RESOLUTION NO. 87-1085
A RESOLUTION AUTHORIZING THE CITY MANAGER TO
NEGOTIATE UP TO $127,000 WITH PROPERTY OWNER
FOR ACQUISITION OF REAL PROPERTY IN THE
OVERTOWN COMMUNITY DEVELOPMENT TARGET AREA
LOCATED AT 208-244 NORTHWEST 13TH STREET IN
THE CITY OF MIAMI, LEGALLY DESCRIBED AS LOTS
2-5 INCLUSIVE, AND EAST 42 FEET LOT 6, BLOCK
9; SORTS SUBDIVISION, AS RECORDED IN PLAT
BOOK B ON PAGE 27 OF THE PUBLIC RECORDS OF
DADE COUNTY, FLORIDA, TO BE USED FOR THE
DEVELOPMENT OF HOUSING AFFORDABLE TO LOW AND
MODERATE INCOME FAMILIES; FURTHER AUTHORIZING
AND DIRECTING THE CITY ATTORNEY TO PROCEED TO
CLOSE ON THE SAID PROPERTY AFTER EXAMINATION
OF THE ABSTRACT AND CONFIRMATION OF OPINION
OF TITLE; FURTHER DESIGNATING PREVIOUSLY
ALLOCATED 11TH YEAR COMMUNITY DEVELOPMENT
BLOCK GRANT LAND ACQUISITION FUNDS IN THE
AMOUNT OF $1,000,000 TO COVER THE COST OF
SAID ACQUISITION.
WHEREAS, there is a shortage of standard housing in the City
of Miami affordable to families and individuals of low and
moderate income; and
WHEREAS, the City of Miami is in dire need of suitable
development sites for the development of such housing; and
WHEREAS, the City Commission pursuant to Motion No. 86-127,
directed the City Manager to proceed in acquiring vacant housing
sites in the Overtown Community Development Target Area for the
development of such housing; and
WHEREAS, in September of 1986, the City retained the
services of two (2) appraisers in order to determine the fair
market value of the subject property; and
WHEREAS, the two appraisers retained by the City determined
the fair market value of the subject property to be $100,000 and
$127, 000; and
WHEREAS, the City Commission, through Resolution No. 86-886
authorized the City Manager to negotiate with the owner of the
subject property and established a purchase price of $113,500;
and
WHEREAS, the City's initial offer of $113, 500 which
represented an average of the two appraisals secured by the City
was rejected by the property owner; and CITY COMMISSION

WHEREAS, a counter offer of $127,000 was submitted by the
property owner which represents the highest appraised value of

the subject property, and
WHEREAS, funding in the amount of $1,000,000 is available

from llth Year Community Development Block Grant funds for
acquisition of the subject property;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY

OF MIAMI, FLORIDA:
Section 1. The City Manager is hereby authorized to
negotiate up to $127,000 for the parcel located at 208-244
Northwest 13th Street with Henry Frederick Schuessler, Jr.,
Trustee, for the testamentary trust, of Henry Frederick
Schuessler, Sr., owner of record, for the purchase of the subject
property.
Section 2. Eleventh Year Community Development Block Grant
land acquisition funds in the amount of $1,000,000 previously
authorized by the City Commission is hereby allocated to fund the

cost of said acquisition.
Section 3. Upon notification from the City Manager that an

agreement with the property owner has been reached in accordance
i
with the above authorization, the City Attorney is hereby

authorized to proceed to close on said property after examination

of the abstract and confirmation of an Opinion of Title;

whereupon, if approved by the City Attorney, the City Manager is
hereby authorized to disburse the sum(s) of money in accordance
with said agreement.
Section 4. All recitals and finds contained in the preamble

of this Resolution are hereby incorporated by reference thereto
'
and are hereby adopted as if fully set forth in this section.

ENCLOSURES:
It is recommended that the City Commission adopt the attached
resolution authorizing the City Manager to negotiate with the
property owner up to $127,000 for the acquisition of a vacant
parcel located at 208-244 Northwest 13th Street in the Overtown
Community Development Target Area for the purpose of developing
affordable. sales housing in the Overtown neighborhood.
BACKGROUND:
The Housing Conservation and Development Agency recommends the
adoption of the attached resolution authorizing the City Manager to
negotiate up to $127,000 with the owner of the property located at
208-244 Northwest 13th Street in the Overtown neighborhood.
in February of 1986, through Motion NO. 86-127, the City Commission
directed the City Manager to proceed in acquiring two vacant
housing sites in the Overtown neighborhood for the purpose of
developing sales housing affordable to low and moderate income
families under the City's Affordable Housing Development Program.
Subsequently, the City retained the services of two appraisers in
order to determine the fair market value of the subject parcels
under consideration for acquisition. The appraisers retained by
the City, Martin Golob and Moses C. Florences, determined the fair
market value of the aforementioned property to be $100,000 and
$127,000, respectively.
On November 13, 1986, through Resolution No. 86-886, the City
Commission authorized the City Manager to proceed in acquiring
subject property through a negotiated purchase and established a
purchase offer of $113,500 for the subject parcel which represents
an average of the two appraised values assigned by the appraisers.
Subsequently, the City's offer of $113,500 was forwarded to the
owner and a counter offer of $127,000 was submitted to the City by
the owner, which represents the highest appraised value assigned
the subject property by the appraisers.

In an effort to expedite the development of affordable sales
housing in the Overtown neighborhood, it is recommended that the
City Commission approve the attached resolution authorizing an
increase in the purchase offer to $127,000 for acquisition of the
property located at 208-244 Northwest 13th Street. $1,000,000 in
Community Development Block Grant funding previously authorized by
the City Commission for the acquisition of housing sites in
connection with the City's Affordable Housing Development Program
is available to fund the cost of acquiring the above mentioned
parcel.
