2,
FOR OVER FIFTY (50) YEARS THE ALLAPATTAH BAPTIST
CHURCH HAS BEEN TRYING TO MEET THE NEEDS OF PEOPLE IN
THE ALLAPATTAH COMMUNITY. AS YOU ARE AWARE, THERE HAVE
BEEN SOME VERY SEVERE CHANGES IN OUR COMMUNITY WHICH
HAVE AFFECTED EVERYONE, NOT TO EXCLUDE THE. CHURCH.
THERE HAS BEEN A DRASTIC DFCLINE IN OUR MEMBERSHIP;
THEREFORE, WE HAVE BEEN EXPLORING WAYS IN WHICH WE FELT
WE COULD MEET THE ADDITIONAL NEEDS OF OUR NEW COMMUNITY
WITHOUT DISCONTINUING OUR PRESENT MINISTRY.
BY HAVING AN ADULT CONGREGATE LIVING FACILITY
OPERATING IN OUR BUILDINGS WOULD ENABLE US TO- CONTINUE
MEETING NEEDS IN THE COMMUNITY FOR WHICH THE BUILDINGS
WERE BUILT. THIS. WOULD ALSO GIVE MANY OF CUP. PEOPLP THE
CPPOPTUNITY FOR MINISTRY RIGHT AT HOME.
WE WILL BE REHAPILTTATING TWO OF THE EDUCATIONAL
BUILDINGS INTO 130 RFDRCO%AS AND OTHER LIVING SPACE. THE.
TOTAL COST OF THIS REHABILITATION IS APPROXIMATELY TWO
AND ONE HALF MILLION DOLLARS. BECAUSE OF ROUGH TIMES IN
THE PAST, THE CHURCH COULD NOT HANDLE THIS TYPE OF
FINANCIAL PRESSURE. SO I HAVE FORMED A CORPORATION WHO
WILL LEASE THE PROPFRTY AND FINALIZE SCME TYPE OF JCIN'f—
VENTURE FOR FINANCING Ttlh: TOTAL PROJECT. THE CHURCH AND
VINISTRI! S, WILL RE ABLE TO CONTINUE MEETING AS USUAL

THE GOAL OF THE ACLF IS TO PWOVIDE. QUALITY CARE

WE WANT TO PROVIDE.OUR RESIDENTS WITH COMFORT AND

BUT BECAUSE 1T IS A ►A1'DISTRY TO US. WE WANT TREM TO

USEFULNESS. CNI. WAY OF FEELING USEFUL IS TO "WATCH" THE
CHILDREN AS THEY PLAY IN A CONTROLLED ENVIRONMENT
OUTSIDE AND TO HELP IN THE 400 SEAT DINING ROOM AS THEY
DESIRE TO DO SO.
WE ALSO WANT WHAT MOST INSTITUTION'S FOR ELDERLY DC
NOT HAVE AND THAT IS GOOD FOOD. 1 VISIT NURSING HOMES
IN EVERY AREA OF TOWN AND I'M DISGUSTED WITH THE WAY THE
RESIDENTS ARE. TREATED IN RESPECT TO FOOD. WE WANT
FRUITS, JUICES AND SNACKS AVAILABLE. AT ALL TIMES TO THE
RESIDENTS. WE'VE DONE A COST STUDY ON FOOD AND IT CAN
BE DONE RIGHT!
AS YOU CAN SEE, WE WANT THESE PEOPLE. WHO ARE NO
LONGER ABLE TO LIVE IN THEIR OWN HOMES AND NOT YET READY
FOR THE NURSING HOME. TO HAVE THE kEST PLACE PCSSIBLE.
WE BELIEVE THAT THE BEST PLACE TO FEET THE TOTAL NEED OF
AN INDIVIDUAL 1S RIGHT AT THE CHURCH AND THIS 1S OUR
PLAN. TO CARRY OUT OUR PLAN SUCCESSFULLY, WE NEED YOUR
HELP. THERE IS GOING 'r0 BE A LOT OF MONEY SPENT, THE
ALLAPATTAH TARGET AREA OF THE CITY IS GOING TO BENEFIT
AND ONE OF ALLAPATTAH'S HISTORIC SITES WILL CONTINUE ON •
IN IT'S ORIGINAL DESIGN WITH A NEW DEMINSION FOR A

Dear Mr. Genuardi,
As per our telephone conversation a few moments ago, this
letter is being presented for your records regarding our own
church parking lots.
We own lots 3, 4, b S in block K2 of Lavonia Park which
are paved off-street parking for the sanctuary. These lots .
were paved and striped back in the late forties.
I have tried to"update our records; however, the church
and the city have a similiar circumstance. We had a fire
in the fifties as did the city; therefore, neither can help
the other with documents for recording.
We do not have a problem with parking for any of our
services at this time and would be more than -willing to pro-
ceed in providing a unity of title of these three lots with
the church site.
Thank you for your kindness in assisting in this matter. 8 7--106f

Minutes of the Business Meeting
Held August 27, 1980
The following motions were presented by the Board of Directors of
the Allapattah Baptist Church, Inc., and the Deacons of the AllApattah
Baptist Church. These two groups jointly recommended:
I. To encourage the members of the Allapattah Baptist Church to
join another Bible believing, fundamental Baptist Church by
November 2, 1980. '
2. To receive no further active members to the Allapattah Baptist
Church, effective August 28, 1960.
3. To transfer to the status -of an inactive member with no further
voting rights all present active members of Allapattah Baptist
Church who have not moved their membership to another church by
Sunday, November 2, 1990.
C 4. To make all further decisions for the Allapattah Baptist Church,
_Inc., by a majority vote of the Board of Directors with no res-
pact given to membership of the Allapattah Baptist Church.
The Moderator, James Culpepper, gave as a world of explanation the
following:
"Because of the may problems confronting us at this time,.
the riots, the members moving out of commmity, the difficulty
In getting now members to come into our commmity, and the
tremendous debt load that we are carrying, we believe these
moves are in the best interest for all concerned --our church,
the Allapattah Baptist Church, Inc., the creditors who have
been so faithful in working with us these last five years, and
the members of the Allapattah Baptist Church who have given so
sacrificially and so faithfully during this critical time."
After such discussion the recommendations were accepted by the entire
congregation. A vote was taken on each item and each item was accept by
a unanimous vote.
