Home My WebLink AboutO-10372AN EMERGENCY ORDINANCE AMENDING SECTION 1 OF ORDINANCE NO, 10347, ADOPTED OCTOBER 221 19871 THE CAPITAL APPROPRIATIONS ORDINANCE; BY ESTABLISHING THE PROJECT ENTITLED "PIER 3 - MAJOR REPAIR", PROJECT NO, 413010, IN THE AMOUNT OF $50,000 FROM THE FY'88 GENERAL FUND, SPECIAL PROGRAMS AND ACCOUNTS CONTINGENT FUND, CONTAINING A REPEALER PROVISION AND A SEVERABILITY CLAUSE. WHEREAS, the City Commission adopted Ordinance No. 10347 on October 22, 1987, establishing appropriations for the implementation of Capital Improvements in the City of Miami; and WHEREAS, in accordance with Section 2.136 of the Miami City Code (1980), the Planning Department has prepared and submitted to the City Commission a CapitalImprovement Program (CIP) that identifies the sources of funding of all proposed capital projects valued at $5,000 or more for the program years 1987-1993; and WHEREAS, this Program was adopted by the City Commission by Resolution No. 87-935 on October 22, 1987; and WHEREAS, concrete platform dolphins were constructed at Slip 3, in Bicentennial Park, in 1986, for docking of large ships; and WHEREAS, during the operation of the facility, serious damage was sustained by the concrete structure, which created unsafe and dangerous conditions requiring an emergency repair; and WHEREAS, total projected cost for this repair is $50,000, and monies are available in the FY188 General Fund, Special Programs and Accounts, Contingent Fund to cover said expenses; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The herein, appropriations which are hereby designated by reference to descriptive project title and number also include appropriations for previously approved scheduled projects as well as re -appropriations of prior fund appropriations. The source of revenues to support the herein appropriations is hereby identified by fund and project with the project appropriations and' revenues therefor being set forth for seven program areas (I-VII) based upon use or functional category within said areas, as follows: Total Appropriations ( $ X 000) V. If any section, part of section, paragraph, clause phrase - or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. Section 4. This ordinance is hereby declared to be an emergency measure on the grounds of urgent public need for the preservation of peace,, health, safety, and property of the City of Miami and upon the further grounds of the necessity to make the required and necessary payments to generally carry out the functions and duties of municipal affairs. BACKGROUND: The Department of Public Works has analyzed the situation, and determined that there exists an emergency need for repairs to the mooring dolphins on Slip 3 at Bicentennial Park. The attached has been prepared. to, appropri ate the necessary funds from Special Programs and Accounts, Contingent Fund, and create a Capital Improvement Project entitl ed "Pi er 3 - Major Repai rs". Construction of the mooring dolphins took place in 1986. Shortly after completion of the work, the piers were damaged in accidents involving two large navy ships. Subsequently, during the Grand Prix, additional damage was inflicted by a Sea'Escape vessel. The mooring dolphins are, at present, unsafe to handle large ships; this was the thrust behind the ori gJ na'l work. Emergency repairs should take place immediately.
