WHEREAS, the Miami Planning Advisory Roard, at its meeting of October 7, 1987, item No. 1, following an advertised hearing, adopted Resolution No. PAB 58-87, by a 9 to 0 vote, RECOMMENDING APPROVAL of applying the zoning classifi-cation to the subject properties, as hereinafter set forth; and WHEREAS, the City Commission, after consideration of this matter deems it advisable and in the best interest of the general welfare of the City of Miami and its inhabitants to grant this application as hereinafter set forth; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CI`PY OF MIAMI, FLORIDA: Section 1. The Zoning Atlas of Ordinance No.-9500, the Zoning Ordinance of the City of Miami, Florida, is hereby amended by changing the Zoning Classification from RG-1/3 to RG-2/5 to the area generally bounded by Cocoanut Avenue on the South; a line parallel to Virginia Street and located approximately 150 feet East of it on the West; a line parallel to Cocoanut Avenue and located 150 feet North of it on the North; and a line parallel to Southwest 27th Avenue anti located approximately 150 feet West of it on the West more particularly described as Lots 41 51 6, 7, Be 91 .10, lit 12, 13, 14, 15, 16, 17, 18, 19, 20, 21, 22 and 23, Block 1, PALM TERRACE, as recorded in Plat Rook 3 at page 47 of the Public Records of. It is hereby found that this zoning classiE:i cation change: (a) Is in conformity with the adopted Miami Comprehensive yeighborhood Plan; (b) Is not contrary to the established land us(� pattern; (c) Will not create an isolated district unrelated to adjacent and nearby districts; (d) is not out of scale with the needs of the neighborhood or the City; (e) Will not materially alter the population density pattern or increase or overtax the load on public facilities such as schools, utilities, streets, etc.; (f) Is necessary due to changed or changing conditions; (g) Will not adversely influence living conditions in the, neighborhood; (h) Will not create or excessively increase traffic congestion or otherwise affect public safety; (i) Will not create a drainage problem; (j) Will not seriously reduce light and air to adjacent area; (k) Will not adversely affect property values in the adjacent area; (1) Will not be a deterrent to the improvement or. development of adjacent property in accord with existing regulations; (m) Will not constitute a grant of special privilege to an individual owner as contrasted with protection of the. public welfare. :Section 3. AREA GENERALLY BOUNDED BY COCOANUT AVENUE ON THE ; . Change of zoning classification from RG-1/3 to RG-2/5. REQUEST To amend the zoning atlas for lots located on the north side of Cocoanut Avenue from Approximate!,-150 ft. west of SW 27th Avenue to approximately 150 ft. east of Virginia Street. BACKGROUND This item was withdrawn from 2nd Reading before the City Commission and reverted.to the Planning Advisory Board to correct a one -word error in the advertisement notice. The Planning Oepartment conducted a comprehensive analysis of SW 27th Avenue, south of Dixie Highway, and its relationship to the rest of the Coconut Grove Area. This analysis was presented for consideration by the Planning Advisory Board at its meeting of May 14, 1986, and for consideration by the City Commission at its meetings of .May '22, 1986 (1st Reading) and October 23, 1986 (2nd Reading), receiving an approval. in principle. The. amendment to, the Comprehensive Neighborhood Plan was reviewed and approved by OCA (letter included), the Planning Advisory Board and ,the City Commission at their respective meetings of May 140 1986 (PAB Resolution #15-86) and October 23, 1986 (CC Ordinance #10160. This particular zoning change was recommended by the Planning Qepartmient and was continued at the Planning Advisory Board meeting of . December 170 1986, and deferred at the Planning Advisory Board meeting of January 7, 1987, and administratively removed for lack of notice from the Planning Advisory Board agenda of February 4, 1987, At its meeting of February 18, 1987, the Planning Advisory Board adopted Resolution PAB 14•87, byr a 7 to 2 vote, recommending approval of the above.. .03% PAB 10/7187 item �1 Page 1 F'- The City Commission continued the above to its meeting of March 31, 1987, At its meeting.of April 30, 1987, the City Commission passed the above on First Reading. The item was then continued on June 25th, and on July 23rd, to November, 1987,. It was then administratively withdrawn for correction of erroneous notice. (See Attachment A for background