N14--f G11 A RESOLUTION AUTHORIZING PAYMENT TO THE LAW FIRM OF BLACKWELL, WALKER, FASCELL, AND HOEHL FOR FEES AND COSTS RELATED TO LEGAL SERVICES PROVIDED BY ROBERT N. SECHEN SERVING AS SPECIAL COUNSEL FOR THE DOWNTOWN DEVELOPMENT OF REGIONAL IMPACT PROJECT AND THE SOUTHEAST OVERTOWN/PARK WEST DEVELOPMENT OF REGIONAL IMPACT PROJECT WITH FUNDS THEREFOR NOT TO EXCEED $75,000 FOR FEES AND $3,200 FOR COSTS TO BE ALLOCATED FROM THE DOWNTOWN DEVELOPMENT SUPPLEMENTAL FEE SPECIAL REVENUE FUND ACCOUNT NO. 127001, AND WITH FUNDS THEREFOR NOT TO EXCEED $15,000 FOR FEES AND S650 FOR COSTS TO BE ALLOCATED FROM THE HUD SECTION 108 LOAN AND GENERAL OBLIGATION HOUSING BOND FUNDS FOR SOUTHEAST OVERTOWN/PARK WEST. WHEREAS, on April 10, 1986, the Commission adopted Resolution No. 86-272 waiving by 4/5 affirmative vote the prohibition against the City entering into a contract with a former City employee, Robert N. Sechen, within two years after leaving City employment; and WHEREAS, on April 10, 1986, the Commission adopted Resolution No. 86-273 authorizing the City Attorney to employ the professional services of Robert N. Sechen and the firm of Blackwell, Walker, Fasceil and Hoehl to perform legal services relative to the Southeast Overtown/Park West Development of Regional Impact and the Downtown Development of Regional Impact; and WHEREAS, the Downtown Development of Regional Impact Project and the Southeast Overtown/Park West Development of Regional Impact Project have required extensive legal services for a period of over three years due to their inherent complexity, changes in the state statutes, and appeals filed by the Florida Department of Community Affairs; and WHEREAS, funds to reimburse the City for legal expenses and other costs related to the preparation and approval of the Downtown Development of Regional Impact will be collected from new development pursuant to the Downtown Development Supplemental Fee; and WHEREAS, funding for legal services on the Southeast Overtown/Park West Development of Regional Impact project is included within the budget for the Southeast Overtown/Park West Community Redevelopment District from the HUD Section 108 Loan and General Obligation Housing Bonds; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: CITY COMMISSION MEETING OF JUL 14 198d RESOMION No. 190-664 REMARKS: I 4 1i Section 1. Payment is hereby authorized to the law firm of Blackwell, Walker, Fascell and Hoehl for fees and costs related to legal services provided by Robert N. Sechen serving as special counsel for the Downtown Development of Regional Impact Project and the Southeast Overtown/Park West Development of Regional Impact Project, with funds therefor not to exceed $75,000 for fees and $3,200 for costs to be allocated from the Downtown Development Supplemental Fee Special Revenue Fund Account No. 127001, and with funds therefor not to exceed $15,000 for fees and $650 for costs to be allocated from the HUD Section 108 Loan and General Obligation Housing Bond Funds for Southeast Overtown/Park West. Co-inunity ';edevelopnent project froi the H10 ',Potion i^? Loin ar;„I Obligation Housing Bond Funds. BACKGROUND: On npri1 In, I936 t!e Commission adopted Resolution Nus. R5-272 end Pr,-?7 authorizing the City Attorney to retain the services of .Robert. N. Sechen in connection with the Downtown DRI and the Southeast Overtown/?ark ':.lest DRI. Mr. Sechen had previously been an Assistant City Attorney, and had represented the City Attorney's Office on these ORI projects. The DRI projects for Downtown and Southeast Overtown/Park West have required extensive legal services during the three years since the process was begun. Both the City Attorney's Office and Mr. Sechen have participated throughout the process, including extensive work during the recent appeals filed by the Department of Coinrrunity Affairs. Considerable staff time and legal expenses have been saved by having the sane- persons representing both the %vintown and the Southeast Overtown/Park :42St DRI projects. Funding for the legal fees and costs for the Downtown DRI has been specifically included in the calculation of fees in the proposed Downtown Development Supplemental Fee ordinance and will be repaid from those fees as new development occurs in the downtown area. A temporary loan from the Brickell area Housing Trust Fund has been recommended to enable these legal expenses and other DRI/Master Plan expenses to be paid immediately. The. 515,000 in fees and S650 in costs attributable to Southeast Overtown/Park West is also included within the comnunity redevelopment project budget in the Department of Development.
