HomeMy WebLinkAboutO-10457J-88-681 6/29/88 ORDINANCE NO. 10457 AN EMERGENCY ORDINANCE AMENDING SECTIONS 1 AND 6 OF ORDINANCE NO. 10321, ADOPTED SEPTEMBER 22, 1987, THE ANNUAL APPROPRIATIONS ORDINANCE FOR THE FISCAL YEAR ENDING SEPTEMBER 30, 1988, BY INCREASING THE APPROPRIATIONS TO THE DEPARTMENT OF PARKS, RECREATION AND PUBLIC FACILITIES BY $135,000 FOR THE OPERATING BUDGET OF THE BAYFRONT PARK MANAGEMENT TRUST, AND BY INCREASING REVENUES IN THE SAME AMOUNT FROM THE SUNSHINE STATE BOND POOL PROCEEDS - INTEREST EARNINGS, CONTAINING A REPEALER PROVISION AND A SEVERABILITY CLAUSE. WHEREAS, the City Commission adopted Ordinance No. 10348 on November 19, 1987, establishing the Bayfront Park Management Trust; and WHEREAS, said Trust is responsible to direct, operate, manage and maintain all aspects of the City's Bayfront Park; and WHEREAS, by direction of the City Commission and City Manager, the Department of Parks, Recreation and Public Facilities presently provides all maintenance for said park and the Trust operates the amphitheatre located therein; and WHEREAS, the City Commission adopted Resolution No. 88-399 on May 12, 1988, approving a budget in the amount of $135,000 for the operation of the Trust through September 30, 1988; and WHEREAS, funds in said amount are available from the Sunshine State Bond Pool Proceeds - Interest Earnings; and WHEREAS, funds in the amount of $50,000 have already been paid out of the current operating budget of the Department of Parks, Recreation and Public Facilities to the Trust so as to provide initial start-up funds for the Amphitheatre on an emergency basis; and WHEREAS, it is now necessary that funds in the amount of $135,000 be appropriated into the FY'88 operating budget of the Department of Parks, Recreation and Public Facilities to replace 1Q457 funds previously spent and so that funds can be properly paid out to the Trust in accordance with their line item budget; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. Sections 1 and 6 of Ordinance No. 10321 adopted September 22, 1987, the annual appropriations ordinance for the fiscal year ending September 30, 1988, are hereby amended in the following particulars: 1/ "Section 1. The General Fund is hereby increased by $135,000 from non -revenues for the purpose of providing additional funds through the Department of Parks, Recreation and Public Facilities for operating expenses of the Bayfront Park Management Trust. Section 3. All ordinances or parts of ordinances insofar as they are inconsistent or in conflict with the provisions of this ordinance are hereby repealed. Section 4. If any section, part of section, paragraph, clause, phrase, or word of this ordinance is declared invalid, the remaining provisions of this ordinance shall not be affected. Section 5. This Ordinance is hereby declared to be an emergency measure on the grounds of urgent public need for the preservation of peace, health, safety, and property of the City of Miami and upon the further grounds of the necessity to make the required and necessary purchases and payments, and to generally carry out the functions and duties of municipal affairs. Section 6. The requirements of reading this Ordinance on two separate days is hereby dispensed with a vote of not less than four-fiths of the members of the Commission. Odio City Manager ENCLOSURES: Recommendation FILE: Increase to Annual Appropriations Ordinance for Bayfront Park Management Trust It is respectfully recommended that the City Commission adopt the attached -emergency ordinance which amends the Annual Appropriations Ordinance by increasing the General Fund budget by $135,000 to provide the necessary funds for the operations of.the Bayfront Park Management Trust through the Department of Parks, Recreation and Public Facilities. These monies are to be provided by the Sunshine State Bond Pool Proceeds Interest Earnings Background The Department of Parks, Recreation and Public Facilities prepared the .attached legislation. On November 19, 1987, the City Commission adopted Ordinance No. 10348 to establish the Bayfront Park Management Trust, giving the Trust the responsibility to direct, operate, manage and maintain Bayfront Park. During its meeting of May 12, 1988, the City Commission passed Resolution No. 88-399 which approved the Trust's operating budget through September 30, 1988, in the amount of $135,000. At that time, it was directed that the Department of Parks, Recreation and Public Facilities continue to maintain the park property, while the Trust would concentrate its efforts on the running of the Amphitheatre. Subsequently, the Department of Facilities provided $50,000 from as a loan to the Trust as Amphitheatre operations. Parks, Recreation and Public its own FY'88 operating budget emergency start-up funds for The attached Ordinance formally appropriates the $135,000 operating budget of the Trust into the City's FY'88 Operating Budget. Funds are to be provided from Sunshine State Bond Pool Proceeds - Interest Earnings through the Department of Parks, Recreation and Public'Facilities. The Ordinance is requested as an emergency measure so that the Bayfront Park Management Trust has operating capital through the remainder of this fiscal year. 10457
