RESOLUTION NO.
A RESOLUTION RATIFYING, APPROVING AND
CONFIRMING, BY A 4/5THS AFFIRMATIVE VOTE OF
THE MEMBERS OF THE CITY COMMISSION, THE
ACTIONS OF THE CITY MANAGER IN FINDING A
VALID EMERGENCY NEED EXISTS WHICH NEED
JUSTIFIES THE WAIVER OF THE REQUIREMENT THAT
FORMAL COMPETITIVE BIDS BE SECURED FOR THIS
PROJECT AWARD; FURTHER ACCEPTING THE BID OF
TREE MASTERS, INC. FOR THE FURNISHING OF
DEMOLITION SERVICES AT THE STRUCTURES LOCATED
AT 1402 & "A" SOUTH BAYSHORE DRIVE TO THE
DEPARTMENT OF BUILDING AND ZONING AT A TOTAL
PROPOSED COST OF $7,506.00; ALLOCATING FUNDS
THEREFOR FROM THE BUILDING AND ZONING
DEMOLITION FUND ACCOUNT CODE #560502-340-
110035 WITH RECOVERY OF SAID AMOUNT TO BE
ACCOMPLISHED THROUGH NORMAL LIEN ENFORCEMENT
PROCEEDINGS.
WHEREAS, these structures have long been eyesores: vacant,
unsecure, harbors for vagrants, and sources of criminal activity,
posing threats to Firefighters and Police Officers who respond to
frequent calls from the equally endangered and outraged citizens;
and
WHEREAS, informal invitations were mailed and three (3) bids
were received June 30, 1988; and
WHEREAS, funds for this demolition are available from the
Building and Zoning Demolition Fund Account Code #560502-340-
110035 with recovery of said amount to be accomplished through
normal lien enforcement proceedings; and
WHEREAS, the City Manager has made a written finding that a
valid emergency exists which need justifies the waiver of the
requirement that formal competitive bidding methods be followed
in the procurement of the herein services; and
WHEREAS, the City Manager and the Director of the Department
of Building and Zoning recommend that the bid received from Tree
Masters, Inc. be accepted as the lowest responsible and
responsive bid which offers the combination of price and quality
that is most advantageous to the City;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:

REMARKS:
Section I. The June 30, 1988 bid from Tree Masters, Inc. in
the amount of $7,506.00 for furnishing demolition services at
1402 & "A" South Bayshore Drive to the Department of Building and
Zoning is hereby accepted with funds therefor hereby allocated
from the Building and Zoning demolition fund Account Code
#560502-340-110035 with recovery of said amount to be
accomplished through normal lien enforcement proceedings.
Section 2. The recitals and findings contained in the
Preamble to this Resolution are hereby adopted by reference and
incorporated herein as if fully set forth in this Section.
Section 3. The actions of City Manager as set forth in this
Resolution are hereby ratified, approved and confirmed by a 4/5
affirmative vote of the members of the City Commission.
PASSED AND ADOPTED this 21st day of July 1988.

This property is presenting a danger and hazard to its
neighbors, as well as the City's Fire and Police departments.
My office as well as the City Manager's office has received
numerous complaints regarding this property. I request
that the City Commission approve the lowest and most
responsive bid on Thursday so that we can move quickly to
demolish this unsafe structure. Attached please find
background information as prepared by the City Manager's
office.

It. is respectfully recommended that an Award be made and a
Resolution be passed accepting the lowest responsive and
responsible Bid as received from Tree Masters, a Demolition
Contractor, for the demolition and clearing away of debris at 1402
& "A" South Bayshore Drive at a total cost of $7,506.00.
BACKGROUND:
The Department of Building & Zoning has analyzed the need to execute
the attached resolution for the award of bid for the demolition of a
structure.
It is requested that formal bid process be waived and that the
demolition contract be awarded to Tree Masters, a demolition
contractor, based upon their informal. bid received by Procurement
Management for the City of Miami. The informal bids were requested
due to the urgency in having these structures demolished as
continuous complaints have been received from numberous members of
Brickell Avenue Association and Downtown Development Authority.
The subject buildings have long become eyesores. They are vacant,
unsecured and harbors for vagrants. They have been identified as
sources of criminal activity. This along with the fact that they
pose threats to Firefighters and Police Officers responding to
frequent calls from the equally endangered and outraged property
owners in the area justify the need for their removal.
Funds are to be provided by the Building & Zoning Demolition Fund
with recovery by normal lien enforcement, proceedings.
