A RESOLUTION CONCERNING THE 1988 MIAMI
CITYFAIR TO BE CONDUCTED DECEMBER 2-11, 1988
IN BICENTENNIAL PARK AND ON THE BAYWALK IN
BAYFRONT PARK AND ON THE F.E.C. PROPERTY;
APPROVING THE APPLICATION FOR A TEMPORARY
SPECIAL EVENT, CLASS B SPECIAL PERMIT FOR
MECHANICAL RIDES ON THE F.E.C. PROPERTY ONLY,
PURSUANT TO SECTION 2003.9 OF ORDINANCE
NO. 9500, AS AMENDED, THE ZONING ORDINANCE OF
THE CITY OF MIAMI, FLORIDA, AND SUBJECT TO
APPLICABLE REQUIREMENTS CONTAINED THEREIN;
AUTHORIZING THE CITY MANAGER TO ISSUE THE
NECESSARY PERMIT(S) AND TO EXECUTE THE
NECESSARY AGREEMENT(S), IN A FORM ACCEPTABLE
TO THE CITY ATTORNEY AND CONTAINING THE
PROVISIONS DETAILED HEREIN; SUBJECT TO AND
CONDITIONED UPON SUCH LIMITATIONS AND
REQUIREMENTS AS MAY BE PRESCRIBED BY THE CITY
OF MIAMI, INCLUDING THE REQUIREMENTS FOR
ADVANCE PAYMENT OF ALL CITY SERVICES AND FEES
AND PAYMENT FOR ANY AND ALL DAMAGES TO CITY
PROPERTY AS A RESULT OF SAID EVENT; FURTHER
DECLARING THAT THIS RESOLUTION DOES NOT
CONSTITUTE AUTHORIZATION FOR THE STAGING OF
ANY FUTURE CITYFAIR EVENTS AFTER 1988 AND
DIRECTING THAT AUTHORIZATION, IF ANY, FOR
FUTURE CITYFAIR EVENTS WILL BE CONTINGENT
UPON A FAVORABLE REVIEW OF SAID EVENT HELD IN
1988.
BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. Approval is hereby granted for a Temporary
Special Event known as the 1988 Miami CityFair to be conducted
December 2 - 11, 1988 in Bicentennial Park and on the Baywalk in
Bayfront Park and on the F.E.C. Property, for the operation of
mechanical rides, on the F.E.C. Property only, pursuant to
Section 2003.9 of Ordinance No. 9500, as amended, the Zoning
Ordinance of the City of Miami, Florida, subject to the sponsor's
compliance with applicable provisions contained therein including
obtaining a Class B Permit from the Zoning Administrator.
Section 2. The City Manager is hereby authorized to
issue the necessary permit(s) and to execute the necessary
agreement(s), in a form acceptable to the City Attorney which
agreements(s) shall include the following:

a. For the use of Bicentennial Park and the F.E.C.
Property, sponsor shall pay to the City Department of
Parks, Recreation and Public Facilities: $10,000, in
advance, as a minimum guaranteed fee for the use of
said facilities, said amount to be applied toward the
use fee to City of ten percent (10%) of total gross
receipts from all sources operating in or on said
facilities, including, without limitation, admissions,
concessions, rides and parking for use of said
facilities;
b. Sponsor shall enter into the necessary agreement(s)
with the Department of Off -Street Parking for the use
of Lot 24, and shall pay to said Department the sum of
$7,800 for the use of said lot;
C. Sponsor shall enter into the necessary agreement(s)
with the Bayfront Park Management Trust for the use of
the Bayfront Park Baywalk for exhibits and shall pay to
said Trust the following: (1) $5,000, in advance, as a
minimum guaranteed fee for the use of the Baywalk, said
amount to be applied toward the use fee to City of ten
percent (10%) of total gross receipts from all sources
operating in or on said Baywalk;
d. Furnishing of 1,000 tickets for inner city children;
e. Such limitation on the number of rides allowed to be
operating as may be determined by the City Manager;
f. Indemnification by Sponsor for the repair of any damage
to City -owned parks and the Grand Prix race course; and
g. Event operation to be in compliance with all existing
curfews and regulations with no overnight campers
allowed on the premise.
Section 3. The above authorizations and approvals are
further subject to and contingent upon the event not being a
violation of the terms of any existing agreements related to the
subject area of the event; the sponsor's compliance with any and
all applicable limitations and requirements as may be prescribed

by the administration of the City of Miami, including the
following requirements: that the City be insured against any
potential liability in an amount and by carriers deemed
satisfactory to the City Manager; that payment for all City
services and fees be made in full at least seven (7) days in
advance of said event, and that sponsor shall pay for any and all
damage to City property as a result of said event.
Section 4. The herein Resolution does not constitute
authorization for the staging of any future CityFair events after
1988 and authorization, if any, for future CityFair events will
be contingent upon a favorable review of said event held in 1988.

Dear Mr. Perez-Lugones:
Please accept this letter as a request to appear before
the July 14, 1988 City Commission Meeting by Michael "tilberq
and Robert N. Sechen for the purpose of obtaining permission
for the use of Bayfront Park, the F.E.C. Park and Bicentennial
Park and for granting a Temporary Special Event Permit for- the
staging of the Miami CityFair, including mechanical rides during
December 2nd through the llth, 1988, all in accordance with
Sections 2003.9.1 and 2003.9.3 of Zoning Ordinance number 9500.
