A RESOLUTION REVERSING THE DECISION OF THE ZONING BOARD AND DENYING THE APPLICATION FOR VARIANCE FROM ORDINANCE 9500, AS AMENDED, THE ZONING ORDINANCE OF THE CITY OF MIAMI, SCHEDULE OF DISTRICT REGULATIONS, PAGE 1 OF 6, RS-1; RS-2; ONE FAMILY DETACHED RESIDENTIAL, MINIMUM OPEN SPACE REQUIREMENT AND MAXIMUM HEIGHT, TO ALLOW A TWO-STORY ADDITION TO THE EXISTING SINGLE FAMILY RESIDENCE FOR PROPERTY LOCATED AT 2551 TIGERTAIL AVENUE, MIAMI, FLORIDA, (MORE PARTICULARLY DESCRIBED HEREIN), WITH AN EASTERLY SIDE YARD OF 4'2" (5.0' REQUIRED) AND A HEIGHT OF 29' (25' MAXIMUM HEIGHT ALLOWED), AS PER PLANS ON FILE; ZONED RS-2/2 ONE FAMILY DETACHED RESIDENTIAL. THIS VARIANCE HAS A TIME LIMITATION OF TWELVE MONTHS IN WHICH A BUILDING PERMIT MUST BE OBTAINED. WHEREAS, the Miami Zoning Board at its meeting of March 21, 1988, Item No. 8, following an advertised hearing, adopted Resolution No. ZB 34-88, by a five to two (5 - 2) vote granting a variance from Ordinance 9500, as amended, the Zoning Ordinance of the City of Miami, Schedule of District Regulations, Page 1 of 6, RS-1; RS-2; One Family Detached Residential, Minimum Open Space Requirement and Maximum Height, as hereinafter set forth; and WHEREAS, adjacent property owners have taken an appeal to the City Commission from approval of the variance; and WHEREAS, the City Commission after careful consideration of this matter finds that there are no peculiar circumstances affecting this parcel of land nor any practical difficulties and unnecessary hardships which would impair the owner's right to the reasonable use of the property without the grant of variance as hereinafter set forth; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. RECOMMENDATIONS PLANNING DEPARTMENT APPROVAL. The proposed addition to the existing amfiiy structure necessitates the requested variances. The existing residence was constructed in 1948 according to previous zoning regulations, the house is surrounded by large mature trees and abundant landscaping. In order to allow an expansion of the existing facilities without damaging or removing the trees, and without tearing down a substantial portion of the existing building, the applicant has chosen to construct a second floor addition which the Planning Department favors. The existing foundations would not allow a second story addition, therefore, new columns independent of the existing structure were recommended by the architect. The Planning Department recommends a variance of 10" intrusion into the side yard as a minimum variance that would make possible a reasonable use of the land. The height variance is recommended as a reasonable way of extending the building structure over the existing approximately 15' high structure and still keeping in harmony with the architectural design. R8-473 RTC There would be minimal impact upon the surrounding area. It should be noted that if the variances were to be granted, the proposed expansion would allow a potential of approximately 1000 square feet of office space that could be allowed through home occupation. PUBLIC WORKS No comment. DADE COUNTY PUBLIC WORKS No comments. ZONING BOARD At its meeting of March 21, 1988, the Zoning Board adopted Resolution 34-88, by a vote of 5-2, granting the above. SS-473 /0? 4ft 4" N City of Miami Hearing Boards Division Building & Zoning Department February 16, 1988 Dear Board Members, In the summer of 1983, as a single man, I purchased a home belonging to the estate of Ms. Agatha Owens, an elderly woman who had occupied the house since 1948. -I continued her tradition of nurturing the trees and plants, and , I added quite a bit of landscaping myself. The house seemed adequate for a bachelor's needs. A year ago I married a woman who shares my desire to maintain the natural beauty of our property. However, we are seriously in need of an expanded dwelling, not only for ourselves but also for the family we intend to raise. When my wife and I discussed expansion of our home with architects and contractors, we soon discovered that expanding the ground floor area alone would inevitably result in severe damage too or removal of our huge fruit trees, as well as other vegetation in close proximity to the house. We also discovered that the existing foundation was not strong enough to support a second floor. Knowing that a second floor was the only alternative for saving the property in its natural state, we discussed the possibility of building another foundation to support the upper floor. We discovered this would be possible if we were willing to spend the extra money, and, if the City of Miami would allow us to build higher than 25 feet and allow the placement of columns 10 inches into the side yard bordering our neighbor, Fred Griffin. We decided that it was worth pursuing. So did our neighbor Fred and other neighbors in the area who also share Coconut Grove's penchant for plants and trees. Now we are asking you to help us expand our family dwelling without sacrificing the natural beauty that everyone in our area `-- wishes to preserve. We have taken great pains and are willing to go through the extra expense of adding to our residence without disturbing any of the plant and tree life. Please help us preserve this important part of our neighborhood. If you'll just drive by the property some time and have a look, you will have to agree that the variance requested is more than justifiable under the circumstances. It is my understanding that their residence will include a second floor that will reach a height of approximately 30'8", and, their building will expand by approximately 10" into the side -yard (i.e. 5' setback) along my property line. My property is perhaps the most "impacted" by the Lind's planned construction. Nonetheless, I heartily support the approval of their plans. The Lind's intention to preserve their plants and trees is a credit to the Coconut Grove tradition as a place where plantlife flourishes. The foundation of your existing home is a 10" X 16" continuous footing with 2 # 5 reinforcing bars. A 10" X 20" continuous footing is the current minimum code requirement for two story homes (S.F.B.C. 2403.2). Also your existing home has filled masonry cells with 1 # 5 reinforcing bar in lieu of standard tie columns. The second story will require minimum tie columns of 8" X 12" with 4 # 5 reinforcing bars per code (S.F.B.C. 2704.2b). These tie columns must.have new column pads. After considering this information, we strongly recommend that a new struc- ture, independent of the existing one should be erected. The new structure can be architecturally pleasing as we have demonstrated in preliminary design draw- ings. Although your construction costs will increase some, we believe that this conservative solution to the problem, in your case, will insure the integ- rity of both existing and new construction.
