A RESOLUTION RESCINDING RESOLUTION
NO. 87-3 ADOPTED ON JANUARY 8, 1987
WHICH ORDERED DOWNTOWN HIGHWAY
IMPROVEMENT - PHASE 1I H-4521,
REORDERING DOWNTOWN HIGHWAY
IMPROVEMENT - PHASE II H-4521, AND
DESIGNATING THE PROPERTY AGAINST
WHICH SPECIAL ASSESSMENTS SHALL BE
MADE FOR A PORTION OF THE COST
THEREOF AS DOWNTOWN HIGHWAY
IMPROVEMENT DISTRICT - PHASE II H-
4521.
WHEREAS, at the City Commission Meeting of January 8, 1987,
Resolution No. 87-3 was passed which ordered a highway
improvement identified as DOWNTOWN HIGHWAY IMPROVEMENT - PHASE II
in DOWNTOWN HIGHWAY IMPROVEMENT DISTRICT - PHASE II H-4521; and
WHEREAS, said highway improvement district was to be
located in the area bordered by North 1 Street, South 1 Street,
West 2 Avenue and Biscayne Boulevard to allow the City to improve
North 1 Street and South 1 Street within said district; and
WHEREAS, the City has entered into an agreement with the
Florida East Coast Railway Company and its subsidiary Gran
Central Corporation whereby the City has agreed to expeditiously
rebuild the portion of N.W. 1 Avenue between N.W. 1 Street and
N.W. 5 Street at no cost to Florida East Coast Railway Company or
Gran Central Corporation; and
WHEREAS, this agreement, along with the ongoing
redevelopment of Southeast Overtown/Park West and the
construction of the Miami Arena, justify a higher priority for
rebuilding N.W. 1 Avenue between N.W. 1 Street and N.W. 5 Street
than for rebuilding South 1 Street between Biscayne Boulevard and
West 2 Avenue;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE
CITY OF MIAMI, FLORIDA:
Section 1. Resolution No. 87-3 passed and adopted on
January 8, 1987 is hereby rescinded. CITY COMMISSION

Section 2. A local improvement described as DOWNTOWN
HIGHWAY IMPROVEMENT - PHASE II H-4521, shall be made under
Section 56 of the Charter of the City of Miami, as amended,
located at North 1 Street between Biscayne Boulevard and N.W. 1
Avenue and at N.W. 1 Avenue between N.W. 1 Street and N.W. 5
Street.
Section 3. This improvement shall include clearing and
grading, construction of asphaltic pavement, concrete curbs
and/or gutters, sidewalks, storm drainage facilities, and
landscaping,if feasible.
Section 4. This improvement shall be designated in all
proceedings and assessments as DOWNTOWN HIGHWAY IMPROVEMENT -
PHASE II H-4521 and the property against which special
assessments shall be made for a portion of the cost thereof,
'- hereunder shall be designated as DOWNTOWN HIGHWAY IMPROVEMENT
DISTRICT - PHASE II H-4521 with the following property
descriptions by lot and block number constituting all of the
pieces of property affected by the said improvements:

RECOMMENDATION:
It is respectfully recommended that the City Commission adopt the
attached resolution rescinding the ordering resolution adopted
January 8, 1987 and re -ordering Downtown Highway Improvement -
Phase II H-4521, and authorizing the City Clerk to advertise for
sealed bids for the construction of said improvement.
BACKGROUND:
The Department of Public Works, after studying the downtown area
and considering the wishes of the property owners, and in a
continuing effort to serve all residents of the City of Miami, is
proposing an assessable improvement under Section 56 of the
Charter of the City of Miami described as Downtown Highway
Improvement - Phase II. This improvement district is located at
N.W. 1 Street between Biscayne Boulevard and M.19. 1 Avenue, and
at N.W. 1 Avenue between N.W. 1 Street and N.W. 5 Street.
On January 8, 1987 the City Commission passed resolution no. 87-3
which ordered Downtown Highway Improvement - Phase II. At that
time it was the C i ty's intention to rebuild North 1 Street and
South 1 Street within the central business district. Subsequent
to the adoption of said resolution, several events have occurred
that make it desirable to improve N.W. 1 Avenue from N.W. 1
Street to N.W. 5 Street instead of improving South 1 Street in
Downtown Highway Improvement - Phase II.
The City has entered into an agreement with the Florida East
Coast Railway Company and its subsidiary Gran Central Corporation
whereby the City has agreed to expeditiously rebuild N.W. 1
Avenue between N.W. 1 Street and N.W. 5 Street at no cost to the
F.E.C. Railway or Gran Central. All other owners of property
within the proposed highway improvement district will be assessed
for a portion of the cost of the improvements.

The Southeast Overtown/Park West Redevelopment Project and the
Miami Arena construction are already underway. The C i ty has
already awarded a -contract for reconstruction of N.W. 1 Avenue
between N.W. 5 Street and N.W. 10 Street to serve and enhance
these two major projects. This portion of N.W. 1 Avenue, already
under construction, is being realigned and widened to provide
four lanes of vehicular traffic. It is now desirable to realign
and widen the portion. of 1 Avenue from N.W. 1 Street to N.W. 5
Street.
The agreement with F.E.C. Rallway, the ongoing redevelopment of
Southeast Overtown/Park West, and the construction of the Miami
Arena all justify placing a higher priority on rebuilding N.W. 1
Avenue between N.W. 1 Street and N.W. 5 Street than on rebuilding
South i Street between Biscayne Boulevard and West 2 Avenue.
