A RESOLUTION OF THE MIAMI CITY COMMISSION WAIVING THE TWO (2)
TEMPORARY EVENT LIMITATION PER YEAR FOR THE PRIVATE PROPERTY
LOCATED AT 2516 NW 2 AVENUE, MIAMI, FLORIDA PURSUANT TO CHAPTER
62/ARTICLE XIII/DIVISION 1/SECTION 62-521(13)(4) OF THE CODE OF THE CITY OF
MIAMI, FLORIDA, AS AMENDED, TITLED "PLANNING AND ZONING/PLANNING
AND ZONING APPROVAL FOR TEMPORARY USES AND OCCUPANCIES; PERMIT
REQUIRED/TEMPORARY EVENT PERMITS/TEMPORARY EVENTS IN GENERAL",
TO ALLOW FOR THE LE DINER EN BANC MIAMI EVENT TO TAKE PLACE ON
MARCH 31, 2023.
WHEREAS, pursuant to Section 62-521 of the Code of the City of Miami, Florida, as
amended ("City Code"), titled "Temporary Events in General", temporary events are limited to
no more than two (2) events per year per property for a maximum of two (2) weeks per permit;
and
WHEREAS, pursuant to Section 62-521(b)(4) of the City Code, the number of events
can be waived upon affirmative vote of the City Commission; and
WHEREAS, the property located at 2516 NW 2 Avenue ("Event Site") wishes to host Le
Diner en Banc Miami ("DEB Event") which is a picnicking event held in 40 cities throughout the
United States where participants can bring their own food or order for onsite pickup from a DEB
Event vendor and spend the evening in their community with their fellow community residents;
and
WHEREAS, there were prior temporary events held on February 24-26, 2023 and on
March 4, 2023 at the Event Site; and
WHEREAS, the DEB Event at the Event Site will require permits to be issued by the City
of Miami ("City") to ensure life -safety, quality of life issues and appropriate conditions may be
imposed on each permit; and
WHEREAS, the DEB Event at the Event Site will be beneficial to the City's residents;
and
WHEREAS, in accordance with Section 2-33(f) of the City Code, the City Commission,
by a majority vote, hereby deems this Resolution to be of an emergency nature due to the
timing of the Event and the necessary actions to take place beforehand;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. Pursuant to Section 62-521(b)(4) of the City Code, titled "Temporary Events
in General", the two (2) temporary event per year per property limitation is hereby waived to
allow the DEB Event at the Event Site on March 31, 2023.
Section 3. This Resolution does not waive any other requirements of the City Code,
including but not limited to, noise restrictions, applicable fees, inspections, and permits.
Section 4. This Resolution shall become effective immediately upon its adoption.
