AND A SEVERABILITY CLAUSE.
WHEREAS, the City Corrunission adopted Ordinance No. 10347 on
November 19, 1987, appropriating funds for Capital Improvement
projects; and
WHEREAS, in accordance with Section 2.136 of the Miami City
Code (1980), the Planning Department has 'prepared and _submitted
to the City Commission a Capital Improvement Program (CIP) that
identifies the sources of funding of all proposed capital
projects valued at $5,000 or more for the program years 1987
1993; and
WHEREAS, this Program was adopted by the City Commission by
Resolution No. 87-935 on October 22, 1987; and
WHEREAS, the City Commission, upon the recommendation of the
City Manager and Director of the Department of Parks, Recreation
and Public Facilities has identified the emergency need for an
additional project for Orange Bowl Stadium Modernization in order
to secure new long-term use agreements with the major tenants of
said City facility; and

WHEREAS, tine City Commission adopted Ordinance No. 10347 on
November 19, 1987, appropriating funds for Capital Improvement
projects; and
WHEREAS, in accordance with Section 2.136 of the Miami City
Code (1980), the Planning Department has prepared and submitted

WHEREAS, the total Project will iriclucie press box

system, and construction of new ramps, concourses, concession
stands and restrooms at a total estimated Lost of $15,000,000, and
WHEREAS, said Project has been divided into two phases:
Phase I pertaining to press box and elevator improvements at a
total proposed cost of $1,010,000, and Phase II encompassing the.
balance of elements previously described At a total proposed cost
of $14,000,000; and
WHEREAS, said tenants require completion of Phase I of said
project by September 1, 1988 and completion of Phase II by
September 1, 1989; .and
WHEREAS, the City Commission, by Resolution No. 88-339,
adopted April 14, 1988, expressed its approval of such project by
authorizing an agreement with Kunde, Sprecher, Yaskin and
Associates, Inc. as consultant to the City for Phase I and
allocating $60,000 from FY'88 Tourist Resort Tax monies; and
WHEREAS, funds in the amount of_$350,000 and $100,000 are
currently available in FY'88 Orange Bowl Equity in Poole:i Cash
and in FY'88 Orange Bowl Revenue - anticipated, respectively; and
WHEREAS, funds in the amount of $500,000 are available
through a loan from the Downtown People -Mover_ Extension Project
Deposit (Project No. 371001) with repayment of this loan, in a
minimum yearly amount of $167,000.within the time frame of FY'89
through FY'91, being primarily secured by the Metro -Dade Tourist
Development Resort Tax (Project No. 195001), and as secondary
pledge, the Orange Bowl Stadium - Equity in Poolad Cash (Project
No. 404000); and
WHEREAS, funds in the total amount of $1,010,000 are thus
currently available for Phase I of said project; and
WHEREAS, the City Manager and the Directors of the
Department of Finance and Department of Management and Budget are
preparing a financing plan for Phase 11 of said projects

"Section 1. The herein appropriations are hereby
made for implementation of all municipal capital
improvements of the City of Miami, including new
capital improvements projects scheduled to begin
during fiscal year 1987-8B. The herein
appropriations which are hereby designated by
reference to descriptive project title and number
also include appropriations for previously approved
scheduled projects as well as re -appropriations of
prior fund appropriations. The source of revenues
to support the herein appropriations is hereby
identified by fund and project with the. project
appropriations and revenues therefor being set forth
for seven program areas (I-VII) based upon use or
functional category within said areas, as follows:

Section 4. This Ordinance .is hereby declared to be an
emergency measure on the grounds of urgent public need for the
preservation of peace, health, safety, and property of the City
of Miami and upon the further grounds of the necessity to make
the required and necessary purchases and payments, and to
generally carry out the functions and duties of municipal
affairs.
Section 5. The requirements of reading this ordinance on
two separate days is hereby dispensed with by a vote of not less
than four-fifths.of the members of the Commission.

