HomeMy WebLinkAboutR-87-108201* J-87-1073 12/10/87 RESOLUTION NO. 97o"1082 A RESOLUTION AMENDING RESOLUTION NO. 87-664, ADOPTED JULY 9, 1987, BY ADDING A SECTION 2 THERETO, THEREBY ALLOCATING AN ADDITIONAL AMOUNT, NOT TO EXCEED $150,000, FROM THE CITY OF MIAMI LAW ENFORCEMENT TRUST FUND FOR THE CONTINUED FINANCING OF COMPLEX AND/OR PROTRACTED CRIMINAL INVESTIGATIONS, UPON SUCH COSTS AND EXPENSES HAVING BEEN APPROVED BY THE CHIEF OF POLICE. WHEREAS, Florida State Statute 932.704(3)(a) authorizes the use of Law Enforcement Trust Fund monies to defray the costs of protracted and/or complex investigations and to provide law enforcement with additional technical equipment and expertise; and WHEREAS, the need exists within the Miami Police Department to conduct protracted and/or oomplex investigations which often require additional monies for such costs as overtime, the purchase/rental of equipment and supplies, payment of confidential informants, buy monies, and other investigative support investigative expenses; and WHEREAS, it is in the best of interest of the oommunity and the City of Miami to fund these expenditures through monies generated as a result of the seizures authorized under the Florida Contraband Forfeiture Act; and WHEREAS, funds to cover these necessary and legitimate costs and expenditures have not been included in the Police Department's normal, operating budget; and WHEREAS, the Chief of Police has recommended adoption of this resolution and determined that the expenditures proposed comply with Florida State Statute 932.704; and —v� WHEREAS, the funds to cover the necessary and legitimate expenses are available in the City of Miami Law Enforcement Trust -- Fund; i AMENDED ROGNOW BY .. Resolution No. 87-654, adopted on July 9, 1987, is hereby amended by adding a new section in the following particulars: "Section 2. Additional funding in an amount not to exceed $150,000 is hereby allocated from the Law Enforcement Trust Fund, and the Chief of Police is hereby authorized to expend monies for the necessary and legitimate expenses associated with the continuation of complex and/or protracted investigations." Section 2. This Resolution shall be effective upon its adoption and the provisions thereof, unless otherwise indicated herein, shall also become operative upon its adoption. _ PASSED AND ADOPTED this loth day of D cember 1987. OdioVV City Manager RECOMMENDATION: GATE: NOV * 5 1987 FILE: SUBJECT: Proposed Resolution for Expenditure of Law Enforcement Trust Fund Monies REFERENCES: ENCLOSURES: It is respectfully requested that the City Commission adopt the attached resolution amending Resolution No. 87-654 and allocating an additional one hundred and fifty thousand dollars ($150,000) from the City of Miami Law Enforcement Trust Fund for specialized crime suppression activities which will involve protracted, in- depth, and/or complex investigations. BACKGROUND: The Miami Police Department is requesting that the funding of special investigative activities, as provided for originally under the seed monies allocated under "Operation Crime Suppression" in Resolution No. 86-665 and Resolution No. 87-654, be continued as authorized under Florida Statute 932.704, the Florida Contraband Forfeiture Act. The monies will be utilized to enhance and support police operations by providing additional resources to pay for such expenses as overtime, the purchase and/or rental of necessary equipment and supplies, the payment of confidential informants, the provision of buy monies, consultant/expert services, and any other special investigative expenditure required for the successful investigation of protracted and/or complex investigations as authorized by the Chief of Police. Therefore, it is requested that the attached resolution amending Resolution No. 87-654 be approved to provide an additional $150,000 from the Law Enforcement Trust Fund for the enhancement of resources available for the conducting of complex and/or protracted criminal investigations.
