A RESOLUTION DECLARING THE CONTRACT BETWEEN THE CITY OF MIAMI AND URBAN SOUTH, INC., FOR THE PROJECT ENTITLED "VIRGINIA KEY IMPROVEMENTS - LIFEGUARD FACILITIES", TO BE IN DEFAULT; FURTHER ACCEPTING THE BID OF TARAFA CONSTRUCTION, INC., IN THE AMOUNT OF $31,555.00, FOR VIRGINIA KEY IMPROVEMENTS - LIFEGUARD FACILITIES, WITH MONIES THEREFOR ALLOCATED FROM THE CAPITAL IMPROVEMENTS PROGRAM ORDINANCE NO. 10347, AS AMENDED, PROJECT NO. 331044 IN THE AMOUNT OF $31,555.00 TO COVER THE CONTRACT COST; AUTHORIZING THE CITY MANAGER TO EXECUTE A CONTRACT WITH THE FIRM OF TARAFA CONSTRUCTION, INC. FOR SAID PROJECT. WHEREAS, sealed bids were received February 18, 1988, for VIRGINIA KEY IMPROVEMENTS - LIFEGUARD FACILITIES; and WHEREAS, after determination of the low bidder, a contract was awarded to Urban South, Inc., in the amount of $21,455.00 for oonstruction of said project, by Resolution No. 88-197, dated March 10, 1988; and WHEREAS, four months have elapsed since the bid was accepted from Urban South, Ino., by the City Commission, and Urban South, Inc. has been unable to successfully execute the contract documents in compliance with City requirements; and ' WHEREAS, the City of Miami is committed to the renovation of the recreational areas at Virginia Key, including the lifeguard facilities; and WHEREAS, Tarafa Construction, Inc., the second lowest responsible and responsive bidder, has indicated to the City a willingness to undertake construction for the same bid price said firm originally submitted, and said bid price is within budget; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The contract with Urban South, Inc., in the proposed amount of $21,455.00 for VIRGINIA KEY IMPROVEMENTS - LIFEGUARD FACILITIES is hereby declared to be in default. The February 18, 1988 bid of Tarafa Construction, Inc., in the proposed amount of $31,555.00, for the project entitled "VIRGINIA KEY IMPROVEMENTS - LIFEGUARD FACILITIES", for the base bid of the proposal, based on lump sum prices, is hereby accepted at the price stated therein. Section 3. The amount of $31,555.00 is hereby allocated from Capital Improvements Program Ordinance No. 10347, as amended, Project No. 331044, to cover the cost of said contract. Section 4. The City Manager is hereby authorized to enter into a contract on behalf of the City of Miami with Tarafa Construction, Inc., for VIRGINIA KEY IMPROVEMENTS - LIFEGUARD FACILITIES, base bid of the proposal. Agenda item #16 (J-88-635) [Resolution accepting bid for furnishing and installation of playground equipment] The allocation of speoified amounts from the various project accounts for this contract to purchase and install park equipment in 18 City parks has been modified to reflect that the allocations are maximum amounts. The modification was made because the total proposed contract cost is less than the allocated amount in the Resolution that was distributed in the Packet. Agenda item e29 (J-88-645) [Resolution declaring a previously awarded bidder in default and acoepting next lowest bid] This Item involves a bidder, who after being awarded a contract for the construction of this Virginia Key Lifeguard project, simply did nothing (not even executing the contract documents). As distributed, the Resolution would have rescinded the earlier awarding Resolution (No. 88-197, 3/10/88). However, we have modified the proposed Resolution to expressly deolare--the previously successful bidder to be in default. Agenda Item #36 (J-88-650) [Resolution authorizing a contract to increase existing Revolving Loan Fund] The title to this Resolution has been modiLUd to reflect the provision of $190.000 for &dmjffMtTUive operations of Miami Capital Development, Inc. As distributed the allocation, although expressly set forth in Section 2 of the Resolution body, was not reflected in the title. Agenda Item #39 (J-88-696) [Resolution rescinding portion of previously adopted Resolution, allocating funds, approving guidelines for pilot program and authorizing contracts] There were unsubstantial changes made in the title as well as the body of this Resolution as distributed which Resolution formalizes action taken by you at the Meeting of June 23, 1988 in regard to the Citywide Business Development Pilot Program. Agenda item #42 (J-88-655) [Resolution authorizing amendment to Revocable Use Permit for the United States Yacht Racing Union] Our office is reviewing the unified development process which is being applied to the parcel of land involved in this Item. Pending that review, we request that your consideration of this Item be deferred until the next Commission Meeting of July 21st. Agenda item #50 (J-88-687) [Resolution authorizing request for bids and allocation of funds for construction of housing units] We have added language in the title of this Resolution to reflect the fact that the contract will be awarded on the basis of a minority set -aside and that the performance bond is being waived as;is reflected in the body of the Resolution. 94-64 Honorable Mayor and Members July 14, 1088 of the City Commission page 3 agenda item #53 (J-88-670) (Resolution approving and establishing reimbursement to City for construction of housing project) Attached for reference you will find a reimbursement schedule for repayment of the City's site acquisition cost for the Civic Center Site housing project which is the subject of this Item and which was previously approved by Motion 88-182 on 2/25/88. The Schedule was not included in the material that was distributed in the Agenda Packet. Copies of the motion and schedule are attached. Agenda Item #60 (J-88-674) (Resolution authorizing use of streets for a running event) A last minute change in the local sponsor of this September 11, 1988 event necessitated a modification of the Resolution as distributed. Attached is a substitute Resolution reflecting that the Miami Runners Club is the new sponsor for the Sports Aid '88 race to be run in Coconut Grove instead of Downtown Miami. Agenda Item #62 (J-88-695, J-88-695A) (Emergency Ordinance increasing fees for reproduction of records and services) This Item as distributed consists of an emergency ordinance which not only would increase fees for reproduction of copies of Building and Zoning Department records but also increase fees for other department services and for certificates issued by that Department. In order to satisfy the requirements of law pertaining to "single subject" legislation, we have drafted = ordinances which treat the reproduction fee increase separately from the increase in other fees.
