AN ORDINANCE, AMEND CNG OaOINANCE NO. 9500, AS
AMENDED, THE "ZONING ORDINANCE OF THE CITY OF
MIAMI, FLORIDA, BY AMENDING ART:ICLF 20,
ENTITLED "08NERAL AND `SUPPLEMENTARY
REGULATIONS"; SECTION 202E ENTITLED "SIGNS,
SPECIFIC LIMITATIONS AND REQUIREMENTS";
SUBSECTION 2026.15. ENTITLED "OUTDOOR
ADVERTISING, SIGNS"; AND PARAGRAPH
2025.15.2.1., BY REDUCING THE NUMBER OF
OUTDOOR ADVERTISING SIGNS FROM A MAXIMUM OF
TEN (10) TO NINE (9') WHICH MAY FACE LIMITED
ACCESS HIGHWAYS, WITHIN TWO HUNDRED (200)
FEET OF THE WESTERLY S[DE OF I-95 RIGHT-OF-
WAY LINES, OR OF ANY LIMITED ACCESS HIGHWAY

CONTAINING A REPEALER PROVISION AND A
SEVERABILITY CLAUSE.
WHEREAS, the Miami Planning Advisory Board, at its meeting
of APRIL 15, 1987, Item No. 5, following an advertised hearing,
adopted Resolution PAB 30-87 by a vote of 7 to 0, RECOMMENDING
APPROVAL, of amending Ordinance No. 9500 as hereinafter set
forth; and
WHEREAS, the City Commission after careful consideration of
this matter deems it advisable and in the best interest of the

general welfare of the City of Miami and its inhabitants to amend
Ordinance No. 9500 as hereinafter set forth;
NOW, THEREFORE, BE IT ORDAINED BY THE ,COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. Ordinance 9500, the Zoning Ordinance of the
City of Miami, Florida, is herein amended in the following
respect:1
"ARTICLE 20. GENERAL AND SUPPLEMENTARY REGULATIONS

2026.15. Outdoor advertising signs,
2026.15.2.2f Limitations on location, Orten tat ion,3/

and expressways. Except as otherwise Provided in Section
2026.15.1, outdoor advertising signs may he carected,
constructed, aIteredd, 11ali.ntained or relocated within
six hundred sixty (660)- feet of Iny limited acCe::s
highway including expressways as established by the State
of Florida or any of its political subdivisions, provided
that such sign faces are parallel to or at an angle of
not greater than thirty (30) degrees with the center_ line
of anv such limited access highway and faced away from
such highway.
2026.15.2.1. No outdoor advertising sign which faces any
such limited access highway to a greater degree than
permitted in 2026.15.2 shall he erected, constructed,
alterlr), maintained or relocated within six hundred sixty
(660)- feet of any such hirlhways, including expressways,
easterly of I=9.5. Outdoor advertising signs, a maximum
of nine +1-,G+ (9) in number which face such limited
access big wh ays, may be erected, constructed, altered,
maintained or relocated within two hundred (200) feet of
the westerly side of I-95 right-of-way lines, or of any
limited access highway including expressways westerly of
I-95, as established by the State of Florida or any of
its political subdivisions, after_ city commission
approval utilizing standards and review procedures for
special exceptions, and subject. to the following
conditions:"
Section 2. All ordinances or parts of ordinances insofar
as they are inconsistent or in conflict with the previsions of
this ordinance are hereby repealed.
Section 3. If any section, part of section, paragraph,
clause, 'phrase or word of this ordinance is declared invalid, the
remaining provisions of this ordinance shall not be affected.

Miami, by amending ARTICLE 20. GENERAL ANO
SUPPLEMENTARY REGULATIONS, Section,2026 Signs,
specific limitations and requirements,
Subsection 2026.15. outdoor advertising signs,
paragraph 2026.15.2.1. to reduce the number of
outdoor advertising signs from a maximum of ten
(10) to nine (9) which may face limited access
hi ghwaTs, within two hundred (200) feet of the
westerly ;ida of I-95 right-of-way lines, or of
any 1 i mi ted access highway inclusive of
expressways westerly of I-95.
REQUEST
To reduce the permissible number of billboards
immediately west of I-95 from 10 to 9.
BACKGROUND
IrL September, 1985, by Ordinance 10037, the City
Commission amended this section of the Zoning
Ordinance to allow 10 outdoor advertising signs
within 200 . feet of the westerly side of I-95.
The City Commission then specifically approved 9
si gn locations. On March 139 1987 the
Commission considered an application for the
10th sign location. A motion to approve the
sign failed. The Commission then passed
Motion 87-257 unanimously is follows:
"A MOTION DIRECTING THE CITY MANAGER TO INSTRUCT
THE PLANNING DEPARTMENT TO COME BACK WITH. A.
RECOMMENDATION AS TO HOW TO REDUCE THE TOTAL
NUMBER OF PERMITTED OUTDOOR ADVERTISING SIGNS
FROM TEN TO NINE."
ANALYSIS The Planning Department had, in the past,
recommended against the installation of
billboards which would be visible from the
expressway system. Consistent with this
previous recommendation, the Planning Department
supports this reduction of permitted billboards,
RECOMMENDATIONS even if only by ,one.

by a 7 to 0 vote, recommending approval of the
above.