It is respectfully recommended that the City Commission adopt the
attached Emergency Ordinance to amend the Capital Improvement
Program Ordinance (No. 10347) by establishing a new project
entitled "Orange Bowl Stadium Modernization Project Phase I"
and appropriating funds in the amount of $1,010,000 as follows
$60,000 from FY'88 Metro -Dade Tourist Development Resort Tax,
$350#000 form Orange Bowl Equity in Pooled Cash,$100,000 as a
contribution from Orange Bowl Enterprise Fund revenue, and
$500,000 as a loan from the Downtown People -Mover Extension
Project. Repaymentofthis loan, in a minimum yearly amount of
$167000 within the time frame of FY'89 through FY'91, will be
primarily secured by the Metro -Dade Tourist Development Resort
Tax, and as secondary pledge the Orange Bowl Stadium Equity, in
Pooled Cash.
Background:
The Parks, Recreation and Public Facilities Department has
prepared the attached legislation to formally establish and
appropriate funds for the Orange Bowl Stadium Modernization,
Project Phase I The Project was given initial approval by
Commission Resolution No. 88-339, adopted April 14, 1988, which
authorized the execution of an agreement with Kunde, Sprecher,
Yaskin and Associates'to provide design, engineering and project
management services. Funds in the amount of $60,000 were
allocated at that time for Phase I consultant services.
As previously presented, the University of Miami (UM) and Orange
Bowl, Committee (OBC) have stated that specified' improvements to
the 'Stadium are mandatory if either' major tenant is to execute
new -long-term use agreements when existing contracts expire in
1991 and 1992. Kunde and Associates' assisted staff in preparing
the project outline (attached) which shows Phase I improvements
at a costof$1,010,000 and Phase II improvements at a cost of
$14000,000. The tenants have indicated deadlines of
September 1'1988 for Phase I and September 1, 1989 for Phase II.

At the present time, affected departments, including Finance,
Management and Budget, and Planning, have identified the balance
of Phase I financing in the amount of $950,000 Because the
September 1, 1988 deadline is imminent, funds must be readily
available and in -place immediately for the start of Phase I
construction. Thus, we have recommended a loan of $500,000 from
the DowntownPeople-Mover Extension Project Deposit. Repayment -
of this loan, in a minimum yearly amount of $167,000 within the
time frame of FY'89'through FY'91, will be primarily secured by
the Metro -Dade Tourist Development Resort' Tax, and as secondary
pledge the Orange Bowl Stadium - Equity in Pooled Cash.' The -
remaining funds are. to be taken from current Orange Bowl Stadium
sources: $100,000 Enterprise Fund Contribution (FY'88 revenue)
and $350,000 existing Equity in Pooled Cash.
For Phase' II of the Project, the administration proposes a
20-year Special Revenue Bond. The issuance of $16 million in
revenue bonds will provide sufficient funds for this Project and
will retire all previous committments of Tourist Development
dollars to the Capital Improvement Program. Annual payment on
the bonds would be made from three sources: a ticket surcharge
on all Orange Bowl event admissions, advertising revenue
generated from the new Orange ;Bowl scoreboard/message board
system; and Tourist Development Revenue (begining FY'90). A
detailed presentation on this aspect of project financing and the:.
ticket surcharge will be made once negotiations are complete.
This item is presented: as an emergency measure so that funds are
immediately in; place for the, start of Phase I construction. A
Companion resolution is also .scheduled after this ordinance as a
Public 'Hearing to approve the the waiver of formal bid procedures
for construction contracts.

kECOMMENDATION
It is respectfully recommended that the City Commission adopt the
attached emergency ordinance which establishes a new special
revenue fund entitled "JTPA/01der Worker, FY ` 87 -88" appropriating
$17,800 for a grant from the South Florida Employment and
Training Consortium and authorizes the City Manager to accept the
grant and enter into the necessary implementing agreement.
BACKGROUND
The Department of Community Development has been advised that the
Neighborhoods Jobs Program has been awarded a grant from the
South Florida Employment and Training Consortium in the amount of
$17,800, for the purpose of providing a job development and
placement program for persons 55 years�of aqe and older.
Adoption of the proposed emergency ordinance authorizes the City
Manager to accept the grant, establishes a new special revenue
fund appropriating the funds from the grant and authorizes the
City Manager to enter into the necessary implementing agreement.
In order to receive grant funds to recover operating costs from
the February 29, 1988 commencement date of the program and enter
into 'the implementing agreement with the South Florida Employment
and Training Consortium, this ordinanceis being submitted• on an
emergency basis.
