AN ORDINANCE. AMENDING CHAPTER 62, ENTITLED
"ZONING AND PLANNING," OF THE CODE OF THE
CITY OF MIAMI, FLORIDA, AS AMENDED, BY
AMENDING ARTICLE VIIt ENTITLED "LAPIN QUARTER
REVIEW BOARD," SECTIONS 62-76 THROUGH 62-82,
BY CLARIFYING DEFINITION OF CLASS "C" PERMIT;
MODIFYING THE BOARD'S PURPOSE; MODIFYING
BOARD ATTENDANCE REQUIREMENTS; , CLARIFYING

PROCEDURES.
WHEREAS, the Miami Planning Advisory Board, at its meeting
of February 3, 1988, Item No. 4, following an advertised hearing,
adopted Resolution PAB 18-88, by a vote of 7 to 0, RECOMMENDING
APPROVAL, of amending the City Code, as hereinafter set forth;
and
WHEREAS, the City Commission after careful consideration of
this matter deems it advisable and in the best interest of the
general welfare of the City of Miami and its inhabitants to grant
these amendments, as hereinafter set forth;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The Code of the City of Miami, Florida, is
hereby amended in the following particulars:
"CHAPTER 62
ZONING AND PLANNING
ARTICLE VIII. LATIN QUARTER REVIEW BOARD
Sec. 62-76. Definitions.
Words and/or figures stricken through shall be deleted.
Underscored words and/or figures shall be added. The

As used in this article ► the following words
and phrases shall have the meanings
respectively asbribed to them by this
section:
Platting director: Director of the planning
department. Class "C" special permit as
defined ned in the City zoning ordinance 9500

department before a building permit is
granted.
Sea. 62-17. Establishment.
There is hereby established a board, to
be known as the Latin Quarter review board
(LQRB), for the purpose of
recommending whether the design of
developments and/or improvements within the
Latin Quarter district are in conformance
with the Latin Quarter design guidelines and
standards and other guidelines and standards
and the intent of the Latin Quarter special
public interest distriot_LZ (SPI_g).
Sea 62-78. Membership
(f) Removal. Members of the Latin Quarter
review board may be removed for cause by vote
of not less than three (3) members of the
city commission; however, whenever a member
has had within a calendar year, foar—{4}
three (3) trn i absences from regularly
scheduled meetings, the chairman shall
certify same to the city commission. Three

Sec. 62-79.
Functions, powers and duties

(a) No building permit shall be issued
within the boundaries of the Latin Quarter
zoning districts for any project involving
new construction; exterior improvements
including but not limited to fences, walls,`
decorative building features and attachments,
landscaping devices, pavement treatments,
oolor, signage and alterations along
pedestrian oriented streets; and projects
involving only improvements visible •from
Public right-of-way in the remainder of the

Latin Quarter review board (LQAI3) for any
oonstruction, alteration or improvement over
ten thousand dollars ($10,000.00) in post, or
if less, whenever the planning director

board and the director shall take into
consideration the Latin Quarter design
guidelines and standards.
(b) In addition to such other powers, duties
and authority as may be set forth elsewhere
in the City Code and in the zoning ordinance,
the Latin Quarter review board is hereby
authorized to:

Seca. 62-80 Proceedings
(a) Offioers. The Latin Quarter review
board shayl.l select a chairperson and
vice -chairperson from among Its members
tQ serve for a one-year term and may
create and fill such other offices as It
may deem necessary or desirable.
(b) Mules of procedure. The Latin Quarter
review board shall establish rules of
procedures necessary to its governing
and the conduct of its affairs, in
keeping with the applicable provisions
of the City Charter, ordinances and
resolutions. Such rules of procedure
shall be available in written form to
Persons appearing before the board and
to the public upon request.
(e) Meetings. The Latin Quarter review
board shall meet at least once per
month, except August where when there
will be no resfular meeting, with all
meetings open to the public. Notice of
meetings shall be posted at the city
Administration Building.
(d) Voting; quorum. All decisions and
recommendations of the Latin Quarter
review board shall require a concurring
vote of a majority of the members
present. Five (5) members shall
constitute a quorum. In case of a tie
vote, such vote shall be construed as a
denial.
(e) Assignment of personnel. The City
Manager shall assign adequate staff to
the Latin Quarter review board to carry
out its responsibilities and duties,
including but not limited to
representatives from the departments of
planning;
adintatstratton building and zonings; law;
a;nd fire, rescue and inspection services
and publio works.
(f) Public record. Summary Mminutes of each
Latin Quarter review board meeting shall
be prepared by staff representattyeks
the Latin
Quarter Officer, under the supervision
and direction of the board.- Records of
the summary minutes shall be kept with
the city planning department.
Sec. 62-81. Latin Quarter officer.
(a) The city manager shall appoint a person
from the planning department to serve as
Latin Quarter officer to assist the
Latin Quarter review board. The
appointee shall be experienced and
knowledgeable in respect to
architectural design, urban design, site
planning, and land use control
regulations.

forth in sections 15140 through 15145 of
the zoning ordinance.

(1) Schedule meetings of the Latin Quarter
review board, prepare agendas, and
ensure that proper notice is oarri,ed out
by persons or departments assigned to
such duties.
(2) Provide applicable
information on Latin Quarter rojeots,
standards, guidelines, a—nd procedures in
the Latin Quarter SPI,s and_ related
materials.
(3) Prepare summary reports of board
dectsiottEr actions and, transmit them to
the planning director..

recommendations to the planning

agencies, and private groups as required

Sec. 62-82. Appeals from decision.
An appeal from any decision of the
director of the planning department to the
zoning board must be filed in accordance with
article 30 of the city zoning ordinance
may be taken to the zoning board by any

as they are inconsistent or in conflict with the provisions of
this Ordinance are hereby repealed.
Section 3. If any section, part of section, paragraph,
clause, phrase or word of this ordinance is declared invalid, the

Generally, subsections (a) and (b), to make
technical corrections and to delete subsection
(b)(3) and revise subsection (b)(4) to clarify.
the functions or the Board; Section 62-80
Proceedings, subsections (e) and (f) to
substitute new names for city departments, add
new departments, and to modify the wording;
Section 62-81 Latin Quarter Officer, subsections
(b)(2), (b)(3), adding a new (b)(4) and amending
(b)(5) to update the functions of the Latin
Quarter Officer, and Section 62-82, Appeals from
Decision, to simplify the appeal language; all
in order to provide a better coordination
between the City Code and the Zoning Ordinance'
as pertains to the Latin Quarter.
REQUEST
To amend Article VIII Latin Quarter Review
Board.
ANALYSIS
There is a need to update Article VIII in order
to improve the review board function. The
Proposed amendments would:
Modify the number of absences and to include
arrival and departures from meetings, make'
technical corrections,update the functions of
the Latin Quarter Officer and simplify the
appeal language.

Advisory Board adopted Resolution PA9 IS-88, by
a 7 to 0 vote, recommending approval of the above.
Fifteen replies in favor and six objections were
received by mail.
CITY COMMISSION At its meeting of March 24, 1988, the City
Commission passed the above on First Reading.
