ORDINANCE:, NO. 1,(� 5.
AN ORDINANCE AMENDING THE ZONING ATLAS OF
ORDINANCE NO. 9500, THE ZONING ORDINANCE OF
THE CITY OF MIAMI, FLORIDA, BY REMOVING THE
"PEDESTRIAN STREET DESIGNATION" FROM THE
PUBLIC RIGHT -OP -WAY IN THE SPI-14 ZONING;
DISTRICT FOR THOSE PORTIONS OF SOUTHWEST 12TH
AND SOUTHWEST 17TH AVENUES BETWEEN SOUTHWEST
8TH AND SOUTHWEST 9TH STREETS; RETAINING SAID
DESIGNATION FOR THAT PORTION OF RIGHT-OF-WAY
ON PROPERTIES FOR HEREIN AFFECTED AREAS
FACING SOUTHWEST 8TH STREET; BY RETAINING THE
SPI-14 ZONING DESIGNATION; AND BY MAKING ALL
THE NECESSARY CHANGES ON PAGE NOS. 38 AND 39
OF SAID ZONING ATLAS.
WHEREAS, the Miami Planning Advisory Board, at. its meeting
of February 3, 1988, Item No. 2, following an advertised hearing,
adopted Resolution No. PAB 13-88, by a 7 to 0 vote, RECOMMENDING
APPROVAL of a change of zoning, as hereinafter set forth; and
WHEREAS, the City Commission after careful consideration of
this matter deems it advisable and in the best interest of the
general welfare of the City of Miami and its inhabitants to grant
this change of zoning as hereinafter set forth;

NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA.
Section 1. The Zoning Atlas of Ordinance No. 9500, the
Zoning Ordinance of. the City of Miami, Florida, is hereby amended
by removing the "pedestrian street designation" for the public
right-of-way in the SPI-14 Zoning district located on Southwest
12th Avenue and Southwest 17th Avenue between Southwest 8th to
Southwest 9th Streets ("Subject Area")
Section 2. Notwithstanding Section 1, above, that
portion of right-of-way on properties fading Southwest 8th Street
at both above locations shall retain the Pedestrian Street
designation.
Section 3. The Subject Area shall retain the SPI-14
zoning designation.

Zoning Ordinance of the City of Miami, Florida, is hereby amended
by removing the "pedestrian street designation" for the public
right-of-way in the SPI-14 Zoning district located on Southwest
12th Avenue and Southwest 17th Avenue between Southwest 8th to
Southwest 9th Streets ("Subject Area").
Section 2. Notwithstanding Section 11 above, that
portion of right-of-way on properties facing Southwest 8th Street
at both above locations shall retain the Pedestrian Street
designation.
Section 3, The subject Area shall. retain the SPI-14
zoning designation.
Section 4, tt is herebv found that this zoning

(a) Is in conformity with the Adopted Miami Cn � e � v

Neighborhood plan;

(b) Is not contrary to the estahlished land usp pattr?rn;
(c) Will not create an isolated district unrelated to
adjacent and nearby districts;
$ (d) Is not out of scale with the needs of the neighborhood
or the City;

(e) Will not materially alter the population density
pattern or increase or overtax the load on public
facilities such as schools, utilities, streets, etc.;
I (f) Is necessary due to changed or changing conditkons;
(g) Will not adversely influence living conditions in the
neighborhood;
(h) Will not create or excessively increase traffic
congestion or otherwise affect public safety;
(i) Will not create a drainage problem;
(j) Will not seriously reduce light and air to adjacent
area;
(k) Will not adversely affect property values in the
adjacent area;

(1) Will not be a deterrent to' the improvement or
development of adjacent property in accord with
existing regulations;
(m) Will not constitute a grant of special privilege to an
s individual owner as contrasted with protection of the
s;
public welfare.
Section 5. Page Nos. 38 and 39 of the Zoning Atlas
incorporated in said ordinance, by reference and description in
Article 3, Section 300 thereof, is hereby amended to reflect the
herein changes.
Section 6. All ordinances or parts of ordinances insofar
as they are inconsistent or in conflict with the provisions of
this ordinance are ;hereby repealed.

17th Avenues, from S.W. 8th to 9th Streets,
excluding the portion of the right-of-way on
properties facing S.W.'8th Street, and retaining
the SPI-14 zoning designation.
To remove the pedestrian street designation from
SPI-14 at the above mentioned properties.
The proposed amendments are consistent with the
intent of the Latin Quarter. These areas are
not conducive to specialty retail activity or,
they are already redeveloped.
Approval.
At its meeting of February 3, 1988, the Planning
Advisory Board adopted Resolution PAB 13-88,_by
a 7 to 0 vote, recommending approval of the above.
Fifteen replies in favor and six objections were
received by mail.
At its meeting of March 24, 1988, the City
Commission passed the above on First Reading.
