A RESOLUTION GRANTING A VARIANCE FROM
ORDINANCE 9500, AS AMENDED, ARTICLE 20,
SECTION 2023, SUBSECTION 2023.4. THE ZONING
ORDINANCE OF THE CITY OF MIAMI, AND THE
SCHEDULE OF DISTRICT REGULATIONS, PAGE 3 OF
6, RO-2.1 RESIDENTIAL OFFICE, MAXIMUM HEIGHT
AND TABLE 3 STANDARD RATIOS BY LAND USE
INTENSITY SECTORS, PARKING RATIO, TO PERMIT
CONSTRUCTION OF AN OFFICE BUILDING TO BE
LOCATED AT APPROXIMATELY 3250 SOUTH DIXIE
HIGHWAY AND APPROXIMATELY 3271-91 WEST TRADE
AVENUE, MIAMI FLORIDA, (MORE PARTICULARLY
DESCRIBED HEREIN), AS PER REVISED PLANS ON
FILE DATED JANUARY 27, 1988, WITH A MAXIMUM
BUILDING HEIGHT OF APPROXIMATELY 41.5 FEET
(40 FEET MAXIMUM ALLOWED), AND PROVIDING 21
OF 24 REQUIRED OFF-STREET PARKING SPACES;
ZONED RO-2.1/4 (RESIDENTIAL OFFICE).
WHEREAS, the Miami Zoning Board at its meeting of
March 2, 1987, Item No. 1, following an advertised hearing,
adopted Resolution No. ZB 28-87, by an eight to one (8-1) vote
DENYING the variance as hereinafter set forth; and
WHEREAS, the applicants have taken an appeal to the City
Commission from denial of the variance; and
WHEREAS, the City Commission after careful consideration of
this matter and notwithstanding the denial by the Zoning Board,
finds that there are peculiar circumstances affecting this parcel
and that practical difficulties and unnecessary hardships exist
which would impair the owner's right to some reasonable use of
the property without the grant of the variance as hereinafter set
forth;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. That the decision of the Miami Zoning Board
in this matter is reversed and the request for a variance from
Ordinance No. 9500, as amended, Article 200 Section 2023,
Subsection 202 3.4, the Zoning Ordinance of the City of Miami, and
the Schedule of District Regulations, Page 3 of 6, RO- 2.1
Residential Office, Maximum Height and Table 3 Standard Ratios by
Land Use Intensity Sectors, Parking Ratio, to permit construction

of an office building to be located at approximately 3250 South
Dixie Highway and approximately 3271-91 West Trade Avenue, Miami,
Florida, also described as Lots 25, 26 and 27, PEACOCK
SUBDIVISION, Plat Book 1 at Page 195 of the Public Records of
Dade County, Florida, as per revised plans on file dated
January 27, 1988, with a maximum building height of approximately
41.5 feet (40 feet maximum allowed), and providing 21 of 24
required off-street parking spaces; zoned RO-2.1/4 (Residential -
Office), is hereby granted.

Sectors, Parking Ratio to permit construction of
an office building on above site, as per plans
on file, with 52.32' proposed maximum height
(40' permitted), providing 0 of 1 required off-
street loading space, and providing 21 of 29
required off-street parking spaces.
RECOMMENDATIONS
PLANNING DEPARTMENT DENIAL. There is no hardship to justify the
requested variances. There is too much building
proposed for the size of the subject property
which does not constitute hardship, especially
since this is new ccrstruction and a reasonable
use of the land could be achieved with a lesser
structure. There is no justification for
eliminating the required loading space, as this
could cause a potential for use of adjacent
streets or blocking of parking aisles by trucks.
The subject area requires the balanced
maintenance of the required parking for the
protection of the adjacent residential area. A
waiver of the eight (8) parking spaces should
not be allowed because cars would probably park
in front of adjacent residential lots and would
create a negative impact on the neighborhood.
PUBLIC WORKS Denial. The Department is concerned with the
request for a variance to eliminate 8 of 29
required off-street parking spaces and the
required off-street loading space. The ;arking
and loading space shortage will result in
vehicles from this project parking in frcnt cf
other properties on west Trade Avenue.
Require the dedication of the north 5' and the
south 10' of Lots 25, 26 and 27 and a 7' radius
return at the intersection of S Dixie Highway
and west Trade Avenue

