PE PROVIDED FPOM FONDS ALLOCATED Tn THE PROJECT; FURTHEP RATIFYING THE CITY MANAGEP'S WPITTFIJ FINDINGS THAT THE HEREIN INCREASE RESULTED FROM EMERGENCY CIRC!!MSTANCES BY AN AFFIRMATIVE VOTE OF FOUR/FIFTHS OF THE MEMBERS OF THE CITY COMMISSION, A V D ADOPTING THE FINDINGS AND CONCLUSIONS SET FORTH IN TIFF PREP,MriLE OF THIS RESOLUTION. WHEREAS, there exists a contract. dated April 23, 19R7 between the City of Miami, Florida and Madsen/Barr Corporation for the construction of Citywide Sanitary Replacement Project - N.W. 8 St.Rd. CIP No. 351275; and WHEREAS, an increase in contract of $3n,nnO is required to cover the cost of a full width asphaltic concrete surface overlay on N.W. 7 Avenue (SR 9) as required by the Florida State Department of Transportation; and WHEREAS, the City Manager has made a written finding that a valid emergency exists for the increase; and WHEREAS, the Director of the Department of Public Works recommends the increase in contract to cover the additional costs; and WI(EREAS, funds to cover the increase are available from money already allocated to the project; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. After a properly advertised public hearing, the finding of the City Manager set forth in the preamble to this resolution is hereby ratified by an affirmative vote of four/fifths of the City Commission, and adopted as if fully set forth in this section) together with all other findings and conclusions in the Preamble. »hiING Qr APR 14 104 K& 88-340 Section 2. Increase in Contract FROM Cesar H. n d i REFERENCES City Manager ENCLOSURES RECOMMENDATION: It is respectfully recommended that the City Commission adopt the attached resolution authorizing an increase in contract amount of E30,000 in the contract between the City of Miami, Florida and Madsen/Barr Corporation for Citywide Sanitary Replacement Project - N.W. 9 St.Rd. C.I.P. Project No. 351275; said funds to be provided from funds already allocated to the project; further ratifying the City Manager's written finding that the herein increase resulted from emergency circumstances by an affirmative vote of 4/5 of t-he members of the City Commission and adopting the findings and conclusions set forth in the preamble of this resolution. BACKGROUND: The Department of Public Works has analyzed the situation and has determined that there is a need to adopt legislation which will increase the contract amount of this project by $30,000. This project consists of the replacement of an old existing sanitary sewer on N.W. 7 Avenue (State Road 9) and on N.W. 8 St. Rd. in conjunction with the N.W. A St.Rd. Highway Improvement. All work connected with this project is reimbursable from the Metropolitan Dade Co. Water I. Sewer Authority. After the contract was awarded the D.O.T. increased the scope of work required on N.W. 7 Avenue to include a full width overlay within the limits of the new sewer. As a result it is now necessary to increase the contract amount by $30,000 to pay for this additional work. Funds for the proposed increase are available from the General Obligation Bond Fund already allocated to the project. Attachments: Proposed Resolution A8-340 TO FILE IRON Cesar H. CIP Project No. 351275 REFERENCES Emergency Need for Increase in Contract ENCLOSURES Based on information supplied to me by the Director of the Public Works Department, I have found that there exists an emergency need for an increase in contract amount of $30,000 in the contract between the City of Miami, Florida and Madsen/Barr Corporation for the construction of Citywide Sanitary Replacement project - N.W. 8 ST.RD. The reason for the emergency need is as follows: * The construction of a full width asphaltic concrete surface overlay required by the Florida State Dept. of Transportation on M.W. 7 Avenue over the new sewer construction will more than deplete the cash allowance for the project. An increase in the contract amount is necessary to replenish the cash allowance without delay so that funds will be available to cover the extra work required by the State. DWC:AJL:mh Z. P98-340
