A RESOLUTION AUTHORIZING THE DIRECTOR OF
FINANCE TO PAY TO CHARLES MATHER AND HIS WIFE
PAMELA, WITHOUT THE ADMISSION OF LIABILITY
THE SUM OF $36,000.00 IN FULL AND COMPLETE
SETTLEMENT OF ANY AND ALL CLAIMS AND DEMANDS
AGAINST THE CITY OF MIAMI, FLORIDA, UPON THE
EXECUTION OF A RELEASE, RELEASING THE CITY ON
MIAMI FROM ANY AND ALL CLAIMS AND DEMANDS.
WHEREAS, CHARLES MATHER AND PAMELA, his wife, filed a claim
against the City of Miami for alleged bodily injury, resulting
from an accident on May 6, 1986, at or near Northeast 2nd Avenue
and Northeast 30th Street; and
WHEREAS, the above claim has been investigated by the Claims
Division of the City Attorney's Office in accordance with
Ordinance No. 8417, as amended, which created the City of Miami's
Self_ Insurance Program, and said office recommends that this
claim be settled for the sum of $36,000.00;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE
CITY OF MIAMI, FLORIDA:
Section 1. The Director of Finance is hereby authorized to
pay to CHARLES MATHER AND PAMELA, his wife, without the admission
of liability, the sum of $36,000.00 in full and complete
settlement of any and all bodily injury claims and demands
against the City of Miami, Florida, upon the execution of a
release, releasing the City of Miami from all claims and demands.
PASSED AND ADOPTED this 14th day of July 1988.

Charles Mather Claim

It is respectfully recommended that the City Commission approve
the attached proposed resolution so that this bodily injury claim
can be settled.
BACKGROUND
Mr. Charles Mather
filed a claim against the
City
of Miami
involving personal
injuries allegedly received
in an
accident
which occurred at 5:52 p.m. on May 6, 1986, at
the location of
N.E. 2nd Avenue and
30th Street in Miami, Florida.
The
accident
occurred while the
claimant's vehicle was
stopped
heading
southbound on N.E.
2nd Avenue about to make
a left
turn to
proceed east on ^?.F.
30th Street when it ias struck in
the rear
by a marked City of
Miami Police vehicle.
As a result of this accident, Mr. Mather sustained a herniated
disc. - The primary physician was Dr. Steven Lawyer, D.O. A
permanent injury rating of 20% was given. The total medical
expenses were S6,200.32. All medical expenses have been verified
as to being correct and reasonable. This claim can be settled
for $36,000.00.
The claim has been investigated by the City Attorney's office and
in accordance with the resolution which created the City of
Miami's Self -Insurance Program and our office recommends thaf- the
City of Miami pay S36,000.00 in full settlement of this claim
because of the liability exposure.