ZONING BOARD At its meeting of September 22, 1986, the Zoning
Board adopted Resolution ZB 98-86, by a 9 to 0
vote continuing the above to their meeting of
October 6, 1986.
At its meeting of Octooer 6, 1986, the Zoning
Board adopted Resolution Z3 104-86, by an 8
to 0 vote, deferring the aoove for applicant to
meet with Planning Department to review plans.
At its meeting of Decenoer 15, 1986, the Zoning
Board adopted Resolution ZB 135-86, by a 9 to 0
vote, continuing this item at the request of the
applicant to its meeting of January 12, im.

APPEAL
CITY COMMISSION
At its meeting of January 12, 1987, this item was
removed from the Zoning Board agenda for correc-
tion to plans.
At its meeting of March 2, 1987, the Zoning Board
adopted Resolution ZB 28-87, by an 8 to 1 vote,
denying the above request.
Three replies in favcr and one objection were
received by mail. Tw: proponents were present at
tnis meeting.
Letter of appeal from applicant, dated March 10,
1967, was received.
At its meeting of April 30, 1987, the City
Commission continued the above to its meeting of
May 28, 1987.
At its meeting of May 28, 1987, the City Commission
continued the above to its meeting of June 25, 1987,
subject to the applicant proving to Public Works
and Planning staff that he cannot build an
additional floor of parking.
At its meeting of June 25, 1987, the City
Coimmission continued the above to its meeting of
July 23, 1987.
At its meeting.of July 23, 1987, the City
Commission continued the above for the
applicant to resolve the parking issue.

A variance is relaxation of the terms of the ordinance where such action will not be
contrary to the public interest and where, owing to conditions peculiar to the
property and not the result of actions of the applicant, literal enforcement of this
ordinance would result In unnecessary, and undue hardship on the property. As used in
this ordinance, a variance is authorised only for height, area, size of structure,
dimensions of yards grid other open spaces and offstreet varWng or loading

Zoning Ordinance:

The land is an acute pie shape with street on cv•o sides
of the triangle, due to restrictions of the setbacks is
imoosible to accomodate the F A R allowed for commercial
development in a height of 40', consecuently t,e are asking
variance to go to 52.32' high.
Due to restrictions and considerations mentioned above, olus
the fact that the owners have to give aT.,ay to the city one
third of their land, again is impossible to accomodate the
required parking, again ve are asking variance in this respect.
(b) The special conditions and circumstances do not result from the actions of
the petitioner in that:
The original plat of the land -as done in a very unefficient
vay, plus the circumstance that the city requires one third
of the land for extra right of •ays,out the owners on extreme
hardship to use the land to its present potential, as other
neighbor lands have.

The configuration of the land and the dedication requested
by the City of one third of the land, outs the owner on hard-
ship to develop the land :
1) It is impossible to accomodate the F.A.R. allot•,ed in 4
stories
2) It is impossible to layout the required off-street Par-
king requirements, even if more Harking decks -ere to be
provided
(d) Granting the variance requested will not confer on the petitioner any special
privilege that is denied by the Zoning Ordinance to other lands, buildings, or
structures in the same zoning district in that:
The entire area of U.S. ] bet-een 27th. Ave. and 37th.Ave.
is snrounded by buildings 5 to 7 stories high so if the
height variance is granted, the building will be inkeeving
t•ith the neighborhood.
The fact that the required parkink can not be met, and the
variance is granted: the owers are willing to estioulate
ii the lease agreement, that one third of the tenants occu-
pants have to use the Metro Rail System for transvortation,
since the site is strategicly located bet-een t,•o stations:
Douglas and Coconut Grove.
(a) The variance, if granted, is the minimum variance that will make possible the
reasonable use of the land, building, or structure in that:
The building will be closer to its present votentiall allo•ed
by the overall Zoning District.
