MIAMI, FLORIDA:
SECTION 1. This Ordinance is enacted pursuant to
the Charter of The City of Miami, Florida, Chapter 166,
Florida Statutes, the Constitution of the State of Florida
and other applicable provisions of the law.
SECTION 2. Notice of the bond election heretofor
called by Ordinance No.10365 to be held -on Tuesday, March 8,
1988, shall be published in two newspapers of general circu-
lation published on a daily basis in The city of iiiami,
Florida at least twice, once in the fifth week and once in
the third week prior to the week in which that election is
to be held, the date of the first publication in each of
said newspapers to be at least thirty days before said elec-
tion, which notice shall be substantially=in the following
form:

Commission of The City of Miami, Florida, on January 14,
1988, an election will be held on Tuesday,

For the purpose of submitting to the qualified
electors of The City of M ar^:i, Florida, the following
question:

The palls at said election will be open from
7:00 a.m. until 7.00 p.m. the same day.
The; City of Miami, Florida shall be author,L-"ed to
issue said bonds if "lie question for the issuance of said
bonds shall be approved by a majority of the votes cast by
the qualified electors of The City of Miami, Florida, voting
on such question.
Such bond election shall be held at the polling
places in The City of Miami, in the several election pre-
cincts designated by the Board of County Commissioners of
Dade County, Florida as set forth below, which are the same
polling places as for other elections of The City of Miami,
Florida.

SECTION 4. Since The City of Miami, Florida, has
established the permanent recji.stration system under state
law, and the general election laws of tine State of Florida
require fourteen (1 4) days prior approval by the Board of
County Commissioners of Dade Cotinty, Florida, for acceptance
of branch office registration and that the registration
books be closed thirty (30) days prior to the date of such
bond election, registration for such bond election shall be
at the office of the Supervisor of Elections of Dade County,
Florida, 1.11 N.W. lst Street, Miami, Florida.
SECTION 5. Said bond election shall be held at the
polling places in the several precincts, respectively, in.
The City of Miami, Florida as set forth in the foregoing
Notice of Bond Election. Not less than twenty (20) days
before said election the City Commission shall designate the
Inspectors of Election and Clerk of Election for each, pre-
cinct and, at least fifteen (15) clays before the election,
shall publish the names of such Inspectors of Election and
Clerk of Election in a net-rspaper of general circulation pub-
lished in The City of Miami', Florida.
SECTION G. All qualified electors of The City of
Miami, Florida, shall be permitted to vote in said election,
and the Supervisor of Elections of Dade County, Florida is
hereby requested, authorized and directed to furnish, at the
cost and expense of The City of Miami, Florida, a list of
all qualified electors residing in The City of Miami,
Florida, as shown by the registration books and records of
the office of said Supervisor of Elections, and to duly cer-
tify the same for delivery to and use of the election of of-
ficials designated to serve at the respective polling places
in said election precincts.
SECTION 7. Matty Hirai, the City Clerk to The City
of Miami, Florida, is hereby designated and appointed as the
official representative of the City Commission of The City
of Miami, Florida, in all transactions with the Supervisor
of Elections of Dade County, Florida, in relation to matters
pertaining to the use of the registration books and the
holding of said election.
SECTION '8. The official ballot to be used at said
election shall be in full compliance with the laws of the
State of Florida with respect to absentee ballots and the
use of Computer Election System (CES), and shall be in sub-
stantially the following farm.

SECTION 9. Electors desiring to vote for the ap-
proval of said question described above shall be instructed
to punch straight down with the stylus through the hole next
to the phrase "FOR THE MEASURE (For Bonds)" within the bal-
lot frame containing the statement relating to said
question, and electors desiring to vote against said
question shall be instructed to push straight down with the
stylus through the hole next to the phrase "AGrINST THE
MEASURE (Against Bonds)" within the 'ballot frame containing
the statement relating to said question.
SECTION 10. The City Clerk shall cause to be pre-
pared absentee ballots containing the question set forth in
Section 8 above for the use of absent electors entitled to
cast such ballots in said election.
SECTION 1.1. This Ordinance is hereby declared to
be an emergency measure on the grounds of urgent public need
for the preservation of peace, health, safety and the
property of The City of Miami, Florida. An emergency exists
with respect to the adoption of this Ordinance in that, in
order to place the question of 1h.e issuance of the bonds and
the levy of the taxes described above on the ballot for
March 8, 1988, at which time an election for other purposes
will be held, and therefore to preserve funds and reduce
costs of The City of Miami, Florida, it is necessary that.
this Ordinance be adopted immediately.
The City Commission of The City of Miami, Florida,
by adoption of this Ordinance by at least a four -fifths
vote, hereby waives all notice requirements, including, .but
pot limited to, the reading of this Ordinance on two
separate days, for the regular enactment of municipal
ordinances,

Recommendation: It is respectfully recommended that the
attached Emergency ordinance providing for the holding of a
Bond Election in the City of Miami on March 8, 1988, for the
inssuance of $40$000,000 Street and Highway Improvement Bonds
be approved.
Background, The existing Street and Highway Improvement Bond
authorization remaining totals $3,900,000. This additional
$40,000,000 authorization shall fund five to six years of
street and highway capital improvements.

I am enclosing herewith proposed drafts of two
Emergency Ordinances in connection with the above -referenced
matter. I would appreciate it if each of you would review
these as soon as possible so that I can make any necessary
changes before delivering "hand" copies of'these Ordinances
to Annette this afternoon. I would especially appreciate it
if you would look closely at the form of the ballot set
forth in the second Ordinance to be certain that it is
acceptable: There appear to be some conflicts between the
City's Charter and general law (Chapter 100, Florida
Statutes), and I have tried to accomodate both provisions
with the ballot format.
If you have any questions or comments, please call
me as soon as possible.
