A RESOLUTION OFFICIALLY ACCEPTING THE
ATTACHED CITY CLERK'S CERTIFICATION AND
DECLARATION OF THE RESULTS OF THE SPECIAL
MUNICIPAL ELECTION HELD ON MARCH 8, 1988, IN
WHICH THE ISSUANCE OF NOT TO EXCEED
$40.000,000 STREET AND HIGHWAY IMPROVEMENT
BONDS OF THE CITY OF MIAMI, FLORIDA, AND THE
LEVYING OF A TAX TO PAY THE PRINCIPAL AND
INTEREST THEREON WAS DISAPPROVED BY THE
ELECTORATE.
BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI.
FLORIDA:
Section 1. The City Commission hereby officially accepts
the attached City Clerk's Certification and Declaration of the
results of the Special Municipal Election held on March 8, 1988,
in which the issuance of not to exceed $40,000,000 Street and
Highway Improvement Bonds of the City of Miami, Florida, and the
levying of a tax to pay the principal and interest thereon was
disapproved by the electorate.
Section 2. The City Commission hereby declares:
(a) with respect to said question of the
issuance of not to exceed $40,000,000 Street and Highway
Improvement Bonds of the City of Miami, Florida, and the levying
of a tax to pay the principal and interest thereon, said election
was duly called and properly held and notice thereof was duly
given in accordance with law and Ordinance No. 10366, adopted
January 14, 1988, entitled:
"AN EMERGENCY ORDINANCE OF THE CITY OF MIAMI,
FLORIDA, AUTHORIZING A BOND ELECTION TO BE
HELD ON MARCH 8, 1988. WITH RESPECT TO THE
ISSUANCE OF NOT TO EXCEED $40,000,000 STREET
AND HIGHWAY IMPROVEMENT BONDS OF THE CITY OF
MIAMI. FLORIDA, AND THE LEVYING OF A TAX TO
PAY THE PRINCIPAL AND INTEREST THEREON;

from various vendors for Heavy Equipment] This item as
distributed reflects a t.80 overage in the purchase
cost, vhich error has been corrected in the original
that is being transmitted to the City Clerk.
Agenda item •19 (J-88-307) (Resolution authorizing
execution of an agreement for the City's lease of
space] This item has been modified to reflect that the
City is the proposed lessor in the lease being
considered for approval.
NOTE: At the time the Consent Agenda is voted upon. if these
Items 08 and •19) are not removed from the Consent Agenda and
considered separately, there should be an announcement made by
the Mayor that Items •8 and #19 are being voted upon 'as
modified'.
Agenda item #72 (J-88-349) (Ordinance amending a
previous amendatory ordinance by appropriating and
transferring additional funds to Community Development
Block Grant Funds for Citide Demolition of
Substandard Buildings Project] This item as
distributed incorrectly reflects $7,000 less than the
total amount appropriated and the correction has been
made in the original vhioh is being transmitted to the
City Clerk.

The City of Miami Special Election was held on March 8, 1988. As
of the time of the March loth City Commission meeting,
Metropolitan Dade County had not fully canvassed absentee
ballots. Official results were not complete. It is now in.order
for the City Commission to approve the City Clerk's Certification
and Declaration of the Official Results of said election.
Attached please find the following documents for Commission
approval:
(1) The City Clerk's Certification and Declaration of Official
Results of the City of Miami Election held in March 8, 1988
for the following questions: (1) General Obligation Bonds
for Street and Highway Improvements and (2) Proposed Lease
of city -owned Existing Boatyard Property at 2640 South
Bayshore Drive.
(2) Precinct -by -precinct printout of the results of said
election.
(3) Resolutions approving all of the above.

