A RESOLUTION RATIFYING, APPROVING AND CONFIRMING THE ACTION OF THE CITY MANAGER TO MAKE CONFISCATED, SEIZED AND/OR FORFEITED BICYCLES AVAILABLE AT NO COST TO NON-PROFIT AGENCIES, CHARITABLE ORGANIZATIONS, CHURCH GROUPS AND/OR PUBLIC AGENCIES FOR DISTRIBUTION TO INDIGENT INDIVIDUALS AND/OR USE IN YOUTH PROGRAMS. WHEREAS, the City Police Department has a number of bicycles in stock which have been seized through the forfeiture statute or regular confiscation process; and WHEREAS, Section 932.704(3)(a), Florida Statutes permits forfeited property to be disposed of by the Chief of Police as follows: "...salvage the property or transfer the property to any public or nonprofit organization..."; and WHEREAS, Section 705.01, Florida Statutes provides definitions for lost or abandoned property and unclaimed evidence property; and WHEREAS, Section 705.03, Florida Statutes establishes procedures for abandoned property which states that an agency may donate property to a charitable organization; and WHEREAS, Section 705.05, Florida Statutes permits the disposal of lost or abandoned property and unclaimed evidence by allowing an agency to donate the property to a charitable organization; and WHEREAS, the City's practical options as determined by the Chief Procurement Officer are to have the bicycles destroyed or i 4 made available at no cost to indigent and needy individuals; and WHEREAS, it is further agreed to allow three juvenile temporary employees each a bicycle of his choice for his contribution to the MPD Property Unit while in the "Summer Youth Employment and Training Program"; and WHEREAS, the distribution to those individuals in need can best be accomplished by non-profit agencies charitable c organizations, church groups, and/or public a CITY COMM MEETING OF fi DEC 1001987 �; RESOLUTION No. 8 !My—1 { �i particular responsibility is in the performance of such functions; and WHEREAS, a number of such organizations in the community have indicated to the Police Department their wtllingness to distribute said bicycles to individuals in need; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The City Manager's action in authorizing to make confiscated seized and/or forfeited bicycles available at no cost to non-profit agencies, charitable organizations, church groups and/or public agencies for distribution to indigent individuals and/or use in youth programs is hereby ratified, approved and confirmed. Section 2. The City Manager's action in authorizing to provide each of the three juvenile temporary employees assigned to the MPD Property Unit with a bicycle of his choice from those in stock at the Police Department as a result of forfeiture, seizure or confiscation, is hereby ratified, approved and confirmed. Od i REFERENCES: City Manager ENCLOSURES: i RECOMMENDATION: It is respectfully recommended that the City Commission adopt the attached resolution ratifying, approving and confirming the action of the City Manager to donate, at his discretion, seized, confiscated, or forfeited bicycles to non-profit agencies, churches and/or public agencies. BACKGROUND: The Miami Police Department's Property Unit has acquired 613 bicycles through seizure or confiscation process. The department is desirous to donate these bicycles in time for Christmas to indigent individuals through distribution by local social service agencies, charitable organizations church groups, or public agencies. Donation of these bicycles is allowable by Section 932.704(3)(a), 705.01, 705.03, 705.05 and other Florida Statutes. In addition, the Department is requesting three youths be allowed to each choose a bicycle of his choice for his contribution in the "Summer Youth Employment and Training Program". These youths were instrumental in taking spare parts from broken bicycles and creating whole bicycles which can now be donated as a result of their placement at the MPD Property Unit. Therefore, it is recommended that the City Commission adopt the attached resolution ratifying, approving and confirming the action of the City Manager, at his discretion, to distribute these bicycles.
