WHEREAS, the. Miami zoning Board, at its meeting of
October 19, 1987, Item No. 3, following an advertised hearing,
adopted Resolution No. ZB 87-116, by a nine to zero Vote,
RECOMMENDING, APPROVAL of a change of zoning classification, as
hereinafter set forth; and
WHEREAS, the City Commission after_ careful consideration of
this matter deems it advisable and in the best- interest of the
general welfare of the City of Miami and its inhabitants to
grant this change of zoning classification as hereinafter_ set
forth;
NOW; THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The Zoning Atlas of Ordinance No. 9500, the
zoning ordinance of the City of Miami, Florida, is hereby amended
by changing the zoning classification of approximately
3151-3199 Southwest 27th Avenue, 2660 Lincoln Avenue and 2699
Tigertail Avenue, Miami, Florida, more particularly described as
Lots 1-6, Block F, AMENDED PLAT OF NEW_BISCAYNE, as recorded in
Plat Book B at Page 16 of the Public Records of Dade County,
Florida, from PD-MU Planned Development Mixed Use to SPI-*13
Southwest 27th Avenue Gateway District.

by changing the zoning classification of approximately
3151-3199 Southwest 27th Avenue, 2660 Lincoln Avenue and 2699
Tigertail Avenue, Miami, Florida, more particularly described as
Lots 1-6, Block F, AMENDED PLAT OF NEW BISCAYNE, as recorded in
Plat Book B at Page 16 of the Public Records of Dade County,
Florida, from PD-MU Planned Development Mixed Use to SPI-13
Southwest 2.7th Avenue Gateway District,
Section 2, It is hereby found that this zoning
classification change;

(a) Is in conformity with the adopted Comprehensive
Neighborhood Plan;
(b) is not contrary to the established land use pattern;
(c) Will not create an isolated distri.dt unrelated to
adjacent anti nearby districts;
(d) Is not out of scale with the needs of the neighborhood
or the City;
(e) Will not materially alter, the population density
pattern or increase or overtax the load on public
facilities such as schools, utilities, streets, etc.;
(f) is necessary due to changed or changing conditions;
(g) Will not adversely influence living conditions in the
neighborhood;
(h) Will not create or, excessively increase traffic
congestion or otherwise affect public safety;
(i) Will not create a drainage problem;
(j) Will not seriously reduce light and air to adjacent
area;
(k) Will not adversely affect property values in the
adjacent area;
(1) Will not be a deterrent to the improvement or
development of adjacent property in accord with
existing regulations;
(m) Will not constitute a grant of special privilege to an
individual owner as contrasted with protection of the
public welfare.
Section 3. Page No. 45 of the Zoning Atlas, made a part of
Ordinance No. 9500 by reference and description in Article 3,
Section 300 of said Ordinance, is hereby, amended to reflect the
changes made necessary by these amendments.
Section 4. All ordinances or parts of ordinances insofar as
they are inconsistent or in conflict with the provisions of this
ordinance are hereby repealed.
Section 5. If any section, part of section, paragraph,
clause, phrase, or word' of this ordinance is declared invalid,
the remaining provisions of this ordinance shall, not lip aEFP- teA

Zoning Atlas of Zoning Ordinance 9500, as
amended, the Zoning Ordinance of the City of
Miami to SPI-13 SW 27th Avenue Gateway District.
APPROVAL, The proposed change would .be in
co" on7o m ty with the proposals made by the
Planning Department for the SPI-13 district. An
amendment to the adopted 1985 Miami
Comprehensive Neighborhood Plan is necessary.
The Planning Department prepared a'zoning study
for 27th Avenue, south of Dixie Highway and
excluded the subject property from the
recomlRendations presented before the City
Commission because itL would constitute' a down

This decision was taken after the Law Department
advised us to do so'due to the recent rezoning
granted in Juhe of 1985 by the City Commission
which in fact granted a higher intensity of
use= The subject request, however, is initiated
f by the property owner, who is aware that this
would constitute a down zoning.

Toning Board adopted Resolution ZB 116-87
by a 9 to 0 vote recommending approval to the
City Commission.

at the meeting. Seven objections were received
by mail.

The six lots which are the subject of this amendment are
presently zoned PD-MU/G. The property was rezoned to that
classification in June 1985# and the rezoning was tied to a site
plan for a multi -use residential/ retail/office complex which did
not move forward.
On July 23► 1987, the City Commission approved Ordinance No.
10308 amending Ordinance No. 9500► the Zoning ordinance, by
adding a new special public interest district, ;PI-13, Southwest
27th Avenue Gateway District. Said ordinance created a new
classification for S.11. 27th Avenue from Tigertail Avenue to S.W.
28th Terrace.
The subject property was not included in the amendment and
remained zoned PD-M/6. The PD--MU/6 classification is the only,
one of said use remaining in the city and is ineffective for any
future development of the subject property except as described in
the site plan presented by the oviners/developer in 1985. Said
plan is no longer viable, and the present zoning prevents any
reasonable development of the property. The present owners of
the subject property are limited to such a degree in the possible
uses.of the property under the present zoning as to negate any
future improvement of the property unless it is rezoned.
The subject property, under the PD-MU/6 zoning will remain
an eyesore and blight to the neighborhood and is not in conform-
ity with the recently enacted SPI-13 S.W. 27th Avenue Gateway
District. The property ist and should be, considered a' part of
said district.
Based on the existing classification, the property cannot be
fully utilized and developed and remains in disharmony with the
SPI-13 District to the west and north. In addition, the aban-
doned gas station located on lot l has created a condition which
detracts from. the City Commission's desire to develop S.PJ. 27th
Avenue in a harmonious and controlled manner.
Therefore, the present zoning designation is inappropriate
as it is more appropriate to give the owners of the property the
option to develop said property in a more compatible manger with
the recently approved SPI-13 on the rest of S.Vi.,27th Avenue,

