S 7-1091 A RESOLUTION ACCEPTING THE PLAT ENTITLED TOUSSAINT L'OUVERTURE SCHOOL LEMON CITY PARK SITE, A SUBDIVISION IN THE CITY OF MIAMI; ACCEPTING THE DEDICATIONS SHOWN ON SAID PLAT; AND AUTHORIZING AND DIRECTING THE CITY MANAGER AND CITY CLERK TO EXECUTE THE PLAT AND PROVIDING FOR THE RECORDATION OF SAID PLAT IN THE PUBLIC RECORDS OF DADE COUNTY, FLORIDA. WHEREAS, the City Zoning Board and the Department of Public Works recommends the acceptance of the plat; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The plat entitled TOUSSAINT L'OUVERTURE SCHOOL LEMON CITY PARK SITE is a replat of Block 14, 15, 16 and 17 Dixie Highway Tract, as recorded in Plat Book 5 at Page 24 and lots 1, 2, 11, 12, 13, 14 and 15 of Block 1, Biscayne Avenue Tract, as recorded in Plat Book 3 at Page 195, both of the Public Records of Dade County, Florida, together with those portions of the existing Rights of Way for N.E. Miami Court, N.E. Miami Place, N.E. 58th Street and N.E. 58th Terrace lying within the limits of this plat, all lying in Section 13, Township 53 South, Range 41 East, City of Miami, Dade County, Florida which subject plat by reference is made a part hereof as if fully incorporated herein and which plat, together with the dedications shown thereon, and the dedications to the perpetual use of the public of all existing and future planting, trees and shrubbery on said property, is hereby accepted and confirmed by the City of Miami, Florida. Section 2. The City Manager and City Clerk are hereby authorized and directed to execute the plat and cause the same to be recorded in the Public Records of Dade County, Florida. Ave. It is respectfully recommended that the City Commission adopt a resolution accepting the plat Toussaint L'ouverture School Lemon City Park Site Subdivision and approving recording the same in the Public Records of Dade County, Florida. BACKGROUND: The Department of Public Works has reviewed this plat, and has determined that it is now in order for acceptance by the City Commission. The proposed record plat entitled Toussaint L'ouverture School Lemon City Park Site is a replat of Blocks 14, 15, 16 and 17 nixie Highway Tract. as recorded in Plat Book 5 at Page 24 and lots 1, 2, 11, 12, 13, 14 and 15 of Block 1, Biscayne Avenue Tract, as recorded in Plat Book 3 at Page 195, both of the Public Records of Dade County, Florida, together with those portions of the existing Rights of Way for N.E. Miami Court, N.E. Miami Place, N.E. 58th Street and N.E. 58th Terrace lying within the limits of this plat, all lying in Section 13, Township 53 South, Range 41 East, City of Miami, Dade County, Florida. The area platted consists of 3 tracts containing 9.14+ acres. It is zoned PR, RG-2/4 and RG-1/3. It is in correct form for submission to the City Commission and is forwarded with a recommendation that it be approved. PERTINENT INFORMATION REGARDING THE PLAT: 1. The property platted is a repiat of Blocks 14, 15, 16 and 17 Dixie Highway Tract, as recorded in Plat Book 5 at Page 24 and lots 1, 2, 11, 12, 13, 14 and 15 of Block 1, Biscayne Avenue Tract, as recorded in Plat Book 3 at Page 195, both of the Public Records of Dade County, Florida, together with those portions of the existing Rights -of -Way for N.E:-Miami Court, N.E. Miami Place, N.E. 58 Street and N.E. 58th- Terrace lying within the limits of this plat, all lying in Section 13, Township 53 South, Range 41 East, City of Miami, Dade County, Florida. The location of the streets and the widths conform with the standards of the Department of Public Works of the City of Miami, Florida. 3. As certified to by Richard P. Shiskin Registered Land Surveyor, this Plat complies with the plat filing Laws of the State of Fl-drida. 4. The City Zoning Board of Miami, Florida, after Public 'Heari ng, has recommended the closing of that portion of Northeast Miami Court lying North of the North Right -of -Way line of Northeast 58th Street and South of the South Right -of -Way line of Northeast 59th Street, that portion of Northeast Miami Place Page 1 of 2 S 7-1091 a lying North of the North Right -of -Way line of Northeast 58th Street and South of the South Right -of -Way line of Northeast 59th Street, that portion of Northeast 58th Street lying East of the East Right -of -Way line of Northeast Miami Place and West of the West Right -of -Way line of Northeast 1st Court, and that portion of Northeast 58th Terrace lying East of the East Right -of -Way line of Northeast Miami Place and West of the West Right -of -Way line of Northeast 1st Court. The area platted is not encumbered by mortgages. 7. In accordance with the requirements of Chapter 54, of The Code of The City -of Miami, Florida, the Bond normally required will be waived due to the fact that this is a School Board and City of Miami Plat. LEMON CITY PARK WHEREAS, The School Board of Dade County, Florida (hereinafter referred to as the "Owner"),.concurrently with the delivery of this Agreement, has applied to THE CITY OF MIAMI, FLORIDA, (hereinafter referred to as the "City"), for the accep- tance and confirmation by the Commission of said City, of a certain proposed plat of a subdivision to be known as Toussaint L'Ouverture School/Lemon City Park site located at NE 59 Street and NE Miami Place, Miami a copy of which proposed plat is attached hereto and made a part hereof as Exhibit "A".
