WHEREAS, on November 19, 1987, the City Commission adopted
Capital Improvement Project Ordinance No. 10347, establishing a
Capital Project entitled "Scattored Site Affordable Housing
Development Program," Project No. 321034 and appropriated funds
in the amount of $3,n97,800 from Special Obligation Bonds-1986
Series A proceeds for the purpose of providing construction
financing for the Program; and
WHEREAS, the construction of the two (2) single family homes
planned i,i Uis-, Community Development Target trea is
estimated at a totat development cost of $90,000;
NOW, THEREFORE BE IT RESOLVED BY THE COMMISSION OF 'rHE CITY
OF MIAMI, FLORIDA:
Section 1. The City Manager is hereby authr.)rized to request
bids from private contractors for the construction of two (2)
single family owner -occupied housing units to be developed on
City -owned lots 34 and 35 at 49 Northwest 35th Street in the
Wynwood neighborhood.
Section 2. The City Commission hereby designates the
Wynwood Housing Project as a set aside for small Hispanic
contracting firms in accordance with the provisions of Ordinance
No. 10062.
Section 3. Special Obligation Bonds-1986 Series A proceeds
in the amount of $90,000 is hereby allocated to fund the cost of
constructing the above mentioned single family homes.
Section 4. The City Commission hereby authorize the City
Manager to waive the requirement for the successful bidder to
secure performance bonding for the units construct i<_)fr of t.11e two
single family homes planned in the Wynwood neighborhood.

for furnishing office supplies] We have added language
in the body of the Resolution to reflect that in those
instances where a minority vendor and a non -minority
vendor submitted bids in the identical amount, the
award is being made to the minority vendor; likewise,
where identical bids have been submitted by a Dade
County vendor and a non -Dade County vendor, the award
is being made to the Dade County vendor.
agenda item #16 (J-88-635) [Resolution accepting bid
for furnishing and installation of playground
equipment] The allocation of specified amounts from
the various project accounts for this contract to
purchase and install park equipment in 18 City parks
has been modified to reflect that the allocations are
maximum amounts. The modification was made because the
total proposed contract cost is less than the allocated
amount in the Resolution that was distributed in the
Packet.
Agenda Item •28 (J-88-645) [Resolution declaring a
previously awarded bidder in default and accepting next
lowest bid] This Item involves a bidder, who after
being awarded a contract for the construction of this
Virginia Key Lifeguard project. simply did nothing (not
even executing the contra.,it documents). As
distributed. the Resolution would have rescinded the
earlier awarding Resolution (No. 88-197, 3/10/88).
However. we have modified the proposed Resolution to
expressly declare. --the previously successful bidder to
be in default. A ccpy of the substitute Resolution is
attached.

BACKGROUND:
The- Housing Conservation and Development Agency recommends
ratification of thl�. rt-s-)lution authorizing the City Manager
to request bids from private contractors for the construction of two
(2) single family homes planned for development on two (2) City -
owned lots located in the Wynwood neighborhood. It is further
recommended that the City Commission approve the City ilanager's
recommendation designating the Wynwood project as a set-,3si:le Eor
small Hispanic general contractors, in accordance with Ordinance N_3—
10062, in addition to allocating $90,000 in Special Obligation
Bonds, 1986 Series A proceeds to fund the cost of constructing the
two (2) single family homes planned.
Among Miami's greatest nta.eds in the housing area is the need for
sales housing within the affordability range of low arid moderate
income families, those with annual 't(i,:,)mes ranging from $15,150 to
$35,625. The costs of land, materials, and labor in the Miami
housing market. place effectively preclude the development of single
family homes within the purchasing power and affordability range of -
the City's low and moderate income residents by the private housing
industry.

In an attempt to address this trainendous need for new affordable
homeownership opportunitie.; for low and moderate income City
residents, the City Commission approved in October of 1986. the
implementation of the City's sponsored Scattered Site i>>;5iig
Development and affordable Homeownership Opportunity Program. With
the City of Miami serving as developer, it will be possible for. the
City to construct and deliver new single family residential units at
sales prices to low and moderate income purcha3ers in the
City's Community Development Target Areas.

that the City Commission approve designating the Wynwood Housing
Project as a set -aside for small Hispanic general contracting firms

be pre -qualified and only firms with gross annual incomes of

$200, 000. It is estimated that the total cost of constructing the
two homes planned is estimated at approximately $90,000. It is
recoinmende:l that application of the aforementioned provisions be
granted to the Wynwood Housing Pr;)joct as a means of insuring
additional cost -savings in the delivery of the two single family
lioines being proposed.

unit. Approximately $90,000 in Special Obligation Bona proceeds are
being recommended to fund the cost of ,lirLs .ruction and other related

City Commission ratification of the ;itr_4-31 resolution is
recommended.

RECOMMENDATION
It is recommended that the City Manager designate an upcoming
Housina Conservation and Development Aaency Project, the b+lildina of
two (2) single family homes on Lots 433 and 434 at 49 N.W. 35 Street
as a set -aside for small, Hispanic general contractors.
SET -ASIDE JUSTIFICATION
Ordinance 010062, Minority/Women Business Affairs and Procurement
Proaram Ordinance, reliuires that two conditions exist to justify a
set -aside recomnenaation. The first, that the cl:rnt I of
procurement with the City of Miami be below seventeen percent (17%),
has been met. As of February 29, 1988 Hispanic construction awards
totalled S4,452,800. Justification for makina this request for
small Hispanic owned general contracting firms is that this total
reoresents thr-ee contracts to lar ae 'iispanic firms who wool(' not be
bidding on this project, estimated at approximately S30,000. if
approved, bidders would be pre -qualified and only firms with cross
annual incomes of $lmil annually or 'Less would be eligible to bid.
Female Hispanic firms, registered as female, but meeting the
criteria of less than $lmil in gross annual sales will be pre -
qualified and allowed to bid.
The second rea_uirement is that there be a sufficient number of firms
available to provide combetitive biddino. The %1inority/;,;oin, en
Business Affairs Coordinator has verified that this condition has
been satisfied and, should you approve this set -aside, will invite
small Hispanic firms registered with the City of Miami to become
pre -qualified prior to bidding and will certify the successful low
bidder.
Resolution No. 86-983 provides for the Minority/Women Procurement
Coordinator to provide Bid Bond Vouchers for qualified
minority/women owned firms and authorizes you to waive performance
bonding for projects under $200,000. This recomme at -ion includes