ELECTION; ESTABLISHING A FORM OF THE OFFICIAL
BALLOT FOR SAID ELECTION; AUTHORIZING CERTAIN
OFFICIALS OF THE CITY TO TAKE ACTIONS
REQUIRED IN CONNECTION THEREWITH; DECLARING
AN EMERGENCY TO EXIST AND DISPENSING WITH THE
READING OF THIS ORDINANCE ON TWO SEPARATE
DAYS; AND PROVIDING AN EFFECTIVE DATE.";
(b) all steps in connection with said
election were duly, regularly and lawfully taken and had; and all
applicable provisions of the Constitution and Statutes of the
State of Florida and of said Ordinance have been fully complied
with;
(o) the inspectors and clerks of each
election precinct in the City have duly made returns of the
results of the election in each such precinct on the question
submitted at said election;
(d) at said election there was submitted to
the qualified electors of the City of Miami. Florida. the
following question:
"Shall bonds of the City of Miami. Florida.
in an aggregate principal amount not
exceeding $40.000,000 be issued under the
provisions of Ordinance No. 10365 for the
purpose of paying the costs of STREET AND
HIGHWAY IMPROVEMENTS. such bonds to be issued
at one time or from time to time and to
mature as shall be established by subsequent
ordinanoe or resolution of the City of Miami,
Florida. but in no event later than twenty
years from the date of such bonds, to bear
interest at a rate or rates not to exceed the
maximum rate permitted by Florida law. and to
be payable from ad valorem taxes unlimited as
to rate and amount?"
(e) the attached schedule correctly shows
the number of each of the election precincts in the City of
Miami, the number of electors entering the voting machine booths
for the purpose of voting, the number of votes cast by qualified
electors approving said question. and the number of votes cast by
qualified electors disapproving said question;
(f) each qualified elector of the City of
Miami was given the opportunity of voting for or against the
question.

Section 3. With respect to the question set forth above,
it is hereby found and determined that 15 7 31— votes were oast
by qualified electors in favor of the issuance of not to exceed
$40,000,000 Street and Highway Improvement Bonds of the City of
Miami. Florida, and the levying of a tax to pay the principal and
interest thereon; that 21,510 votes were cast by qualified
electors against the issuance of said bonds, and the Commission
hereby declares and certifies that the question of such issuance
and the levying of a tax to pay the principal and interest
thereon was disapproved by the qualified electors of the City of
Miami at such election and that the total number of votes on the
question in said election in said voting precincts was
37,241 . and that a majority of the votes on the question in
said election in said voting precincts was not in favor of the
issuance of not to exceed $40,000,000 Street and Highway
Improvement Bonds of the City of Miami, Florida, and the levying
of a tax to pay the principal and interest thereon.

I. I, MATTY HIRAI, City Clerk of the City of Miami, Florida, do
hereby certify that all necessary legal steps were taken in
connection with the conduct of a City of Miami Special Election
held on March 8, 1988 including the following Logic and Accuracy
Tests:
On March 4, 1988 commencing at approximately 9:00 A.M. the Dade
County Canvassing Board had the automatic tabulating equipment
based at the Elections Department and O.C.S.I.S. offices, at the
Metro -Dade Center, tested to ascertain that the "equipment would
correctly count the precinct and absentee ballot votes cast for
the measures.
On March 8, 1988, commencing at approximately 5:00 P.M. the
automatic tabulating equipment based at the Elections Department
and O.C.S.I.S. offices at the Metro -Dade Center was once again
tested to ascertain that the equipment would correctly count the
precinct votes cast for the measures.
At the completion of the precinct ballot count, the automatic
tabulating equipment was again tested to ascertain that the
equipment correctly counted the precinct votes cast for the
measures.
On March 10, 1988, commencing at approximately 2:00 P.M. the
automatic tabulating equipment based at the Elections Department
and O.C.S. I.S. offices, at the Metro -Dade Center, was tested to
ascertain that the equipment would correctly count the absentee
ballot votes cast for the measures.
At the completion of the absentee ballot count, the automatic
tabulating equipment was again tested to ascertain that the
equipment correctly counted the absentee ballot votes cast for
the measures.
I do hereby further certify that all documents concerning
these Logic and Accuracy Tests showed the computer to be
functioning correctly and are in the possession of the Supervisor
Of Elections of Metropolitan Dade County, under sealed vault.
I further certify and declare that the results of the
Special Election which was held on March 8, 1988 are as follows:

Test which was conducted on March 10, 1988 verified the continued
accuracy of the computer.

The City of Miami Special Election was held on March 8, 1988. As
of the time of the March loth City Commission meeting,
Metropolitan Dade County had not fully canvassed absentee
ballots. Official results were not complete. It is now in order
for the City Commission to approve the City Clerk's Certification
and Declaration of the Official Results of said election.
Attached please find the following documents for Commission
approval:
(1) The City Clerk's Certification and Declaration of Official
Results of the City of Miami Election held in March 8, 1988
for the following questions: (1) General Obligation Bonds
for Street and Highway Improvements and (2) Proposed Lease
of City -owned Existing Boatyard Property at 2640 South
Bayshore Drive.
(2) Precinct -by -precinct printout of the results of said
election.
(3) Resolutions approving all of the above.
