A RESOLUTION CONCERNING, THE GUSMAN CENTER FOR
THE PERFORMING ARTS SEASON OPENER TO BE
CONDUCTED BY THE GUSMAN CULTURAL CENTER ON
SEPTEMBER 7, 1988; PROVIDING FOR THE CLOSURE OF
DESIGNATED STREETS TO THROUGH VEHICULAR TRAFFIC
SUBJECT TO THE ISSUANCE OF PERMITS 13Y THE
DEPARTMENTS OF POLICE AND FIRE, RESCUE AND
INSPECTION SERVICES; ESTABLISHING AN AREA
PROHIBITED TO RETAIL PEDDLERS DURING THE PREIOD
OF THE EVENT; CONDITIONED UPON THE REQUIREMENT
THAT THE CITY WILL 13E INSURED AGAINST ANY
POTENTIAL LIABILITY AND UPON THE ORGANIZERS
PAYING FOR ALL NECESSARY COSTS OF CITY SERVICES.
WHEREAS, the Gusman Center for the Performing Arts will
conduct the Gusman Cultural Center Season Opener on September 7,
1988; and
WHEREAS, certain streets must be closed to through vehicular
traffic during specified hours to ensure the safety of participants
and attendees; and
WHEREAS, the organizers have requested that retail peddlers be
restricted in the area during the period of the event;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. In order to effectuate safe passage and establish
a temporary pedestrian mall during the Gusman Center Season Opener
to be conducted by Gusman Center for the Performing Arts the
following streets are hereby closed to through vehicular traffic
from 10:00 A.M. to 2:00 P.M. on September 7, 1988 as specified
below:
East Flagler Street from Second Avenue to First Avenue
Included in the herein closure are all streets,
avenues, alleys, ways and thoroughfares which
intersect the enumerated areas delineated in this
Section.

Section 2. Such closing of streets is subject to State
approval and issuance of permits by the Departments of Police an-1
Fire, Rescue and Inspection Services. Said permit from the
Department of Police is to be issued upon full approval of the
Chief of Police after giving all due consideration to the safety
and traffic needs of resicients, businesses, and religious
institutions in the area for entering and crossing through said
arterials and upon the favorable exercise of the City Manager's
judgement pre(iicated upon all factors set forth herein.
Section 3. Pursuant to the provision of City Code Section 39-
13, all retail peddlers' occupational licenses issued under the
provisions of Chapter 31 of the City Code, as amended, will not be
valid on September 7, 1988 during the hours of 10:00 A.M. and 2:00
P.M. on the above designated streets and on all intersecting
streets for two blocks in all directions.
Section 4. Such authorizations are hereby subject to the
organizers obtaining insurance requirements as mandated by the City
of Miami and paying for all necessary costs of City services.

ENCLOSURES
It is respectfully recommended that the City Commission adopt the
attached resolution authorizing the closure of certain streets an,?
the restriction of retail peldlers in the area in connection wit'li
the Gusman Center Season Opener to be conducted by the Gusman
^enter for the Performing Arts on September 7, 1988 subject to the
issuance of permits by the Departments of Police and Fire, Rescue
ant Inspection Services and the requirement that the City be
insured against any potential liability. This authorizati o+z is
contingent upon the organizers paying for the cost of City services
for said event.
BACKGROUND:
The Department of Community Development has pr.epare,l the
appropriate legislation for the street closures and the restriction
of retail neidlers in the area in connection with an event to be
conductedl by Gusman Center for the Performing Arts on September 7,
1988.
The event is to launch the #q88-89 Season at the Gusman Cultural
Center. The festivities will include High School hands, speeches
and the release of balloons.
