A RESOLUTION BY AN AFFIRMATIVE VOTE OF 4/6THS
VOTE OF THE MEMBERS OF THE CITY COMMISSION
WAIVING FORMAL COMPETITIVE SEALED BID PROCEDURES
FOR CONSTRUCTION OF THE 'BAYFRONT PARK
REDEVELOPMENT - PEPPER FOUNTAIN PROJECT'
(CAPITAL IMPROVEMENT PROGRAM PROJECT NO.
331306); RATIFYING, APPROVING AND CONFIRMING THE
CITY MANAGER'S FINDING THAT AN EMERGENCY EXISTS
JUSTIFYING SUCH WAIVER FOR SAID PROJECT
CONSTRUCTION; AUTHORIZING THE CITY MANAGER TO
ACCEPT THE LOWEST RESPONSIVE AND RESPONSIBLE
BIDS FOR THE CONSTRUCTION OF THE FOUNTAIN UNDER
SAID PROJECT; FURTHER AUTHORIZING THE CITY
MANAGER TO EXECUTE AND/OR ISSUE THE NECESSARY
DOCUMENTS, IN A FORM ACCEPTABLE TO THE CITY
ATTORNEY, WITH THE SUCCESSFUL BIDDER(S).
WHEREAS, the City Manager has made a written finding that
construction of the Bayfront Park Redevelopment Pepper Fountain
Project constitutes a valid public emergency which requires the
immediate procurement of construction services to protect the
welfare, safety and convenience of the City; and
WHEREAS, the nature of said emergency is based on the City's
need for the fountain to be completed and in operation by the
planned New Year's and Super Bowl related events to be held in
the park in January; and
WHEREAS, it is necessary to begin the Project constrmctfen
by September ist, 1988, in order to meet the desired completion
deadline of January 1, 1989; and
WHEREAS, said deadline does not allow sufficient time for
the formal advertising, receipt of bids, and award of contracts
which are normally required procedures; and
WHEREAS, a total of $2.75 million is available for the
construction of the project and is currently appropriated to
Capital Improvement Program Project No. 331306 BAYFRONT PARS
REDEVELOPMENT - PEPPER FOUNTAIN.
WHEREAS. the City Manager and Director of the Department of
Public Works recommend that informal bid procedures be utilized
to procure the needed services and/or materials for the project
construction; and

WHEREAS, after receipt of informal bids, contracts for said
services and/or materials will be awarded to the lowest
responsive and responsible bidders by the City Manager; and
WHEREAS, the foregoing is being presented at a properly
advertised public hearing before the City Commission;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
SECTION I. The recitals contained in the preamble to this
Resolution are hereby incorporated by reference thereto and
adopted as if fully set forth in this Section.
SECTION 2. The City Manager's finding that a valid public
emergency exists justifying such waiver for said project is
hereby ratified, approved and confirmed.
SECTION 3. By an affirmative vote of 4/5ths of the members
of the City Commission, formal competitive sealed bid procedures
for the procurement of services and/or materials for the
construction of the Bayfront Park Redevelopment -Pepper Fountain
are hereby waived. No later than 48 hours prior to the issuance
of invitations for bid the design and plans for the herein
Project, together with a firm estimate of Project cost shall be
furnished to each member of the City Commission. Within such 48-
hour period, any Commissioner shall have the right to order the
City Manager to take no further action on this Project until the
City Commission authorizes further action.
SECTION 4. The City Manager is hereby authorized to accept
the lowest responsive and responsible bids for the construction
of said project.
SECTION 5. The City Manager is hereby authorized to execute
and/or issue the necessary documents, in a form acceptable to the
City Attorney, with the successful bidder(s) for the construction
of said project.

It is respectfully recommended that the City Commission adopt a
Resolution by an affirmative vote of 4/5's of the Commission
waiving formal competitive sealed bid procedures for construction
of the BAYFRONT PARK REDEVELOPMENT - PEPPER FOUNTAIN project;
ratifying, approving and confirming the City Manager's findin
that an emergency exists justifying such waiver for said project
construction; authorising the City Nang, or to accept the lowest
responsive and responsible bid for the construction of the
Project; and further authorising the C1 Manager to execute
and/or issue the necessary documents, in a ora acceptable to the
City Attorney, with the successful bidder.
BACKGROUND
I have made a written finding that there is a valid public
emergency need for the Pepper Fountain to be built at the
intersection of the Baywalk and the Fiagier Street Promenade in
Bayfront Park to be completed by the time the schedule Now Year's
and Super Bowl related events are held in the park. Following
the standard formal competitive sealed bid procedures for
awarding of a construction contract would mean that we would not
begin construction until late September or early October. It is
necessary, even with the special assistance the City and the
City's Consultants will provide to the contractor in securing
equipment and materials, permits, inspection, and timely answers
to construction problems, to begin construction by Soptom6or 1st
in order for the project to be completed by January 1st, 1"9.

Emergency Need for Waiver of
Formal Competitive Bid

Based on information supplied to me by the Director of the
Department of Public Works and the Bayfront Park
Redevelopment Project Manager I have found that there exists
an emergency need for a waiver of formal competitive sealed
bid procedures for the construction of the Bayfront park
Redevelopment - Pepper Fountain Project.
The reason for the emergency need is as follows:
Several events related to New Years and/or the Super
Bowl are scheduled to be held in Bayfront Park.
These events will be attended by thousands of people,
many of whom will be assembled immediately ad,jaceet
to the proposed fountain site. Under normal bidding
procedures the construction of the fountain could not
begin until October which would dictate that the
fountain would still be in an incomplete status at
the time of the events and thereby constitute a
hazardous and unsightly condition.
Waiver of the formal competitive sealed bid procedure
will allow us to receive. sealed
bids utilizing an
abbreviated bidding period and start
construction by
September 1st, I.M. This
early start of
construction will permit essential
completion of the
fountain by the time of the scheduled
events thereby
adding to the safety and welfare
of the public and
improving the image of the park,
and the City in
general in the eyes of the local
public, visitors,
and local and national media who will
be attracted by
the events.
