AN ORDINANCE AMENDING;, THE MIAMt COMi3Rr HENs1VE
NEIGHBORHOOD PLAN AND ADDENDA (SEPTEMBER
1985) FOR PROPERTY LOCATED AT APPROXIMATELY
3151=3199 SOUTHWEST 21TH AVENUE, 2660 LINCOLN
AVENUE AND 2699 TIGERTAIL AVENUE (MORE
PARTICULARLY DKSCRIBED HEREIN) BY CHANGING
DESIGNATION OF THE SUBJECT PROPERTY FROM
MODERATE HIGH DENSITY RESIDENTIAL TO
COMMERCIAL RESIDENTIAL USE; MAKING FINDINGS;
CONTAINING A REPEALER PROVISION AND A
SEVERABILITY CLAUSE.
WHEREAS, the Miami Planning Advisory Board, at its meeting
of October 21, 1987, Item No. 1, following an advertised hearing
adopted Resolution No. PAB 61-87, by a 8 to 1 vote, RECOMMENDING
APPROVAL of an amendment to the Miami Comprehensive Neighborhood
Plan and Addenda (September 1985), as hereinafter set Forth; and
WHEREAS, changing conditions in the area surrounding the
subject property,, support the herein changes; and
WHEREAS, the City Commission after careful consideration of.
this matter deems it advisable and in the best interest of the
general welfare of the City of Miami and its inhabitants to grant
this Comprehensive Plan change as hereinafter set forth;
NOW, THEREFORE, RE IT ORDAINED BY -THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The Miami Comprehensive Neighborhood Plan and
Addenda (September 1985), is hereby amended by changing the
designation of that certain parcel of property located at
approximately 3151-3199 Southwest 27th Avenue,- 2660 Lincoln.
Avenue and 2699 Tigertail Avenue, more particularly described as
Lot(s) 1-6 inclusive, Block F, Amended Plat of New Biscayne, as
recorded in Plat Book B at page 16 of the Public Records of Dade
County, Florida, from Moderate/High Density Residential. to
Commercial Residential use.
Section 2. It is hereby found that this Comprehensive
Plan designation change;

NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Suction 1. The Miami Comprehensive Neighborhood Plan and
Addenda (September 1985), is hereby amended by changing the
designation of that certain parcel of property located at
approximately 3151-3199 Southwest 27th Avenue, 2660 Lincoln
Avenue and 2699 Tigertail Avenue, more particularly described as
Lot(s) 1-6 inclusive, Block F, Amended Plat of New Biscayne, as
recorded in Plat Rook B at page 16 of the Public Records of Dade
County, Florida, from Moderate/High Density Residential to
Commercial Residential. use.
Section 2. It is hereby found that this Comprehensive
:Plan designation change;
a, Is necessary due to changed or changing conditions;
b involves a residenLial land use of 5 acres or less and
a density of 5 units per acre or less or involves other
land use categories, Singularly or in combination with
residential use, or 3 acre: or less and does not, in
combination with other changes during the last year]
product-- a cumulative effect or having changed more than
30 acres;
c. The property which is the subject of this amendment has
not been the specific subject of a Comprehensive Plan
change within the last year; and
d. The herein amendment does not involve the same owner's
property within 200 feet of property provided a
Comprehensive Plan change within the last 12 months.,
Section 3. All ordinances, code sections, or parts
thereof in conflict herewith are hereby repealed insaEar as they
are in conflict.
Section 4. Should any part or provision of this
Ordinance be declared by a court of competent jurisdiction to be -
invalid, the same shall not affect the validity of the ordinance
as a whole.

Moderate/High Density Residential to Commercial
Residential designation.
REQUEST To amend the . plan for this property from
Moderate/High Density Residential to Commercial
Residential designation.
ANALYSIS
The Planning Department supported the
introduction of commercial uses on S W. 27th
Avenue in the planning study - "S.W. 27th'Avenue
Planning Study - A Gateway to Coconut Grove"
which was recommended by the Planning Advisory
Board. At that time, no recommendation was made
for this site as- it had been the subject of a
recent zoning decision by the City Commission;
the,application of recommendations to this site,
consistent with the planning study, would have
resulted in a downzoning.
In this instance,, the applicants, in a separate
action, are seeking a downzoning to SPI-13
S.W, 27th Avenue Gateway District; which the
Planning Department is recommending to the
Zoning Board.
In this instance amending the plan to
Commercial/Residential, consistent with the
SPI-13 proposed rezoning, would extend similar
designations along S.W, 27th Avenue and create

Approval.
At its meeting of October 21, 1987, the Planning
Advisory Board adopted Resolution PAB 61-87, by
a 8 to 1 vote, recommending approval of the above.
Two replies in favor and nine objections were
received by mail. Five proponents and 3 opponents
were present at this meeting.
The decision of the December 2nd meeting will
be presented at the December-10th City Comrission
hearing.

Section 6Z-17 of the Code of the City of Miami, Periodic review, additions at
amendments to the adopted comprehensive plan, reads as follows:
Periodically, but not less often than once in
five (5) years or more often than once in two
(2) years, adopted comprehensive plans or a
portion thereeof shall be reviewed by the
planning advisory board to determine whether
changes in the amount, kind or direction of
development and growth of the city or arear
thereof, or other reasons, make it necessary or
beneficial to make additions or amendments to
the comprehensive plans, or portion thereof. If
the city commission desires an amendment or
addition, it may, on its own motion, direct the
planning department to prepare such amendment
for submission to and review by the planning
advisory board. The planning advisory board
shall make a recommendation on the proposed plan
amendment to the city commission within a
reasonable time as established by the city
commission. The procedure for revising, adding
to or amending comprehensive plains or portions
thereof shall be the same as the procedure for
original adoption.

The existing Plan designation "Moderate/High Density" is
inappropriate because on January 21, 1g86 the City Commission
passed Ordinance No. 86-61 amending the plan to include the
properties between Sird Road to Tigertail Avenue on S.W. 27th
Avenue as "Commercial/Residential" in conjunction with the zoning
designation of the S.W. 27th Avenue Gateway as SP1-13.
This property should be included in the redesignation and
amendment of the plan to reflect its compatibility with the
property currently designated "Cotnn;nercial/Residential".
The proposed change is in harmony with the proposed Plan and
should be approved as a major step in improving the 8.11. 27th
Avenue Gateway to Coconut Grove. Vie changes would beneficially
affect the neighborhood and would be compatible with the direction
expressed by Staff and the City Commission.
In addition, the appropriateness of amending the Plan id� out-
lined in the rezoning application being submitted simultaneously
with the Comprehensive Plan amendment..
The City Commission and Staff approved the Plan change for the
27th Avenue Gateway, and this Plan change being requested is
compatible with the Commission's prior action and harmonious with
Staff's recommendations for the area. The "Commercial/Residential"
designation would afford the flexibility for reasonable development
and would become a vehicle for more beneficial use of the property.