material from these previous hearings). ANALYSIS The condition of development along SW 27th Avenue and its immediate surroundings generates the need to develop in accordance with the rest of the Coconut Grove area and in relation.to the transit station. The proposed zoning changes create the appropriate atmosphere for adequate development. Two companion items - the application of the SPI-19 Overlay District - will prohibit off -site parking. RECOMMENDATIONS PLANNING DEPT. Approval. PLANNING ADVISORY BOARD At its meeting of October 7, 1987, the Planning Advisory Board adopted Resolution PAB 58-87, by a 9 to 0 vote, recommending approval of the above. One reply in favor ana three objections were received by mail. CITY COMMISSION At its meeting of October 22, 1987, the City Commission continued the above to its meeting of November 12, 1987. The decision of the December 2nd meeting will be presented at the December loth City Commission hearing. The development of 27th Avenue with commercial divides the existing residential areas on both sides of 27th Avenue and does not serve to unify the neighborhood. If anything is a "gateway" to the Grove, it should be its residential tree lined streets with a village center, not the continuation of the type of, development that is on 27th Avenue, north of U.S. 1. The specifications proposed in the planning fact sheet dated November 25, 1986 need to be revised to insure preservation of the Grove's special character. The continuing zoning violations at the corner of Day Avenue and Center Street illustrate the importance of having effective specifications and the capacity to strongly enforce them. We would first point out that the planning fact sheet proposed for the SPI-13 district contains two substantial conceptual errors - are in the type of activity expected from this rezoning and second in the technical specifications of the proposed new buildings.. First, both land and construction costs in Eoconut Grove require that new building's tenants receive a high volume of sales income per square foot, such as in a Mayfair or Ccmmador Plaza type of office or shop. Low income per square foot tenants such as drug store, newstands, hardware stores, etc.., cannot afford the rents. Only a few of the permissable retail uses in SPI-13 - jewelery stores, banks, gift shops and restaurants - qualify to pay high rents. In reality, despite the varied list of retail uses permissable in SPI-13, only a very few of these can economically be done in Coconut Grove today. Second, to permit retail and office space on 27th Avenue in 50, high buildings of a 1.0 floor area ratio with no setback from the sidewalk will create towers blocking sunlight from adjacent residential, areas that are surrounded by a sea of steel and parking. Existing examples of this are Grove Towers and the Bakery Center - the unattractiveness of 27th Avenue north of U.S, 1 will be brought to Coconut Grove, In short, the Grove will loose its special character with the adoption, as proposed, of SPI-13. (3) Building front setbacks should be staggered, one half would have no setback, and half 20' from the sidewalk. A 27th Avenue with 4 lanes of traffic and no setbacks will create a canyon of buildings and a runway for a street, as is 27th Avenue north of U.S. 1. That the additional setback areas be a minim= of 20' deep and contain parks, outdoor restaurants or similar public spaces and be heavily landscaped. (4) Landscaping requirements should be intense to maintain the Grove's character and make the area more habitable. The 10' high tree required in theplanning fact sheet is insignificant with larger structures. Trees should have a minimum height of 20' clear truck for every 250 square feet of yard and every 30' of frontage on 27th Avenue. In addition, a stall or planting hedge would be planted along Center Street. The developer also promised to do necessary right of %av improvements, such as sidewalks, along his property. To guarantee that this does not happen on 27th avenue an impact fee of $2 per square foot of construction should be required of the developer at the time of site plan approval (to be disbursed for landscaping of the property). These moneys should be used as a forfeiture bond/fund should the developer fail to maintain the landscape as required. Note also that ingress and, egress from this building was not to be from Center Street - a residential street 15, wide which barely holds 2 lanes of cars -yet this is the main entrance for the building's approximately 50 cars per day.