Given the present zoning and the reclassification of the,
S.w., 27th Avenue Gateway as. described above, the proposed change
in hhe Zoning to 5PI-13 would Allow more creative planning and
building .in harmony with the neighborhood anO the city' s plans
for the gateway to Coconut Grove. It also would permit a greater
flexibility in the uses of the subject property which would fit
within the plans for future development of the area envisioned by
the City.
Because of the changed circumstances in the Coconut Grove
area, as embodied in the SPI-13 Zoning Amendment and the present -
inability under the current zoning classification to make use of
the subject property, the requested zoning change is in the
public interest, represents a down -zoning and less intense use of
the subject property which is in harmony with the neighborhood,
and approval of the request would be beneficial to the City and
would be in harmony with the stated intent and purposes of the
recent SPI-13 !Amendment and the Zoning Ordinance.

XI, SPECIAL CLAUSES:
(a) Notwithatanding anything to the contrary herein
contained, the Buyer shall have one hundred twenty (120) days
from the date of execution by Seller to determine the feasibility
of the Property for use as a restaurant. If the Property may not
be developed for use as a restaurant As contemplated by Buyer,
the Buyer shall notify the Seller in writing thereof -and the
Escrow Agent shall forthwith return the deposit aforedescribed
and all interest earned thereon to Buyer, whereupon each party
hereto shall be released and relieved of further obligations
hereunder.
(b) The purchase money note described in Paragraph
II(c) above shall bear interest at a fluctuating rate 2X above
the rate charged from time to time by Citibank, N.A. to its most
favored borrowers for ninety day borrowings. Interest shall"be
paid quarterly and the entire princtpaL amount shall be due and
payable on the third (3rd) anniversary of the closing of this
transaction. Prepayment in whole or in part may be made at any
time without premium or penalty.
( c ) The Escrow Agent aforedescribed shall forthwith
place the escrow deposit described in Paragraph II(a) above in an
interest -bearing accou:tt. Interest earned shall be paid to Buyer
at closing or used to furtherreduce the balance to close. In
the event that Buyer shall default, the escrow deposit and
interest earned thereon shall be forthwith paid. to Seller and
Carlos R. Eiber, Co. and Foreign Investments Consultants
Corporation and each party shall be released and relieved of
further obligations hereunder, notwithstanding anything to the
contrary herein contained.-
(d) The Property was previously used as a gasoline
service station and the parties are uncertain as to whether or
not gasoline storage tanks remain below the surface thereof. The
Seller agrees, at Seller's cost, prior to closing, to determine
the presence or absence of such tanks, and to cause their removal
from the Property if they are found to exist. If removal is
required, the Seller shall also, at Seller's cost, re —fill the
Property to the present grade.

Dear Ms. Fox:
Our client, Mr. David Welsh, is the owner of the
property located at.3151 Southwest 27th Avenue in Coconut
Grove. Mr. Welsh was informed, on the afternoon of September
16, of an application to rezone (to classification SPI.13),
lots 4, 5 and 6 of that block, and that the owners of lots 2
and 3 have also joined or may join in that application.
Mr. Welsh owns the remaining lot (lot 1`) of the block,
and had previously requested that his property be rezoned to
SPI 13 zoning, though he never made formal application for
such. He was advised, by -letter dated June 13, 1986, by Mr.
Sergio Rodriguez, that the requested rezoning would have to
be made jointly by the owners of all six lots referred to
above; currently zoned PD MU. A copy of that letter is
enclosed for your convenience.
Mr. Welsh still desires to obtain a rezoning of his
property to SPI 13, and may ultimately join in the pending
application; however, he wishes to know more about it before.

We ara'contacting the other property owners in an effort
to ascertain ..whether a joint application (for all six lots)
would be appropriate. In the meantime, we would greatly'
appreciate your sending us a copy of the pending application.

Dear Mr. Reynolds:
We are on receipt of your letter in which you inform us of your representation
of David Welsh for the above reference property.
In June of 1985, the zoning of this property, along with others located on
27th Avenue between Lincoln Avenue and Tigertail, was changed from RG 2/5 to
RG 2/6 and then to PD MU.
This Department prepared a zoning study for 27th Avenue, south of Dixie
Highway and excluded the subject property from the recommendations presented
before the City Commission because of the recent change, which in fact granted
a higher intensity of use.
The owners of the subject lots can jointly request the already granted
classification in order to have it included in the 27th Avenue rezcning study
or in the alternative, a classification which is consistent with,the Planning
Department's recommendation for surrounding properties.
The Planning Department, follpwi_ng the direction of the City Commission, has
held two neighborhood meetings with affected owners and neighbors of that
particular area. Mr. Welsh was included on our mailing list and he was
advised of the meeting's time and place.
