AND EXECUTING A CONTRACT WITH SAID FIRM IN THE PROPOSED AMOUNT OF $147,400.00, BASE BID OF THE PROPOSAL, FOR MIAMARINA RENOVATION - PHASE II; WITH MONIES THEREFOR ALLOCATED FROM THE CAPITAL IMPROVEMENTS ORDINANCE NO. 10347 , PROJECT NO. 413007 IN THE AMOUNT OF $147,400.00 TO COVER THE CONTRACT COST. WHEREAS, sealed bids were received November 13, 1987, for Miamarina Renovation - Phase II; and WHEREAS, the City Manager and the Director of the Department of Public Works recommended that the bid received from Fire Pak, Inc. be accepted as the lowest responsible and responsive bid; and WHEREAS, the Capital Improvements Ordinance No. 10347 , was w adopted on November 19, 1987, and monies are available for the proposed amount of the contract, project expense, and incidentals under Project #413007 of said ordinance; WHEREAS, there existed an emergency need to begin construction on the project Immediately; and WHEREAS, the City Manager accepted the bid of Fire Pak, Inc., and executed a contract with them for the work; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The City Manager's action in accepting the bid of Fire Pak, Inc. In the proposed amount of $147,400.00, for the project entitled Miamarina Renovation - Phase II, for the Base Bid of the proposal is hereby ratified. CITY COMMISSION MEETING OF. The City Manager's written findings that a valid emergency need existed herein and his action in executing a contract with Fire Pak, Inc., for the above -mentioned work are hereby ratified. Od i o REFERENCES: City Manager ENCLOSURES: RECOMMENDATION It is respectfully recommended that the City Commission adopt the attached resolution ratifying the actions of the City Manager In accepting the bid of Fire Pak, Inc.. and executing a contract in a proposed amount of $147,400 for the base bid for MIAMARINA RENOVATION - PHASE 11, received November 13, 1987, with monies therefor allocated from the C.I.P. Ordinance No. 10347, adopted November 19, 1987, In the amount of $147,400 to cover the contract costs, plus project expense, Incidentals, and Indirect costs. BACKGROUND The Department of Public Works evaluated the bids received November 13, 1987 for Mlamarina Renovation - Phase 11, with the Intention of asking the Commission to award a contract to the lowest acceptable bidder at the earliest available City Commission meeting. This project covers emergency replacement of the fire lines at Miamarina. The Departments,of Public Works and Development believed that any ' cue i ays In the starting of the work' covered by the contract would result in an Increased hazard to the public as well as an Increased liability to the City. Accordingly, the City Manager proceeded with the acceptance of the lowest acceptable bid and the execution of a contract with the firm. The lowest acceptable bidder was Fire Pak, Inc. They ar-e a Hispanic controlled corporation, whose bid of $147,400 is under the City's estimate for the cost of the work. The Directors of the Departments of Public Works and Development recommend the award of the contract to said firm. Funds for the project are available from the C-.I.P. Odio REFERENCES: City Manager ENCLOSURES: B-3213- Amount 1- Based on information supplied to me by the Director of the Department of Public Works I have found that there exists an emergency need to prepare plans and specifications, and receive informal bids, for the replacement of unacceptable fire lines at Miamarina. The reason for the emergency need is as follows: The fire lines installed on the piers at Miamarina under a contract with McNew Marine Construction have proven to be unacceptable in that they have failed both hydrostatic and flow tests and are currently considered unacceptable by the Fire Marshall. The City is currently in pre -litigation activities with both the designer of the fire line system and the contractor who constructed it. Meanwhile, the ►diamarina remains to a large extent unusable because of the unacceptable fire lines, and there is a need to expedite the replacement of them. To follow the standard prescribed procedures of receiving sealed bids, which includes stipulated periods for advertisements and bidding, and awarding of a contract for the work by the Commission, would cause a delay which would not be in the best interest of the City.
