ZONING BOARD AND GRANTING A VARIANCE FROM
ORDINANCE NO. 9500, AS AMENDED, THE ZONING
ORDINANCE OF THE CtTY OF MIAMI, FLORIDA.
ARTICLE 20, SECTION 2023, SUBSECTION 2023.4
AND THE SCHEDULE OF DISTRICT REGULATIONS,
PAGE 5 OF 6, MINIMUM OFFSTREET PARKING
REQUIREMENTS, TO PERMIT THE CONSTRUCTION AND
OPERATION OF A SELF -STORAGE FACILITY FOR
PROPERTY LOCATED AT 2960-78 and 2990
SOUTHWEST 28TH LANE, MIAMI, FLORIDA, (MORE
PARTICULARLY DESCRIBED HEREIN), AS PER PLANS
ON FILE, PROVIDING I OFFSTREET LOADING BAY
(2 REGULAR BAYS AND 1 OVERSIZED BAY
REQUIRED), AND PROVIDING 19 OF 90 REQUIRED
OFFSTREET PARKING SPACES, SUBJECT TO A REVIEW
BY THE ZONING BOARD ONE (1) YEAR FROM TIME OF
APPROVAL; ZONED I-1/7 LIGHT INDUSTRIAL.
WHEREAS, the Miami Zoning Board at its meeting of
April 18, 1988, Item No. 1, following an advertised hearing,
adopted Resolution No. ZB 63-88, by a five to four (5-4) vote
DENYING the variance as hereinafter set forth; and
WHEREAS, the applicant has taken an appeal to the City
Commission from denial of the Variance; and
WHEREAS, the City Commission after careful consideration of
this matter and notwithstanding the denial by the Zoning Board,
finds that peculiar circumstances exist which impair the owner's
right to some reasonable use of the property without the grant of
variance as set forth;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. That the decision of the Miami Zoning Board in
this matter is reversed and the request for a variance. from
Ordinance No. 9500, as amended, the Zoning Ordinance of the City
of Miami, Florida, Article 20, Section 2023, Subsection 2023.4
and the Schedule of District Regulations, Page 5 of 6, Minimum

RECOMMENDATIONS
PLANNING DEPARTMENT DENIAL. There is no hardship to justify the
requested variances. The subject area requires
the balanced maintenance of the ninety (90)
required off-street parking spaces and the three
(3) required loading stalls for the.protection
of the adjacent low density residential area.
Even though the Planning Advisory Service Report
No. 396 recommends approximately seventeen (17)
parking spaces for the size of the subject
facility, the Planning Department recommends
that the total required number of parking spaces
be provided. A visual inspection of the subject
property revealed that all of the existing_ on -
street parking was taken up, which shows that
there is already a parking shortage in the area.
This type of use generates a need to have
parking immediately adjacent to the storage
facility to avoid the inconvenience of carrying
items to be stored over a long distance. The
closest Metrorail Station is approximately three
(3) blocks from the subject property. There is
too much building proposed for the size of the
subject property which does not constitute
hardship, especially since a reasonable use
could be achieved with a lesser structure. For
all the aforementioned, the granting of the
requested variances would be detrimental to the
general character of the area and, therefore,
should be denied.

Require dedication of 25' radius at corner of SW
30 Avenue and SW 28 Lane. Recommend denial of
reduction in parking and loading bays. Right-
of-way inprovement in SW 28 Lane and SW 30
Avenue will be required.

At its meeting of April 18, 1988, the Zoning Board
adopted Resolution ZB 63-88, by a vote of 5 to 4,

Dear Ms. Fox:
On behalf of the applicant, pursuant to the provisions
of Ordinance NO. 9500, please accept this letter as our formal
appeal of the adverse decision of the City of Miami Zoning Board
at its April 18, 1988 public hearing.
We respectfully submit that the Zoning Board erred
in the following respects:
1. Had no substantial competent evidence to base its
decision.
2. Staff recommendations were not based upon national
and local standards for similar facilities.
3. Article 20 of the City Code as applied, is
unconstitutional based upon the Code's failure
to be predicated upon rational and objective
standards. All industrial land uses are treated
as though they had identical off-street parking
impacts and accordingly, there exists no rational
nexus between the land use restriction and the
police power.

Petition for Variance
Dear Ms. Fox:
Our firm represents James Confalone (the "Petitioner") in
connection with his Petition for Variance (the "Petition")
seeking variances from parking and loading requirements (the
"Variances") in order to construct a 90,000 square foot
self -storage facility (the "Facility") on the property at the
intersection of Southwest 30th Avenue and 28th Lane, Miami,
Florida (the "Property").
Subject to the granting of the Variances, the Petitioner
intends to convey the Property to Public Storage, Inc. ("Public
Storage"), the largest and most well respected developer of
self -storage facilities in the United States and Canada.
With respect to the Variances, you should be aware of the
following:
1. PARKING VARIANCE: This Variance is justified because,
among other things, the parking provided is adequate for the
Facility. Public Storage's projections are that on an average
the Facility will generate less than 7.5 cars per hour. This
projection is based upon its facilities throughout the United
States and Canada including more than sixty (60) self -storage
facilities in Florida. This projection is also based upon -the

