N 7-1084 A RESOLUTION TERMINATING THE PROFESSIONAL SERVICES CONTRACT WITH LEGGATT MCCALL ADVISORS, INC., FOR THE MIAMI INDUSTRIAL LAND USE NEEDS STUDY; AND DIRECTING SERGIO RODRIGUEZ, PLANNING DIRECTOR, TO COMPLETE THE PROJECT WITH THE REMAINING FUNDING. i'. WHEREAS, by Contract No. 86-050, dated July 24, 1986, the City of Miami }; entered into a professional services contract with Leggatt McCall Advisors, Inc., for the preparation of an Industrial Land Use Needs Study; and 11 } WHEREAS, this contract specified that the study was to have been completed within 120 days; and WHEREAS, the consultant has satisfactorily completed only one of three phases of the study; and WHEREAS, Leggatt McCall Advisors, Inc., has been twice notified of the } tardiness of the project without completing the remaining work in a satisfactory manner; and WHEREAS, the contract provides for termination of the agreement when the — ' consultant is found to be in default by the City; and WHEREAS, the timely and accurate completion of the Industrial Land Use Needs study is important to the City of Miami for economic development and regulatory purposes; and WHEREAS, the Planning Department has the expertise to coordinate final completion of the project in a timely manner; i NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The contract with Leggatt McCall Advisors dated July 24, 1986, is hereby terminated. 3 Section 2. The City Manager is hereby authorized to negotiate partial a j payment of the remaining funds appropriated to the project to assure proper compensation of the subcontractors. Odi o cj ENCLosuREsDECEMBER -10, 1987 City Manager RECOMMENDATION It is respectfully recommended that the City Commission adopt the attached resolution terminating the professional services contract with Leggatt McCall Advisors, Inc., for the preparation of the Miami Industrial Land Use Needs Study, authorizing the City Manager to negotiate partial payment to assure that the subcontractors are properly compensated, and directing the Planning Department to use the remaining funds to complete the study. BACKGROUND The City Commission appropriated $60,000 for a study of the City of Miami's needs for industrial land. The study, to be directed by the Planning Department, was to investigate the potential for industrial growth in Miami, determine the extent to which the industrially zoned supply of land is adequate to accommodate expected growth, and recommend a course of action for encouraging development or redevelopment of the C i ty' s industrial neighborhoods. Based on their response to the request for proposals, Leggatt McCall Advisors, Inc. of Boston, Massachusetts, was selected by the Commission to execute the study. The resulting contract was signed on July 24, 1986; for a project to be completed within 120 days, consisting of a physical assessment of the City of Miami's industrial neighborhoods (Phase I), a market analysis of these neighborhoods to review their potential for future development (Phase II), and a specific program of action for the improvement of these areas (Phase III). In January 1987, the consultants were notified of the tardiness of the study by letter from the Planning Department. They completed the market analysis (Phase III) and were paid $20,000. In conjunction with several local subcontractors, the consultant conducted the majority of the field research necessary to complete Phase I. However, because the draft document submitted ignored important factors such as the required review of the effect of zoning restrictions on the redevelopment of these industrial areas, this Phase was determined to be incomplete and no payments were made. After a second letter from the City in July 1987, noting the excessive tardiness of the study, the consultants submitted an outline of proposed recommendations as part of Phase III, but have not completed this phase either. The Planning Department is ready to use 'the $15,000 designated for Phase III to complete the project, hiring contractors to evaluate the zoning issues not addressed in Fnase I and to produce the final document required in Phase III.
