HomeMy WebLinkAboutO-10463J-88-717 6/23/88 ORDINANCE NO. 10463► AN EMERGENCY ORDINANCE AMENDING SECTION 1 OF ORDINANCE NO. 10347, AS AMENDED, ADOPTED NOVEMBER 19, 1987, THE CAPITAL IMPROVEMENTS APPROPRIATIONS ORDINANCE, BY INCREASING THE PROJECT ENTITLED "ORANGE BOWL STADIUM MODERNIZATION PROJECT - PHASE I", PROJECT NO. 404237, IN THE AMOUNT OF $220,000; APPROPRIATING FUNDS IN SAID AMOUNT THROUGH AN INCREASE IN THE LOAN FROM THE DOWNTOWN PEOPLE -MOVER EXTENSION PROJECT DEPOSIT, PROJECT NO. 371001, FURTHER INCREASING SAID LOAN PAYMENTS BY $73,000 ANNUALLY TO A NEW MINIMUM YEARLY AMOUNT OF $240,000 WITHIN THE TIME FRAME OF FY'89 THROUGH FY191, BEING PRIMARILY SECURED BY THE METRO-DADE TOURIST DEVELOPMENT RESORT TAX, AND AS SECONDARY PLEDGE THE ORANGE BOWL STADIUM - EQUITY IN POOLED CASH; CONTAINING A REPEALER PROVISION AND A SEVERABILITY CLAUSE. WHEREAS, the City Commission adopted Ordinance No. 10347 on November 19, 1987, appropriating funds for Capital Improvement projects; and WHEREAS, in accordance with Section 2.136 of the Miami City Code (1980), the Planning Department has prepared and submitted to the City Commission a Capital Improvement Program (CIP) that identifies the sources of funding of all proposed capital projects valued at $5,000 or more for the program years 1987- 1993; and WHEREAS, this Program was adopted by the City Commission by Resolution No. 87-935 on October 22, 1987; and WHEREAS, the City Commission, adopted Ordinance No. 10433 on May 12, 1988, which established the project entitled "Orange Bowl Stadium Modernization - Phase I", in the amount of $1,010,000 in order to secure new long-term use agreements with the major tenants of said City facility; and WHEREAS, the City Manager and the Director of the Department of Parks, Recreation and Public Facilities, have identified the need for an increase in the amount of $220,000 to said project; and WHEREAS, said increase will provide for the necessary reroofing of the press facilities, additional structural engineering services, sound system engineering and equipment, elevator mechanics and a full-time on site inspector to ensure completion of the work by September 2, 1988; and WHEREAS, funds in the additional amount of $220,000 are available through a loan from the Downtown People -Mover Extension Project Deposit (Project No. 371001); and WHEREAS, said increase will further increase repayments of this loan by $73, 000 per year for a total minimum yearly amount of $240,000 within the time frame of fiscal years 189 through 191, being primarily secured by the Metro -Dade Tourist Development Resort Tax (Project No. 195001), and as secondary pledge the Orange Bowl Stadium - Equity in Pooled Cash (Project No. 404000); NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. Section 1 of Ordinance 10347, adopted November 19, 1987, as amended, is hereby further amended in the following particulars: 1 "Section 1. The herein appropriations are hereby made for implementation of all municipal capital improvements of the City of Miami, including new capital improvements projects scheduled to begin during fiscal year 1987-88. The herein appropriations which are hereby designated by reference to descriptive project title and number also include appropriations for previously approved scheduled projects as well as re -appropriations of prior fund appropriations. The source of revenues to support the herein appropriations is hereby identified by fund and project with the project appropriations and revenues therefor being set forth for seven program areas (I-VII) based upon use or functional category within said areas, as follows: 1 Words and/or figures stricken through shall be deleted. Underscored words and/or figures shall be added. The remaining provisions are now in effect and remain unchanged. Asterisks indicate omitted and unchanged material. All ordinances or parts of ordinances insofar as they are inconsistent or in conflict with the provisions of this ordinance are hereby repealed. Section 3. If any section, part of section, paragraph, clause, phrase or word of this ordinance is declared invalid, the remaining provisions of this ordinance shall not be affected. Section 4. This Ordinance is hereby declared to be an emergency measure on the grounds of urgent public need for the preservation of peace, health, safety, and property of the City of Miami and upon the further grounds of the necessity to make the required and necessary purchases and payments, and to generally carry out the functions and duties of municipal affairs. Repayment of this loan, in a minimum yearly amount of �4-67,000 $240,000 within the time frame of FY'89 through FY'91 being primarily secured by the Metro -Dade Tourist Development Resort Tax (Project No. 195001), and as secondary pledge the Orange Bowl Stadium - Equity in Pooled Cash (Project No. 404000). 1Q493 N �4'iJ)y Section 5. Odio FROM: REFERENCES: City Manager ENCLOSURES: Recommendation: It is respectfully recommended that the City Commission adopt the attached Emergency Ordinance to amend the Capital Improvement Program Ordinance (No. 10347) by increasing the project entitled "Orange Bowl Stadium Modernization Project - Phase I" and appropriating funds in the additional amount of $220,000 as an increase in the loan from the Downtown People -Mover Extension Project. Repayment of entire $720,000 loan will increase by $73,000 per year to a total minimum yearly amount of $240,000 within the time frame of FY'89 through FY'91, and will be primarily secured by the Metro -Dade- Tourist Development Resort Tax, and as secondary pledge the Orange Bowl Stadium - Equity in Pooled Cash. Background: The Parks, Recreation and Public Facilities Department has prepared the attached legislation to increase the project and appropriate additional funds for the Orange Bowl Stadium Modernization Project - Phase I. The Project was given initial approval by Commission Resolution No. 88-339, adopted April 14, 1988, which authorized the execution of an agreement with Kunde, Sprecher, Yaskin and Associates to provide design, engineering and project management services, in the amount of $60,000. Ordinance No. 10433, adopted May 12, 1988, formally established the Project (No. 404237) and appropriated funds in the amount of $1,010,000. Resolution No. 88-424, also adopted on May 12, 1988, further provided for the waiver of competitive sealed bids for Phase I construction; and authorized the City Manager to obtain and award informal bids for *this work so as to ensure completion by September 2, 1988, as mandated by the major tenants of the Stadium. Honorable Mayorand Members of the City Commission Page 2 Due to the fact that the project has a completion deadline of September 2, 1988 some additional and unforeseen elements must be added. These are identified below. $70,000 increase absorbed into the contract with Target Construction, Inc. for reroofing of the existing press facilities, which resulted in a higher construction price than anticipated. 20,000 for a full-time (and overtime) on -site inspector to ensure proper construction, without delays, to enable completion by September 2. 34,000 for additional engineering services by the City's consultant, Kunde, Sprecker, Yaskin and Associates, including revised conceptual plans for Phase II (as requested by the Mayor on June 9, 1988). 60,000 for the services of a sound engineer and a limited amount of new sound and video equipment for the press facilities. 36,000 for an increase to the amount budgeted for elevator equipment and related mechanics and electric, including an emergency generator. ,,, This $22O,000 increase will be provided through an increase to the loan from the Downtown - People Mover Extension Project, with a corresponding increase to the repayment schedule previously established by Ordinance No. 10433, which identified FY'89 - 191 Metro -Dade Resort Tax revenues and Orange Bowl Equity in Pooled Cash as the ultimate sources of repayment. This item is presented as an emergency measure so that funds are in place for work to be completed by September 2, 1988.
