R146'*241 A RESOLUTION, BY A 4/5THS AFFIRMATIVE VOTE OF THE MEMBERS OF THE CITY COMMISSION AFTER A DULY ADVERTISED PUBLIC HEARING, RATIFYING THE CITY MANAGER'S FINDING OF SOLE SOURCE; WAIVING THE REQUIREMENT FOR COMPETITIVE SEALED BIDS AND APPROVING; ACQUISITION FROM SOFTWARE, CLEARING HOUSE INC. FOR A LICENSE TO XGEN AND WITH A COGEN TO XGEN FILTER FOR USE IN SYSTEMS DEVELOPMENT IN THE PROPOSED AMOUNT OF $27,240.00 AND APPROVING; A CONTRACT FOR THE MAINTENANCE FOR TWO YEARS WITH THE OPTION TO RENEW FOR TWO ADDITIONAL ONE-YEAR PERIODS AT THE PROPOSED FIRST YEAR COST OF $7►440.00, SUBJECT TO THE AVAILABILITY OF FUNDS FOR SUCCEEDING FISCAL YEARS FOR THE DEPARTMENT OF COMPUTERS AT A PROPOSED FIRST YEAR TOTAL COST OF $34,680.00; ALLOCATING FUNDS THEREFOR FROM THE 1987-88 OPERATING BUDGET ACCOUNT CODE NO. 460601-670; AUTHORIZING THE CITY MANAGER TO INSTRUCT THE CHIEF PROCUREMENT OFFICER TO ISSUE A PURCHASE ORDER FOR THIS SERVICE. WHEREAS, the Department of Computers has been using COGEN a 4GL (Fourth Generation Language) for program development since 1983. Planned upgrades of syst,:!m software will make GOGEN unusable for future development or enhancements to existing systems; and WHEREAS, Software Clearing House Inc. is the only vendor that licenses these products of Jacksonville Software; and WHEREAS, funds for this service are available in the Department of Computers 1987-88 Operating Budget Account No. 4606U1-670; and WHEREAS, the Chief Procurement officer has adopted a finding wherein that Software Clearing House Inc. is the sole source to provide this service; and WHEREAS, the findings of the Chief Procurement Officer have been approved and adopted as the finding of the City Manager; and WHEREAS, the City Manager and the Director of the Department of Computers recommend that the requirement for competitive formal sealed bids be waived and the procurement from Software Clearing House Inc. as the sole source, be approved; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Amended CITY COMMISSION MEETING OF MAR 10 1988 R[ SOLU110N No 88-241 WWARKa 1 '1 Section 1. By an affirmative v-)te of 4/5ths of the Members of the City Commission, after a duly advertised public hearing, the City Manager's written finding that Software Clearing House Inc. is the Sole Source of supply to the City for the acquisition of a license to XGEN, Maintenance and with a GOGF.N to XGEN filter for use in systems development for the Computers Department is hereby ratified. Section 2. The requirement for competitive sealed bids is hereby waived and the Department of Computerse acquisition of a license to XGEN and with a GOGEN to XGEN filter for use in systems development in the proposed amount of $27,240.00 and approving a contract for two years with the option to renew for two additional years at a proposed first year cost of $7,440.00 subject to the availability :)f funds for succeeding fiscal years at a total proposed amount of $34,680.00 is hereby approved with funds therefor hereby allocated from the Computer Department 1987-88 Operating Budge Account No. 460601-670. Section 3. The City Manager is hereby authorized to instruct the Chief Procurement Officer to issue a purchase order for this service, subject to availability of funds. FOR SYSTEMS Cesar Odio �i� DEVELOPMENT SOFTWARE AND City Manager MAINTENANCE FOR THE Em"OsURES DEPARTMENT OF COMPUTERS RECOMMENDATION: It is respectfully recommended that the City Commission adopt the attached resolution awarding the contract to Software Clearing House Inc. for a license to XGEN, with maintenance, and with a COGEN to XGEN filter for use in systems development by the Department of Computers (DOC). Software Clearing House Inc. is the only vendor that licenses these products and services is estimated to be $34,680 for FY 87/88 in which funds are available in the budget of the Department of Computers. BACKGROUND: The Department of Computers has been using COGEN, a 4GL (Fourth Generation Language), for program development since 1983. Planned upgrades of system software will make COGEN- unusable for future development or enhancements to existing systems. Jacksonville Software also has a product that will aid in converting existing COGEN systems to the upgraded XGEN which will allow them to be modified as the need arises. Jacksonville Software's products and maintenance services are licensed through Software Clearing House Inc. The cost to license XGEN is as follows: $49,600 License Fee for XGEN -27,360 60% credit of COGEN License Fee 22,2TU + 7,440 Maintenance Fee 29,680 + 5,000 COGEN to XGEN Filter M-70 Since there is no other vendor that can provide these products and services, it is recommended that Software Clearing House Inc. be awarded this contract. 88-241 1 Resolution Authorising Award of Contract to software Clearing House Inc. Attachment: Proposed Resolution Assessable Projects N/A 2 8"41 CITY OF MIAMI FLORIDA NOTICE TO THE PUBLIC A public hearing will be held by the City Commission of the City of Miami, Florida,. on March 10, 1988 in the City Commission Chambers at City Hall, 3500 Pan American Drive, Miami, Florida, for the purpose of considering a waiver of the requirements of obtaining sealed bids for the acquisition of XGEN software. Software Clearing House, Inc. is the only vendor whose services include all the features required by the City's users. Inquiries from other potential sources of supplies who feel that they might be able to satisfy the City's requirements in the acquisition may contact Robert Parcher at (305)579-6260. All interested parties are invited to appear and may be heard concerning such proposed waiver and purchase. The hearing will be held at the time and place specified above. Should any person desire to appeal any decision of the City Commission with respect to any matter considered at this hearing, that person shall ensure that a verbatim record of the proceeding is made, including all testimony and evidence upon which any appeal may be based.
