A RESOLUTION RATIFYING THE ACTIONS OF THE
CITY MANAGER, WHICH (1) UTILIZED A SHORTENED
TIME PERIOD FOR SEALED BIDS, (2) ACCEPTED THE
LOWEST RESPONSIBLE AND RESPONSIVE BID FROM
MARKS BROTHERS, COMPANY, IN THE AMOUNT OF
$11,000, FOR THE REPAIR TO THE STORM SEWER
BOX CULVERT IN CONNECTION WITH "STORM SEWER
REPAIR EAST FLAGLER STREET", WITH MONIES
THEREFOR ALLOCATED FROM LOCAL DRAINAGE
PROJECTS - FY '88 ACCOUNT, PROJECT NO. 352251
TO COVER THE CONTRACT COST, (3) ENTERED INTO
A CONTRACT WITH SAID LOW BIDDER FOR THE
CONSTRUCTION OF THE PROJECT; ADOPTING THE
CITY MANAGER'S WRITTEN FINDINGS THAT A VALID
EMERGENCY EXISTED; WAIVING THE REQUIREMENTS
FOR FORMAL SEALED BIDS.
WHEREAS, the storm sewer box culvert located in EAST
FLAGLER STREET was in need of emergency repairs because of the
correction of an unsafe condition due to adjacent work to a
sanitary sewer lateral; and
WHEREAS, this created a situation that was unsafe and
dangerous for the public, and said repairs had to be made
immediately; and
WHEREAS, the Director of the Department of Public Works has
determined that the fastest and most effective way to remedy
the situation was to let a contract for the repair of the storm
sewer box culvert; and
WHEREAS, the Capital Improvements Appropriation Ordinance
No. 10347, as amended, was adopted on October 22, 1987, and
monies were available for the proposed amount of the contract,
project expense, and incidentals from the account entitled
"Local Drainage Projects - FY 18811, Project N352251 in said
ordinance; and

WHEREAS, the City Manager made a written finding that the
use of the competitive sealed bidding method for the award of
the herein procurement contract was not practicable or
advantageous, due to the fact that the fifteen (15) day bidding
time required by the City Code imposed a serious constraint on
the correction of the situation on East Flagler Street; and
WHEREAS, emergency bids were solicited from eight (8) local
contractors, and a low bid was received on February 22, 1988,
from Marks Brothers, Company, the lowest responsive and
responsible bidder, in the amount of $11,000; and
WHEREAS, the City Manager has awarded a contract to said
firm in order to avert any danger to the public caused by the
above situation; and
WHEREAS, the City Commission, after a properly advertised
public hearing, accepts the findings of the City Manager and
ratifies his actions in connection with this project; and
WHEREAS, the City Commission hereby waives the requirements
for formal sealed bids in connection with this emergency repair;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE
CITY OF MIAMI, FLORIDA:
Section 1. The findings set forth in the preamble to
this Resolution are hereby adopted as if fully set forth in
this Section.
Section 2. The actions of the City Manager, which
utilized a shortened time period for sealed bids for the
"STORM SEWER REPAIR EAST FLAGLER STREET", accepted the low bid
of Marks Brothers, Company, the lowest responsive and
responsible bidder, and entered into a contract with said low
bidder, are hereby ratified by a four -fifths vote of the
members of the City Commission, and the formal requirements
for competitive sealed bids are hereby waived.
Section 3. The amount of $20,000 is hereby allocated
from the account entitled Local Drainage Projects - FY 18811,
Project No. 352251 to cover the cost of said contract.

RECOMMENDATION
It Is respectfully recommended that the City Commission adopt the
attached resolution which ratifies the emergency actions of the
City Manager which waived the requirement for formal sealed bids
in connection with the "Storm Sewer Repair East Flagler Street"
project, awarded a contract to and entered Into contract with
Marks Brothers, Company, the lowest responsive and responsible
bidder for the bids received, in the amount of $11,000.
BACKGROUND
The Department of Public Works has determined that there exists
an emergency need to carry out repairs to the storm sewer box
culvert on East Flagler Street. Investigations showed that
sewage was spilling into the City's storm sewers at this Flagler
Street location because of the way the system had been originally
constructed years ago. After completion of the repair to and
Isolation of the sanitary sewer lateral by the Miami Dade Water &
Sewer Authority Department, the box culvert was left with a
portion of the top slab removed creating an unsafe and dangerous
situation.
In order to avoid any delays in the start of construction, a
reduction in bidding time was required. In addition, awarding of
contracts at the regular Commission meeting of March 10, 1988,
would place further time constraints on the repairs.

The attached resolution ratifies the actions of the City
Manager, which waived the time requlrements for formal sealed
bids, awarded a contract to and entered into a contract with
Marks Brother, Company, the lowest responsible and responsive
bidder, In the amount Of $11,000. Eight (8) invitations were
delivered to local contractors, and three (3) bids were
submitted In connection with the project (1 Hispanic, 1 Black).
The Capital Improvements Ordinance 10347, adopted October 22,
1987, has been amended. Monies are available for the estimated
amount of the contract from the account entitled "Local Oralnage
Projects - FY '88"•. Project No. 352251.
