HomeMy WebLinkAboutO-10449J-88-285 3/29/88 ORDINANCE NO. 10449 AN ORDINANCE AMENDING THE ZONING ATLAS OF ORDINANCE NO. 9500, THE ZONING ORDINANCE OF THE CITY OF MIAMI, FLORIDA, BY CHANGING THE ZONING CLASSIFICATION OF APPROXIMATELY 2551 SOUTHWEST 27TH LANE, MIAMI, FLORIDA, (MORE PARTICULARLY DESCRIBED HEREIN) FROM RG-2/2 ONE FAMILY DETACHED -RESIDENTIAL TO RO-1/4 RESIDENTIAL -OFFICE BY MAKING FINDINGS; AND BY MAKING ALL THE NECESSARY CHANGES ON PAGE NO. 42 AND 43 OF SAID ZONING ATLAS MADE A PART OF ORDINANCE NO. 9500 BY REFERENCE AND DESCRIPTION IN ARTICLE 3, SECTION 300, THEREOF; CONTAINING A REPEALER PROVISION AND A SEVERABILITY CLAUSE. WHEREAS, the Miami Zoning Board, at its meeting of March 21, 1988, Item No. 2, following an advertised hearing, adopted Resolution No. ZB 28-88, by a seven to zero (7-0) vote, RECOMMENDING APPROVAL of a change of zoning classification, as hereinafter set forth; and WHEREAS, the City Commission after careful consideration of this matter deems it advisable and in the best interest of the general welfare of the City of Miami and its inhabitants to grant this change of zoning classification as hereinafter set forth; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The Zoning Atlas of Ordinance No. 9500, the zoning ordinance of the City of Miami, Florida, is hereby amended by changing the zoning classification of approximately 2551 Southwest 27th Lane, Miami, Florida, more particularly described as Lots 3 and 4, Block 1, SILVER BLUFF BUSINESS CENTER, as recorded in Plat Book 14 at Page 76 of the Public Records of Dade County, Florida, from RG-2/2 One Family Detached -Residential to RO-1/4 Residential -Office. Section 2. It is hereby found that this zoning classification change: If1h�.ri (a) Is in conformity with the adopted Miami Comprehensive Neighborhood Plan; (b) Is not contrary to the established land use pattern; (c) Will not create an isolated district unrelated to adjacent and nearby districts; (d) Is not out of scale with the needs of the neighborhood or the City; (e) Will not materially alter the population density pattern or increase or overtax the load on public facilities such as schools, utilities, streets, etc.; (f) Is necessary due to changed or changing conditions; M (g) Will not adversely influence living conditions in the neighborhood; (h) Will not create or excessively increase traffic congestion or otherwise affect public safety; (i) Will not create a drainage problem; (j) Will not seriously reduce light and air to adjacent area; (k) Will not adversely affect property values in the adjacent area; (1) Will not be a deterrent to the improvement or development of adjacent property in accord with existing regulations; (m) Will not constitute a grant of special privilege to an individual owner as contrasted with protection of the public welfare. Section 3. Page No. 42 and 43 of the Zoning Atlas, made a part of Ordinance No. 9500 by reference and description in Article 3, Section 300 of said Ordinance, is hereby amended to reflect the changes made necessary by these amendments. Section 4. All ordinances or parts of ordinances insofar as they are inconsistent or in conflict with the provisions of this ordinance are hereby repealed. Section 5. RECOMMENDATIONS PLANNING DEPARTMENT DENIAL. The proposed change would be in conTi ict with the. Miami Comprehensive Neighborhood Plan and would require a plan amendment. This area was analyzed during the 27th Avenue Study, "A Gateway to Coconut Grove" and after long meetings and deliberations with the community a definite demarcation line was established. The changes proposed and approved excluded this particular property. Properties facing South Dixie Highway with a direct access from SW 26th Avenue were included in the aforementioned study and were changed to RO-1/4 accordingly. The subject property faces SW 27th Lane which is a residential street. The proposed change would adversely influence living conditions in the neighborhood by creating an unjustified encroachment into the single family residential area. . PUBLIC WORKS No comments. DADE COUNTY PUBLIC WORKS No comments. ZONING BOARD At its meeting of March 7, 1988, the Zoning Board continued the above to March 21, 1988. At its meeting of March 21, 1988, the Zoning Board adopted Resolution 28-88, by a vote of 7-0, recommending approval of the above. Two replies in favor were received by mail. Four proponents and one opponent were present at meeting. CITY COMMISSION At its meeting of April 28, 1988, the City Com- mission passed the above on First Reading, accepting the voluntary proffer of a restrictive covenant to be presented by applicant at Second Reading.
