HomeMy WebLinkAboutO-104444 /' - A ORDINANCE N0: IL0444 AN ORDINANCE REPEALING ORDINANCE N0. 10368 ADOPTED JANUARY 149 1988, AND AMENDING ORDINANCE NO. 10145, ADOPTED SEPTEMBER 11, 19869 BY APPROPRIATING FOR THE IMPLEMENTATION OF AN AMENDED TRUST AND AGENCY FUND ENTITLED: COMMUNITY DEVELOPMENT BLOCK GRANT TWELFTH (12TH) YEAR; THE ADDITIONAL SUM OF $2019955 AT PRESENT ALLOCATED AS REVENUE IN THE COMMUNITY DEVELOPMENT BLOCK GRANT FUNDS, $172,359 IN FIFTH (5TH) YEAR AND $29,596 IN SEVENTH (7TH) YEAR, SAID AMOUNTS TO BE TRANSFERRED FROM SAID REVENUE FUNDS AND ALLOCATED AS BUDGET FUNDS IN THE TWELFTH (12TH) YEAR CITYWIDE DEMOLITION OF SUBSTANDARD BUILDINGS PROJECT TO BE CARRIED OUT BY THE BUILDING AND ZONING DEPARTMENT; CONTAINING A REPEALER PROVISION AND A SEVERABILITY CLAUSE. WHEREAS, the City Commission adopted Ordinance No. 10368 on January 14, 1988, amending Ordinance No. 10145, by appropriating trust and agency funds in the increased amount of $12,147,315 following the original appropriation Ordinance No. 8719 adopted October 26, 1977; and WHEREAS, a scrivener's error was made in the amounts additionally appropriated by Ordinance 10368 (namely $242,315), and amounts of $172,359 and $29,596 (totalling $2019955) should have been credited to the fifth (5th) and seventh (7th) year CDBG funds respectively as program income; and WHEREAS, said correct amounts are to be credited to the fifth (5th) and seventh (7th) years Community Development accounts in compliance with federal rules and regulations, as program income to fund other eligible activities; and WHEREAS, the herein ordinance is a proper vehicle to appropriate the aforesaid amount of $201,955; and IL0444 1 WHEREAS; the Building & Zoning Department has demolition of unsafe structure's planned on a Citywide basis; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. Section 1 of Ordinance No. 10368 adopted January 14, 19889 is hereby repealed in its entirety. Section 2. Section 1 of Ordinance No. 10145 adopted September 11, 1986, is hereby amended in the following particulars:1/ "Section 1. The following Trust and Agency Funds are hereby established and resources are hereby appropriated as described herein. FUND TITLE: COMMUNITY DEVELOPMENT BLOCK GRANT TWELFTH (12TH) YEAR RESOURCES: FEDERAL GRANT - U.S. DEPARTMENT OF HOUSING URBAN DEVELOPMENT ; ^"5^^^ 412 106i955 APPROPRIATION: COMMUNITY DEVELOPMENT BLOCK GRANT TWELFTH (12TH) YEAR ;;,995,9nn $12,106,955"' Section 3. The herein amended appropriation of $12,106,955 for Community Development refers to those publicly supported physical development activities and those related social or economic development activities being carried out within a reasonable period of time in accordance with the approved Grant Program Final Statement, said increased funds in the amount of $201,955, (as well as all future revenues likewise generated), are to be allocated for the Citywide Demolition of Substandard Building Project to be carried out by the Building and Zoning Department. Section 4. All ordinances or parts of ordinance insofar as they are inconsistent of in conflict with the provisions of this Ordinance are hereby repealed. Words and/or figures stricken through shall be deleted. Underscored words and/or figures shall be added. Remaining provisions are now in effect and remain unchanged. - 2 - 1 11 ",4 `kr�rh Section 5. The Building and Zoning Department" has demolition of unsafe structures planned on a Citywide basis. The above mentioned fifth and 'seventh year amounts were credited as program income. In order to make those. funds available for the Twelfth (12th) Year Citywide Demolition of Substandard Buildings Project Fund, it becomes necessary that they be allocated as budget funds.
