A RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE
AN AMENDMENT SUBSTANTIALLY IN THE FORM ATTACHED, TO
THE AGREEMENT DATED JUNE 19, 114,0,7, BETWEEN JOYCE A.
MEYERS AND THE CITY OF MIAMI FOR PROFESSInNAL PLANNING,
SERVICES IN CONNECTION WITH THE DOWNTOWN DEVELOPMENT
OF REGIONAL IMPACT AND MASTER PLAN, EXTENDING THE TERM
OF SAID AGREEMENT TO JULY 15TH, 1989, AND INCREASING
THE FEES BY AN ADDITIONAL $49,562 FOR THE PERIOD FROM
AUGUST 11, 1989 TO JULY 15TH, 1989; 14ITH FUNDS
THEREFOR AUTHORIZED TO BE EXPENDED FROM THE DOWNTOWN
DEVELOPMENT SUPPLEMENTAL FEE SPECIAL REVENUE FUND
ACCOUNT NO. 127001 IN THE AMOUNT OF $7,579, AND THE
PLANNING DEPARTMENT FY'88-99 OPERATING BUDGET IN THE
AMOUNT OF $41,984, SUBJECT TO AVAILABILITY OF FUNDS.
WHEREAS, the Commission adopted Resolution No. 87-504 on May 28, 1987
waiving by a 4/5ths affirmative vote the requirements contained in City Code
Section 2-302, and authorizing the City Manager to enter into an agreement for
professional planning services with Joyce A. Meyers, primarily in connection
with the Downtown Master Plan and Development of Regional Impact; and
WHEREAS, Joyce A. 'Meyers has effectively carried out responsibilities
under the agreement dated June 18, I987 and is uniquely qualified to continue
to coordinate the finalization and implementation of the Downtown Master Plan
and Development of Regional Impact; and
WHEREAS, the City of Miami has a vital interest in the completion of the
Downtown Master Plan and implementation of the Development of Regional Impact
development orders for Downtown and Southeast Overtown Park West; and
WHEREAS, the City Manager believes that it is in the best interest of the
City to Continue to engage a professional planner with sufficient expertise to
coordinate the finalization and implementation of the Downtown Master Plan
and Development of Regional Impact development for Downtown and Southeast
Overtown/Park West, working under the general supervision of the Planning
Director;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:

Section 1. the City Manager is hereby authorized to execute an
amendment, substantially in the form attached, to the Agreement dated June 18,
1997, with Joyce A. Meyers for professional planning services primarily in
connection with finalization and implementation of the Downtown Master
Plan/Development of Regional Impact Project, thereby extending the term of
said Agreement to July 15th, 1989, and increasing the fees by an additional
$49,562 for the period from August 11, 1988 to July 15th, 19R9; with funds
therefor authorized to be expended from the Downtown Development Supplemental
Fee Special Revenue Fund Account No. 127001 in the amount of $7,579, and the
Planning Department FY'89-89 operating budget in the amount of $41,984,
subject to availability of funds.

AMENDMENT NO. 1
An Amendment to the Agreement dated June 18, 1987, between the City of
Miami, hereinafter referred to as the "CITY" and Joyce A. Meyers, an
individual, hereinafter referred to as the "CONSULTANT".
RECITAL
WHEREAS, on June 18, 1987, the CITY executed an Agreement with the
CONSULTANT to provide professional planning services in connection with the
finalization and implementation of the Downtown Master Plan and Development of
Regional Impact; and
WHEREAS, the finalization and implementation of the Downtown Master Plan
and Development of Regional Impact requires the ongoing coordination of a
professional planner; and
WHEREAS, the City Commission adopted Resolution on
authorizing the City Manager to execute this amendment to the Agreement with
Joyce A. Meyers; and
WHEREAS, funds in the amount of $7,578 are available in the Downtown
Development Supplemental Fee Special Revenue Fund for the period from August
15, 1988 through July 15, 1988; and funds in the amount of $41,984 are
programmed in the FY'88-89 Planning Department operating budget to be
reimbursed from the Downtown Development Supplemental Fees;
NOW, THEREFORE, in mutual consideration of the covenants made herein and
in the Agreement of which this is an amendment, the parties hereto understand
and agree as follows:
1. I. TERM: shall be amended as follows:
The term of this Agreement shall be from June 15, 1987,
through July 15, 1982 1989.
2. III. COMPENSATION: shall be amended as follows:

