AN ORDINANCE AMENDING SECTIONS 35-91, 35-92, 35-93, AND
53-161(3) OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS
AMENDED, BY ESTABLISHING RATES AT CERTAIN ON -STREET
PARKING METERS AND CERTAIN OFF-STREET LOTS; ESTABLISHING
RATES AT MUNICIPAL PARKING GARAGES; FURTHER PROVIDING AN
EFFECTIVE DATE OF OCTOBER 1, 1988 FOR THE HEREIN RATE
INCREASES; RATIFYING AND CONFIRMING ALL ACTS OF THE
OFF-STREET PARKING BOARD AND ITS DIRECTOR AS TO RATES
HERETOFORE CHARGED; FURTHER AUTHORIZING THE OFF-STREET
PARKING BOARD TO DEVELOP EXPERIMENTAL RATE STRUCTURES AND
TO INITIATE RATES FOR NEW FACILITIES DURING THE FISCAL
YEAR; APPROVING A PROJECTED ANNUAL OPERATING REVENUE
INCREASE OF SIX (6%) PERCENT INSTEAD OF THE PROPOSED FOUR
(4%) PERCENT INSTALLATION OF ADDITIONAL PARKING METERS AS
PROPOSED BY SAID BOARD IN ITS CURRENT FIVE YEAR STRATEGIC
AND FINANCIAL OPERATIONS PLAN; REQUIRING ADVANCE CITY
COMMISSION APPROVAL FOR ANY TRANSFER OF FUNDS IN EXCESS OF
$5,000 BETWEEN LINE ITEMS IN THE ANNUAL BUDGET OF THE
DEPARTMENT OF OFF-STREET PARKING FOR THE FISCAL YEAR
ENDING SEPTEMBER 30, 1989; CONTAINING A REPEALER PROVISION
AND A SEVERABILITY CLAUSE.
WHEREAS, the Off -Street Parking Board of the City of Miami, on April 27,
1988, instructed the Director to submit an ordinance to the City Commission
that parking ra•:es be changed in certain on -street parking areas, in certain
off-street parking lots and that rates be changed at the Municipal Parking
Garages;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. Sections 35-91, 35-92, 35-93, and 53-161(3) of the Code of
the City of Miami, Florida, as amended, are hereby further amended in the
following particulars:)
"Sec. 35-91. On -street parking meters.
The rate of charge for parking in metered spaces in on -street parking
meter zones, except as otherwise provided herein, is as follows:
1/ Words and/or figures stricken through shall be deleted. Underscored

words and/or figures shall be added. Remaining provisions are now
in effect and remain unchanged. Asterisks indicate omitted and
unchanged material.
NOTE: Rate changes herein shall be effective as of October 1, 1988.

Section 2. The Off -Street Parking Board is authorized to develop
experimental rate structures and to initiate rates for new facilities during
the fiscal year. Experimental rates may not vary from the rates approved by
the City Commission by an amount in excess of 20 percent. The experimental
rates may only be initiated based upon unexpected variations in utilization or
changes in environmental factors not expected at the time of approval of this
Ordinance. Rates established under this provision must be approved by

resolution of the Off -Street Parking Board and written notification must be
given to the City Manager ten (10) days before implementation.
Section 3. All acts of the Off -Street Parking Board and its
Director as to rates heretofore charged are hereby ratified and confirmed.
The City Commission hereby approves a projected annual operating revenue
increase of six (6%) percent instead of the proposed four (4%) percent
increase and hereby disapproves the projected installation of additional
parking meters as proposed by the Board in its current Five Year Strategic and
Financial Operations Plan. Further, in the implementation of the annual
budget of the Department of Off -Street Parking for the Fiscal Year ending
September 30, 1989, advance City Commission approval is required for any
transfer between line items in said budget of monies in excess of $5,000.
Section 4. The provisions of this Ordinance shall take effect on October
1, 1988.
Section 5. All ordinances or parts of ordinances insofar as they are
inconsistent or in conflict with the provisions of this Ordinance are hereby
repealed.
Section 6. If any section, part of section, paragraph, clause, phrase, or
work of this Ordinance is declared invalid, the remaining provisions of this
Ordinance shall not be affected. This Ordinance shall be operative and the
provisions thereof, unless otherwise indicated herein, shall become effective
in accordance with City Charter provisions.

Attached for the City Commission's review. is an ordinance amending Sections
35-91, 35-92, and 35-93 of the City Code in order to revise rate structures for
on -street and off-street public parking facilities within the City of Miami.
The Ordinance has been prepared in order to simplify existing rate structures
and provide a consistency in rate applications by geographic area through the
City of Miami. For on -street parking (meters) only four rates are proposed
($.25/hr, $.50/hr, $.75/hr, and $1.00/hr) as compared to the current eight
rates.
Amendments have also been proposed to standardize rates for garage parking.
Currently some Department garages are fifty cents per one-half hour while
others are $1.00 per one-half hour. It is recommended that all garages be
$1.00 per one-half hour (which includes State sales tax). Early -Bird Specials
and All -Day rates would also be standardized bringing them to $5.00 and $8.00
respectively for parking garages managed by the Department of Off -Street
Parking with the exception of Bayside. Rates have also been reviewed for
Department lots and similar amendments have been proposed in part to achieve
simplification but also in response to market conditions since changes to the
Rate Ordinance have not been made since 1985.
The primary purpose of these revisions to the Rate Ordinance is to bring
simrlificatlon and consistency to the rate structure. These changes would also
result in a cost savings in maintenance and administration, as well as
increased revenues to the Department in order to fund important projects
comprised in the Five Year Strategic and Financial Operations Plan by the City
Commission, these rates would be. scheduled to go into effect October_1, 1988.
