RESOLUTION No, 413
A RESOLUTION ALLOCATING AN AMOUNT NOT TO
EXCEED FOUR THOUSAND FIVE HUNDRED DOLLARS
($4,500) FROM THE CITY OF MI.AMI LAW
ENFORCEMENT TRUST FUND TO COVER THE COSTS
ASSOCIATED WITH THE ACQUISITION OF A PORTABLE
16 MM MICROFILM MACHINE, 'SUCH COSTS
HAVING BEEN APPROVED BY THE CHIEF OF POLICE.
WHEREAS, Florida State Statute 932.704(3)(a), as amended,
authorizes the expenditure of forfeiture proceeds for law
enforcement purposes not considered normal operating expenses;
and
WHEREAS, in an effort to minimize the amount of U.S.
currency being retained in the Miami Police Department's Property

Unit vaults, a program has been established whereby currency

seized is placed into interest bearing accounts; and
} WHEREAS, the placing of monies in interest bearing accounts
occurs most - frequently in forfeiture actions where civil
f
litigation is handled separately from the criminal action; and
f;
WHEREAS, the majority of. Assistant State Attorneys -request
that, prior to transferring currency held as evidence into an
i
interest bearing account, the bills be photographed and copied;
and
WHEREAS, the photographing and copying of said currency is a'
' lengthy process which currently requires the allocation of
significant manpower resources; and
WHEREAS, the purchase of a portable 16 MM Microfilm Machine
can accomplish the photographing and copying of currency in a
more efficient and cost effective manner; and
WHEREAS, funds to cover the necessary expenses required for
the acquisition of a portable 16 MM Microfilm Machine have not
been included in the Police Department's normal operating budget;
and

W1#ER-AS, the Chief of Police has recommended adoption of
this resolution and has determined that the expenditure proposed
complies with Florida State Statute 932,1041 as amended; and
WHEREAS, funds to cover the necessary expenses required for
the acquisition of the portable 16 MM Microfilm Machine are
available in the City of Miami Law Enforcement Trust Fund;
NOW, THEREFORE, 89 IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. Total approved funding, in an amount not to
exceed four thousand five hundred dollars ($4,500)0 is hereby
allocated from the City of Miami Law Enforcement Trust Fund to
cover the necessary expenses required for the acquisition of a
portable 16 MM Microfilm Machine, such expense having been
approved by the Chief of Police.

RECOMMENDATION:
It is respectfully recommended that the attached resolution
allocating an amount not to exceed four thousand five hundred
dollars ($4,500) from the Law Enforcement Trust Fund be approved
to cover the costs associated with the purchase of a portable 16
E MM Microfilm Machine for the Miami Police Department.
BACKGROUND:
In an effort to minimize the amount of U.S. currency retained in
the Miami Police Department. Property Unit .vaults. a program has
been implemented whereby currency is placed into interest bearing
` accounts. This occurs primarily in forfeiture actions where the
civil action is litigated separately from the criminal action.

In instances where the currency is being held as evidence in
relation to the pending criminal charges, the majority of

Assistant State Attorneys require that y q prior to transferring the
currency into an interest -bearing account, the bills be
photographed and copied.
At present,.the process for photographing and counting this money
is quite time consuming and costly since most of the bills
confiscated are in small denominations. Therefore, it is
requested that the City Commission allocate four thousand five
hundred dollars ($4,500) for the purchase of a 16 MM Microfilm
Machine.
Funding to be allocated from the Law Enforcement Trust Fund.