A. C'TY shall pay the consultant, as maximum compensation for
services required pursuant to Paragraph II hereof, $48,831,
allocated as $12,277 for the period of June 15, 1987 -
September 30, 1997 and S36,554 for the period October 1,
1987 - September--30-,— 1988 August 10, 1988, and $49,562
allocated as $7,578 for the period of August 11, 1988 -
September 30, 1988 and $41,984 for the period of October 1,
1988 - July 15, 1989.
B. Such compensation shall be paid on the following basis:
A fee of S40.96 per hour for the period of June 15, 1987
through 5e-ptamhar-30,-1980 August 10, 1988; and a weekly
fee of $1,024 for the period from August 11, 1988 to July
15, 1989. This fee will be paid on a biweekly basis.
Payment of all taxes and expenses such as income tax,
social security, health and major medical insurance,
personal insurances and general expenses of any kind not
provided for in this Agreement will be the responsibility
of the CONSULTANT.
The CONSULTANT shall provide part-time services during the
normal working hours of the CITY plus attending occasional
evening meetings required to carry out the responsibilities
set forth above (average 17 hours per week for the period
June 15, 1987 through August 10, 1988, and as necessary but
no less than 25 hours per week for the period August 11,
1988, through July 15, 1989).
3. It is further understood that all the terms and conditions outlined
under the original Agreement will remain in full force and effect without
modification except as herein stated.
IN WITNESS WHEREOF, the parties hereto have caused this instrument to be
executed by the respective officials thereunto duly authorized.

It is respectfully recommended that the Commission approve the attached
resolution authorizing the City Manager to execute ar. amendment `o `he
agreement dated June 1_3, 1997, between Joyce A. Meyers and the City of tiiami
for professional planning services in connection with the Downtown Development
of Regional Impact and Master Plan, extending the. term of said agreement to
September 30, 1989, and increasing the fees by an addition?1 550,825 for the

funds.
BACKGROUND:
The Commission adopted Resolution No. 87-504 on May 28, 1987, approving a
consultant contract with Joyce A. Meyers to provide professional planning
services in connection with the Development of Regional Impact and Plaster Plan
project. Ms. Meyers had previously worked for over 11 years as s full time
City employee in the Planning Department. The consultant contract was
recommended by the Planning Director due to the Planning Department's need to
retain Ms. Meyer's considerable experience and expertise as Project Manager
for the Downtown Development of Regional impact and Master Plan project and
Ms. Meyer's desire to work on a part-time basis due to family considerations.
Implementation and enforcement of the Downtown and the Southeast Overtowr/Park
.Jest Development of Regional Impact Development Orders and the finalization
and implementation of the Downtown Master Plan will require the on -going
services of Ms. Mef rs. Therefore it is recormended that the term of the
existing contract be extended by one year, and additional funding be
authorized.
The existing contract budget for an average of 17 hours of work per week has
proven to be insufficient to carry out the project responsibilities; thus, the
existing contract funding will be totally expended approximately 7 weeks prior
to the expiration of the existing contract on September 30, 1988. The
contract amendment includes a budget for up to 25 hours of work per week, for
the 7 weeks remaining prior to September 30, 1988, plus at least 25 hours per
week for 52 weeks during the one year contract extension fron September 30,
1988 to September 30, 1989. Please recall that the original contract, now to
be extended, excludes all fringes such as sick leave and vacation.

Funding for the 7 weeks prior to September 30, 1989, in the amount of $7,578,
and funding for the period from October 1, 1989 to September 30, 1989, are
projected to be reimbursed from administrative fees collected frost new
development in the downtown area pursuant to the Downtown Development
Supplemental Fee and the Southeast Overtown/Park West Development Supplemental
Fee ordinances, which are scheduled for approval on second reading on July 14,