method of calculating trip generations set forth in the American
Planning Association Planning Advisory Service Report No. 396, a
copy of which is enclosed (the "Report"). As you will note from
the Report, self -storage facilities such as this one generate
very little traffic and consequently the need for parking is
virtually eliminated.
Additionally, the Facility is uniquely situated
immediately adjacent tc the Metrorail--System- which --clearly
-.justifies a reduction in required parking. Public Storage
envisions that the majority of the users will be business and
offices within the immediate area which need storage space for
records, filing and other office related materials, as well as
residential customers.
2. LOADING SPACES: The request for a variance from the
required loading spaces is justified because of the nature of the
proposed facility. It is Public Storage's experience that the
use of loading docks is very limited in connection with self --
storage facilities such as the proposed Facility. The users of
the Facility will access the Facility from the Metrorail System
or by passenger car or other two-axel vehicles, not trucks and
semi -trucks of the type utilizing loading docks. This is
supported by the Report which states in part that "Traffic
studies have shown that SSSF's generally receive only two-axel
vehicles not semi -trucks, and they generate only a small amount
of traffic spread over a long period of time". Therefore, there
is no need for any loading spaces.
As further support for the Variances, you should be aware
that the Facility will be secured and attended by a manager on a
24-hour basis. Furthermore, the use by its nature is a passive
use compatible with the surrounding area. As reflected on the
architectural drawings submitted with the Petition, the Facility
is aesthetically attractive and has the appearance of an office
structure without the adverse consequences incidental thereto.
Public Storage is a responsible developer of quality
projects. Their facilities as shown in the brochures submitted
with the Petition reflect the highest quality of their product
and their unique experience. We believe the Facility will be an
asset to the area and provide a need which is clearly in demand

A variance is relaxation of the terms of the ordinance where such action will not be
contrary to the public interest and where, owing to conditions peculiar to the
property and not the result of actions of the applicant, literal enforcement of this
ordinance would result in unnecessary, and undue hardship on the property. As used in
this ordinance, a variance is authorised only for height, area, sue of structure,
dimensions of yards avid other open spaces and offstreet pwwng or loading
requirements. (Section 3I0I)

structure, or building involved and which are not applicable to other lands,
structures, or buildings in the some zoning district in that: (list evidence to

The subject property is uniquely situated adjacent to the Metrorail
line and South Dixie Highway at S.W. 30th Avenue. The intended use
for the property is to provide a special self -storage facility for
surrounding business, institutional and residential users which will
use the facility without the necessity of the required parking or
loading spaces.
(b) The special conditions and circumstances do not result from the actions of
the petitioner in that:
The property is unique because of its location along South Dixie Highway
and the Metrorail line. These are c1rc=stances which were not created
by the Petitioner.

x (c) Literai interpretation of the provisions of the zoning ordinance would deprive
the applicant of rights commonly enjoyed by other properties in the some
zoning district under the terms of the zoning ordinance and would work
unnecessary and undue hardships on the petitioner in that:
Compliance with the requirements of the Zoning ordinance will deny
the Petitioner the opportunity to develop its property in a manner
similar to surrounding properties, many of which have received or
are seeking similar variances.
x (d) Granting the variance requested will not confer on the petitioner any special
.� privilege that is denied by the Zoning Ordinance to other lands, buildings, or
structures in the some zoning district in that:
As stated above, the granting of the Variance will allow for the
development of the Property in a manner similar to other properties
in the area. Therefore, not providing the Petitioner with any
special privilege not given to others.
(e) The variance, if granted, is the minimum variance that will make possible the
reasonable use of the land, building, or structure in that:
The proposed use is a reasonable, functional and compatible use fcr
the Property which can only be accomplished by the granting of t't:e
requested Variances which are the minimum necessary to build the
proposed facility.

purpose of - the Zoning Ordinance, and will not be injurious to the
neighborhood, or otherwise detrimental to the public welfare.

I have- enclosed copies of traffic studies prepared by
Public. Storage for several of their facilities. These
studies indicate that the traffic generated by the proposed
facility will be minimal and therefore the variance of
the parking space requirement is justified.
Furthermore, Public Storage has advised us that based
upon their experience throughout the United States and
Canada the need for a loading dock or bay in connection
with the self -storage facility is unnecessary. We intend
to support that position with testimony by Public Storage
at the upcoming hearing.

Dear Stan,
Enclosed are the daily traffic counts from four (4) existing
Miami area Public Storage facilities for your use in conjunction
with the parking variance for the above referenced project. As
you will note. the hourly average number of vehicles entering each
site is very low. The variations in traffic volume at each site
are due to both the facility size and percentage of occupancy.
The average daily traffic for all four facilities is 89.5 vehicles/day
or 89.5-vehicies/169,751.6 square feet (total square feet for all
four facilities adjusted for occupancy rates). This translates -
into a traffic generation rate of 0.527 vehicles per 1000 square
feet of rented space.
For estimating traffic volumes at the proposed 5th Street facility,
there will be approximately 64,000 rentable square feet of storage
available. Assuming 90% occupancy, a traffic generation rate of
0.527 vehicle/day per 1000 square feet of occupied rental space,
yields a volume of 30.3 vehicles/day or 2.5 vehicles/hour.
