AN ORDINANCE AMENDING SECTIONS 1 AND 6 OF ORDINANCE NO. 10321, ADOPTED SEPTEMBER 22, 1987, AS AMENDED, THE ANNUAL APPROPRIATIONS ORDINANCE FOR THE FISCAL YEAR ENDING SEPTEMBER 30, 1988, BY INCREASING THE APPROPRIATIONS IN THE PROPERTY AND LEASE MANAGEMENT ENTERPRISE FUND IN THE AMOUNT OF $34,000 FOR THE PURPOSE OF ACQUIRING PROPERTY LOCATED AT 300 SOUTHWEST NORTH RIVER DRIVE IN THE CITY, IN CONNECTION WITH THE NORTHWEST NORTH RIVER DRIVE PROJECT, REVENUE IN THE LIKE AMOUNT BEING AVAILABLE FROM PROPERTY AND LEASE MANAGEMENT'S RETAINED EARNINGS; CONTAINING A REPEALER PROVISION AND A SEVERABILITY CLAUSE. WHEREAS, the City Commission adopted Ordinance No. 10321 on September 22, 1987, establishing revenues and appropriations for the City of Miami, Florida, for fiscal year ending September 30, 1988; and WHEREAS, the Property & Lease Management Division of the General Services Administration Department performs the function of acquiring property for development projects which the City is presently implementing; and WHEREAS, the acquisition of the herein property will assist the City in implementing the marine -oriented development of publicly owned properties along the Miami River from Southwest 2nd Avenue to Northwest Sth Street; NOW. THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. Sections 1 and 6 of Ordinance No. 10321, adopted on September 22, 1987, as amended, the Annual Appropriations Ordinance for fiscal year ending September 30, 1988 are hereby further amended in the following particulars: 1/ Words and/or figures stricken through shall be deleted. Underscored words and/or figures shall be added. The remaining provisions are now in effect and remain unchanged. Asterisks indicate omitted and unchanged material. All figures are rounded to the nearest dollar. The herein Enterprise Fund is hereby increased for the purpose of providing additional funds from retained earnings in the amount of $34,000 for the Property & Lease Management Fund Manager, for the purpose of acquiring property located at 300 Southwest North River Drive in the City in connection with the Northwest North River Drive Project. Section 3. All ordinances or parts of ordinances insofar as they are inconsistent or in conflict with the provisions of this Ordinance are hereby repealed. Section 4. If any section, part of section, paragraph, clause, phrase, or word of this ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. Odio City Manager ENCLOSURES: RECOMMENDATION It is respectfully recommended that the City Commission adopt the attached ordinance amending the annual appropriations ordinance for the fiscal year ending September 30, 1988, increasing the appropriations in the Property and Lease Management Enterprise Fund, in the amount of $34,000, for the purpose of acquiring a parcel of real property located at 300 Southwest North River Drive (the Kreid t property). BACKGROUND The General Services Administration Department has been working with several departments in connection with the NW North River Drive Project. The City of Miami owns an approximately .75 acre triangular shaped parcel of land located between SW North River Drive and the Miami River, with public access to and from the site on SW 2nd Street and SW North River Drive. It contains approximately 300 linear feet of River frontage. Tnis City -owned triangular site was purchased in 1975. Via Resolution 85--1236, the City Commission adopted in principle the NW North River Drive Design Concept that, among other things, sets forth a general development and implementation program for — the marine -oriented enhancement of publicly owned properties along the Miami River from SW 2nd Avenue to NW Sth Street. Tnis City -owned land parcel is adjacent to and immediately nortn _ of a 1,000+ square foot, parcel with frontage on the Miami River, and having no access to and from a public rignt-of-way except through the City -owned parcel. r Honorable Mayor and Members of the City Commission Proposed Appropriations Ordinance Amendment Page 2 This land -locked, 10,000+ square foot parcel is owned by Wallace Kreid t and its acquisition is essential for the development of the City -owned site which is planned for marine -oriented recreational and retail uses, including food and beverage sales. The General Services Administration Department recently had the Kreidt property appraised and these appraisals established Fair Market Value between $20#000 and $31,400, respectively. The General Services Administration Department is by this ordinance appropriating funding of $34,000, which allows purchase of this parcel at the highest appraised value and will allow for a possible bonus, as stated in the Resolution. The passage of this Ordinance will give the General Services Administration Department funding for this acquisition. Attachment: Proposed Resolution
