On November 19, 1987, the Ci ty Commi ssi-on ' deferred the Nati onal
Investigative Panel Report to the City of Miami - Findings and -
Recommendations for the City of Miami Fire Department (Item 81).
I am requesting that this item be rescheduled for discussion on
the December loth, commission agenda. The presentation of the
report will be made by members'of the National Panel.

On last Thursday's Ccnnnissicn Agenda, I was to represent the National Investigative
Panel, only to the extent of reporting their inability to be present, but to ensure
that the Mayor and each Commissioner received a copy of the Panel's Final Report.
The Panel has recommended making a formal presentation of its report before the
Commission, therefore the Department of Internal Audits and Reviews should be ad-
vised of your desire in this regard.
As Special Advisor to the National Investigative Panel, my responsibilities were to
- commile and analyze all data requested by the Panel;
- transcribe, edit and organize into a written form all minutes of the Panel's
deliberations;
- prepare all final, written, reports and recommendations developed as a result
of the Panel's investigations;
- assist in the coordination and facilitation of all activities, meetings, hear-
ings and deliberations of the Panel; and
- monitor and observe all meetings of the Panel cemmencing May 29, 1987.
In summary, I was to provide the Panel with the required level of independent co-
ordination and facilitation that would assure a fair and equitable investigration,
and a final product (written findings, conclusions and recaimsnndaticns). The City
Manager perceived the function of Special Advisor as an added insurance against
front -office interference. I advised the City Manager that he should not, in the
slic+htest way, influence, or behave such as to give the appearance of influencing
the Panel's work. As a result, I believe the Department Heads, who participated
(Personnel; Chief of Fire; Employee Relations; Leqal; Internal Review and Audits;
Affirmative Action; etc.) were able to express their perspectives on procedural
and policy matters openly, and did not feel restricted by the City Manager's over-
sight.
I hereby certify that all responsibilities were executed as specified in the Pro-
fessional Services Agreement of 29 May 1987, and that all Panel proceedings were
conducted in accordance with the Government in the Sunshine Law, Section 286.011,
Florida Statutes.

The Final Report is delivered as approved by the Panel, with the exception of the
Acknowledgements and Table of Contents pages (these were added on my advice).
.....% I have forwarded to the City Clerk's office, all Exhibits to the Panel's Final
Report, along with the taped recordings of public hearings.
'Phis investiq_ation was indeed a valuable learning experience and an indepth pro-
blem -solving intervention. I believe the Final Report is clearly on target!!
There is need, however, to generate a more specific level of detail based on the
Panel's Findings and Recommendations regarding the City of Miami's Equal Employ-
ment Opportunity/Affirmative Action Program. I am forwarding, under separate
cover, an outline of work, for establishing a progressive Action Plan to remedy
the specific problems identified as a result of this investigation.- The City
of Miami has indeed made the first steps toward showing the way, and demonstra-
ting the courage to engage and solve problems that involve allegations of dis-
crimination.
I remain available to provide follow-on assistance as required.

Dear Mr. Odio:
The National Investigative Panel has completed preliminary
drafts of its Report of Investigation regarding allegations
of discrimination within the Fire, Rescue and Inspections De-
partment based on ethnicity, national origin and sex. The
Report is in its final phase of review, and the Panel antici-
pates completion for purposes of formal presentation to the
City of Miami Commission, at its November 12th meeting.
Request an Agenda Item be established for the presentation of
the National Investigative Panel's Report to the Commission
on November 12, 1987.
Receipt of the final report is expected in ample time to cause -
proper distribution prior to the Commission meeting. Your
office will be advised if the Panel, for any reason, cannot
meet the November 12th date.
